IITY COUNCIL REGULAR MEET?
CITY OF TUSTIN
AUGUST 191 1991 - 7:00 P.M.
The City Council meets the first and third Monday of each month at 7:00 p.m.
in the City Council Chambers at 300 Centennial Way.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk for clarification. Except as otherwise provided by law, no
action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for public
use in the City Council agenda books located in the Police Department and
the Tustin Public Library. These same books are also provided for public
use in the Council Chambers during the Council meeting. Listening devices
for the hearing impaired are available upon request from the City Clerk.
Smoking is prohibited in the Council Chambers; however, if you desire to
smoke, an outside speaker has been provided.

V. PUBLIC HEARING
1. 1991-92 BUDGET
Scheduled hearing to receive public input prior to final adoption
,of the City of Tustin 1991-92 budget.
Recommendation: Pleasure of the City Council.
VI. PUBLIC INPUT - At this time members of the public may address the City
Council regarding any items not on the agenda and within the subject
matter jurisdiction of the City Council (,NO action can be taken on
off -agenda items unless authorized by law).
If you wish to address the City Council on any matter, please fill out
one of the forms located on the speaker's podium and submit to the
City Clerk so that your remarks on the tape recording of the meeting
can be attributed to you. When you start to address the City Council,
please state your full name and address for the record. A Public
Input portion is provided both at the beginning and end of the
meeting.

VII. CONSENT CALENDAR - All matters listed under Consent Calendar are
considered rout i and will be enacted by c motion. There will be
no separate dis ,sion of these items prior the time of the voting
on the motion unless members of the Council, staff or public request
specific items be discussed and/or removed from the Consent Calendar
for separate action.
1. APPROVAL OF MINUTES - AUGUST 5, 1991 REGULAR MEETING
Recommendation: Approve the City Council Minutes of August 5,
1991.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $1,107.022.45
and ratify Payroll in the amount of $291,317.19.
3. RESOLUTION NO. 91-104 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR
THE REPLACEMENT OF WATER MAINS ON THEODORA DRIVE, LIVINGSTON
AVENUE, LILLIAN WAY, CANDEDA PLACE, ROMANZA PLACE, LEON PLACE AND
LEON WAY, AND AUTHORIZING ADVERTISEMENT FOR BIDS
Recommendation: Adopt Resolution No. 91-104 approving plans and
specifications for subject project and directing the City Clerk
to advertise for bids as recommended by the Public Works
Department/Engineering Division.
4. AWARD OF CONTRACT - CENTENNIAL PARR PLAY STRUCTURES
Recommendation: Award the contract for Centennial Park play
structures in the amount of $11,950 to Miracle Recreation
Equipment Company as recommended by the Community Services
Department.
S. AWARD OF CONTRACT - FRONTIER PARR PLAY STRUCTURES
Recommendation: Award the contract for Frontier Park play
structures in the amount of $11,843 to Miracle Recreation
Equipment Company as recommended by the Community Services
Department.
6. PROFESSIONAL SERVICES AGREEMENT FOR THE AMAGANSET WAY STORM DRAIN
PROJECT BETWEEN NORTH TUSTIN CHANNEL (F12) AND ACACIA DRIVE AREA
Recommendation: Authorize City staff to process a Professional
Services Agreement with Gong Enterprises, Inc. for providing
consulting engineering services for subject project in the
amount of $45,870.00 and authorize the execution of the
agreement by the Mayor and City Clerk as recommended by the
Public Works Department/Engineering Division.
7. CLAIM NO. 91-131 ECRERLING V. CITY OF TUSTIN, COUNTY OF ORANGE
Recommendation: Authorize and direct the City Attorney's office
to defend the County of Orange and the City of Tustin in subject
matter as recommended by the City Attorney.
S. UTILITY AGREEMENT NO. 12145 WITH THE STATE OF CALIFORNIA,
DEPARTMENT OF TRANSPORTATION, TO PROVIDE FOR RELOCATION OF
EXISTING WATER MAIN TO ACCOMMODATE I-5 FREEWAY WIDENING
Recommendation: Authorize the Mayor and City Clerk to execute
subject agreement as recommended by the Public Works Department/
Engineering Division.

9. RESOLUTION , 91-107 - A RESOLUTION O. AE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR
SLURRY SEAL PROJECT 1989-90 FY AND 1990-91 FY AND AUTHORIZING
ADVERTISEMENT FOR BIDS
Recommendation: Adopt Resolution No. 91-107 approving plans and
specifications and authorizing advertisement of bids for subject
project as recommended by the Public Works Department/
Engineering Division.
10. AWARD OF CONTRACT FOR ASPHALT CONCRETE REHABILITATION AND OVERLAY
PROJECT, 1989-90 FY AND 1990-91 FY
Recommendation: Award the contract to R. J. Noble Company of
Orange in the amount of $368,042.85 for subject project as
recommended by the Public Works Department/ Engineering Division.
11. RESOLUTION NO. 91-105 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR
SIDEWALK AND WHEELCHAIR RAMPS - SB 821 PROJECT, 1990-91 FY AND
1991-92 FY
Recommendation: Adopt Resolution No. 91-105 approving plans and
specifications for subject project and directing the City Clerk
to advertise for bids as recommended by the Public Works
Department/Engineering Division.

IB. ORDINANCES FOR ADOPTION
1. ORDINANCE NO. 1075 - ZONING ORDINANCE AMENDMENT 91-01
The following Ordinance No. 1075 had first reading by title only
and introduction at the August 5, 1991 City Council meeting:
ORDINANCE NO. 1075 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING ZONING ORDINANCE AMENDMENT 91-01,
AN AMENDMENT TO MOBILE HOME PARK REQUIREMENTS, EXEMPTING CERTAIN
PARCELS FROM NONCONFORMING STATUS RELATED TO DENSITY WHEN THE
NONCONFORMITY IS A RESULT OF ACQUISITION OF PUBLIC RIGHTS-OF-WAY
BY A PUBLIC AGENCY
Recommendation: Have second reading by title only and adoption of
Ordinance No. 1075 (roll call vote).

Xi. NEW BUSINESS
1. BUILDING PERMIT PROCESS
At their meeting of July 15, 1991, the City Council directed the
Community Development Department to prepare a report addressing
processes and improvements that could be implemented to improve
customer service regarding the building permit process.
Recommendation: Receive and file subject report as recommended
by the Community Development Department.

2. ORAL REPORT TILLER DAYS 1991
Representatives from Tustin Tiller Days will be present to provide
the City Council with an update for the 1991 celebration, present
a financial status report from last year, and request financial
support from the City Council for 1991.
Recommendation: Pleasure of the City Council.
3. YOUTH ISSUES COMMITTEE
In response to the School Board action appointing three members to
the Joint Youth Issues Committee, Mayor Pro Tem Pontious requested
that staff agendize this item for Council discussion.
Recommendation: Pleasure of the City Council.
4. COMPENSATION - ELECTED CITY CLERK
Councilmember Prescott requested that this item be placed on the
agenda for City Council consideration.
Recommendation: Pleasure of the City Council.
%II. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - AUGUST 12, 1991
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of
August 12, 1991.
2. SOLID WASTE COLLECTION FEES
At their meeting of July 15, 1991, the City Council directed staff
to survey neighboring cities regarding refuse collection fees.
Recommendation: Receive and file subject report as recommended by
the Finance Department.
3. SUMMER YOUTH SPORTS PROGRAMS STATUS REPORT
Status report on the Summer Youth Sports Program, consisting of a
basketball and soccer league for youth 12-14 years old.
Recommendation: Receive and file subject report as recommended by
the Community Services Department.
4. WATER CONSERVATION UPDATE
Status report on the City's Mandatory Water Conservation Program.
Recommendation: Receive and file subject report as recommended by
the Finance Department.

S. CITIZEN COMPLAINT - EL CAMINO REAL
At the Augt. 5, 1991 City Council mee 1, a resident raised a
complaint regarding excessive noise, truck traffic and pollution
caused by construction contractor's use of the vacant lot at 165
El Camino Real.
Recommendation: Receive and file subject report as recommended by
the Public Works Department/Engineering Division.
6. REQUEST FOR WALL CONSTRUCTION
During the preparation of the 1991-92 Capital Improvement Budget,
staff received a verbal request from a resident for the City to
construct a concrete block wall along the northerly side of Bryan
Avenue between Stonehenge Drive and the E1 Modena -Irvine Channel
right-of-way (westerly of Browning Avenue).

XV. CLOSED SESSION
Pleasure of the City Council.
The City Council will recess to Closed Session pursuant to Government
Code Section 54956.9(a) to confer with the City Attorney regarding
pending litigation which has been initiated formally and to which the
City is a party. The title of the litigation is Harris vs City of
Tustin and the case number is 624828.
XVI. ADJOURNMENT
The City Council has scheduled a Sign Code Workshop with the Planning
Commission on August 20, 1991, at 5:30 p.m. at the Senior Center. The
next regular meeting of the City Council is scheduled for Tuesday,
September 3, 1991, at 7:00 p.m.
