HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: CITIZEN COMPLAINT - EL CAMINO REAL RECOMMENDATIONS: Receive and file. BACKGROUND: At the August 5, 1991 City Council meeting, Helen Lawrence raised a complaint regarding excessive noise, truck traffic and pollution caused by construction contractor's use of the vacant lot at 165 El Camino Real. DISCUSSION: Staff has investigated this complaint and confirmed that Intersection Maintenance Service (IMS) of Anaheim has been utilizing the site as a construction staging site and storage area for their work on a City contract. I.M.S. is under contract to the City and is the contractor for traffic signal installations and/or modifications at the five following intersections: * Yorba Street at Vandenberg Lane * Bryan Avenue at Farmington Road * Red Hill Avenue at Mitchell Avenue * Walnut Avenue at Browning Avenue * Red Hill Avenue at Bryan Avenue As indicated at the last City Council meeting, the contractor reached an agreement directly with the property owner for their use of the vacant lot at El Camino Real. The City was not involved in this agreement. The contractor has been informed that he must apply for a Temporary Use Permit from the Community Development Department to determine if his use of the property, as a construction yard, can be continued. During this application period for the temporary use permit the Contractor has been directed to curtail any excessive noises and creation of dust, and to reduce any unnecessary truck traffic. Citizen Complaint - E1 Camino Real August 14, 1991 Page 2 I.M.S. has indicated that their current contract will last an additional 6-8 weeks. However, the City just awarded a second Traffic Signal Improvement Contract to the same firm,. but they have not indicated that they plan on utilizing the site for the second project. After the contractor has processed the application for the temporary use permit, staff will provide a follow-up report to the Council.
