CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. Kendig ORAL COMMUNICATION/PUBLIC INPUT — At this time, any member of the public may address the City Council on matters which are listed on this agenda or under the jurisdiction of the City Council. Persons wishing to speak regarding Consent Calendar matters should file a "Request to Speak" form with the City Clerk. (Agenda Items 1 through 8) 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Recommendation: That the City Council waive reading in full of all ordinances City Council March 15, 2016 Meeting Agenda Page 2 of 6 and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON MARCH 1, 2016 AND SPECIAL MEETING OF THE CITY COUNCIL HELD ON MARCH 1, 2016 Recommendation: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on March 1, 2016 and the Special Meeting of the City Council held on March 1, 2016. 3. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Recommendation: Approve Payroll in the amount of $674,984.98 and Demands in the amount of $3,102,313.29. 4. 2015 GENERAL PLAN ANNUAL REPORT AND ANNUAL MITIGATION MONITORING STATUS REPORT FOR FEIS/EIR FOR MCAS TUSTIN SPECIFIC PLAN The California Government Code requires that the Planning Commission provide an annual progress report to the City Council on the status of the City's General Plan and the progress in its implementation, including the progress in meeting our share of regional housing needs and efforts to remove governmental constraints to housing development, maintenance, and improvement. In addition, the City Council certified the Program Final Environmental Impact Statement/Environmental Impact Report (FEIS/EIR) for the Disposal and Reuse of MCAS Tustin along with its Supplemental and Addendums. The FEIS/EIR evaluated the environmental impacts of the reuse and disposal of MCAS -Tustin, which included the adoption of a Mitigation Monitoring and Reporting Program (MMRP) pursuant to CEQA Guidelines Section 15097. The MMRP requires annual review to ensure compliance with required mitigations. On March 8, 2016, the Planning Commission reviewed the General Plan Annual Report and Annual Mitigation Monitoring Status Report and authorized staff to forward the reports to the City Council. With Council authorization, staff will forward the General Plan Annual Report to the State Office of Planning and Research and the State Department of Housing and Community Development (HCD) in fulfillment of the State's requirement, and receive and file the Annual Mitigation Monitoring Status Report. City Council March 15, 2016 Meeting Agenda Page 3 of 6 Recommendation: That the City Council: 1. Authorize staff to forward the General Plan Annual Report to the State Office of Planning and Research and the State Department of Housing and Community Development; and 2. Receive and file the Annual Mitigation Monitoring Status Report and authorize staff to submit a subsequent report when considerable and significant activities occur. 5. FY2015 URBAN AREA SECURITY INITIATIVE (UASI) GRANT The City of Santa Ana, in its capacity as a Core City for the Anaheim/Santa Ana Urban Area, has applied for, received and accepted a grant entitled "FY 2015 Urban Areas Security Initiative" (UASI). This grant is from the Federal Department of Homeland Security, Federal Emergency Management Agency, through the State of California Emergency Management Agency. It is intended to enhance countywide emergency preparedness, and to help the Operational Area prevent, respond to, and recover from acts of terrorism, as set forth in the grant guidelines and assurances that are incorporated into the Agreement by reference. The Office of Grants and Training has awarded $4,400,000.00 to the City of Santa Ana for use in the Anaheim/Santa Ana Urban Area, for the term of November 18, 2015, through April 30, 2018. The funds are now available for distribution throughout the Operational Area, and the City of Tustin, as a Sub - Recipient, is authorized to participate in the grant funding. In addition to being a Sub -Recipient for Operational Area projects, the City of Tustin has been awarded $3,409.00 towards UASI sponsored training. The training funds allow personnel to attend training free of charge. With the exception of "instructor training", the training fund does not provide for overtime backfill. First, however, the City must designate an authorized representative and approve the Transfer Agreement. Recommendation: That the City Council: 1. Adopt Resolution 16-13, designating the Chief of Police or his designee as the City's authorized representative for the FY 2015 UASI grant. 2. Approve the FY 2015 UASI Transfer Agreement between the City of Santa Ana and the City of Tustin. RESOLUTION NO. 16-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING THE CHIEF OF POLICE OR HIS DESIGNEE AS THE CITY'S AUTHORIZED REPRESENTATIVE FOR THE FY 2015 URBAN AREAS SECURITY INITIATIVE (UASI) City Council March 15, 2016 Meeting Agenda Page 4 of 6 6. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR THE ANNUAL ROADWAY REHABILITATION AND CITYWIDE SIDEWALK REPAIR PROJECT CIP NO. 70015 The plans and specifications for the Annual Roadway Rehabilitation and Citywide Sidewalk Repair Project CIP No. 70015 have been prepared and the project is now ready to be bid. Recommendation: That the City Council adopt Resolution No. 16-15 approving the plans and specifications for the Annual Roadway Rehabilitation and Citywide Sidewalk Repair Project CIP No. 70015, and authorize the City Clerk to advertise to receive bids. RESOLUTION NO. 16-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE ANNUAL ROADWAY REHABILITATION AND CITYWIDE SIDEWALK REPAIR PROJECT CIP NO. 70015 AND AUTHORIZING ADVERTISEMENT FOR BIDS 7. ADOPT RESOLUTION NO. 16-14 TO APPROVE THE SUBMITTAL OF A PLANNING PROJECT APPLICATION TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR FUNDING UNDER THE 2016 COMPETITIVE MEASURE M2 PROJECT V COMMUNITY-BASED TRANSIT/CIRCULATORS GRANT PROGRAM City Council adoption of Resolution No. 16-14 will approve the submittal of an application for a planning study project to determine the feasibility of implementing a local transit/circulator system within the city to the Orange County Transportation Authority (OCTA) under the 2016 Call for Projects for the Competitive Measure M2 Project V Community -Based Transit/Circulators Grant Program. The planning study will evaluate a local transit/circulator system with fixed routes in the form of a trolley or shuttle that serves major retail centers within the City such as The District, Tustin MarketPlace and Old Town Tustin as well as connecting Metrolink passengers from the Tustin station to job centers and other major generators and attractors. Recommendation: That the City Council adopt Resolution No. 16-14 approving the submittal of the application to the Orange County Transportation Authority for funding of the planning study under the 2016 Call for Projects for the Measure M2 Project V Community -Based Transit/Circulators Grant Program. RESOLUTION NO. 16-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE SUBMITTAL OF A PLANNING PROJECT City Council March 15, 2016 Meeting Agenda Page 5 of 6 APPLICATION TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR FUNDING UNDER THE 2016 COMPETITIVE MEASURE M2 PROJECT V COMMUNITY-BASED TRANSIT/CIRCULATORS GRANT PROGRAM 8. APPROVE GRANT OF EASEMENT TO THE SOUTHERN CALIFORNIA EDISON COMPANY OVER A PORTION OF CENTENNIAL PARK Southern California Edison (SCE) has determined it to be necessary to replace cables connecting two transformers located on the cul-de-sacs of Attboro Place and Cheshire Place. It is necessary for the City of Tustin to grant an easement to SCE over the City owned Centennial Park property for the installation of conduit and pull boxes and for access and maintenance purposes. Recommendation: That the City Council grant an easement to the Southern California Edison Company over a portion of Parcel 2 of Lot Line Adjustment No. 83-2, Recorded October 21, 1983 as Document No. 83-465817 in the Orange County Recorder's Office, as shown on the attached easement document exhibits for electrical facilities and access purposes, and authorize the Mayor and City Clerk to execute the document on behalf of the City.
