:ITY COUNCIL REGULAR MEET:
CITY OF TUSTIN
SEPTEMBER 31 1991 - 7:00 P.M.
The City Council meets the first and third Monday of each month at 7:00 p.m.
in the City Council Chambers at 300 Centennial Way.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk for clarification. Except as otherwise provided by law, no
action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for public
use in the City Council agenda books located in the Police Department and
the Tustin Public Library. These same books are also provided for. public
use in the Council Chambers during the Council meeting. Listening devices
for the hearing impaired are available upon request from the City Clerk.
Smoking is prohibited in the Council Chambers; however, if you desire to
smoke, an outside speaker has been provided.

V. PUBLIC HEARINGS
1. APPEAL OF CONDITIONAL USE PERMIT 91-10, DESIGN REVIEW 91-07, AND
AMENDMENT TO CONDITIONAL USE PERMIT 89-25 (PAQUETTE/KUMAGAI)
On July 22, 1991, the Planning Commission received testimony
concerning Conditional Use Permit 91-10, Design Review 91-07 and
Amendment to Conditional Use Permit 89-25 for the properties
located at 135 South Prospect Avenue and 240 East First Street.
The requests made by co -applicants, Stephen Paquette and Henry
Kumagai, were denied by the Planning Commission.
Recommendation: Pleasure of the City Council.
2. APPEAL OF VARIANCE 91-13 (KUMAGAI)
Applicant has requested authorization to install a monument sign
along street frontage of 110 feet where 150 feet is required and
permit such sign to encroach nine feet into the required 10 -foot
front yard setback on the property located at 240 East First
Street.
Recommendation: Pleasure of the City Council.

can be attributed to you. When you start to address the City Council,

Input portion is provided both at the beginning and end of the
meeting.
VII. CONSENT CALENDAR - All matters listed under Consent Calendar are
considered routine and will be enacted by one motion. There will be
no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request
specific items be discussed and/or removed from the Consent Calendar
for separate action.
1. APPROVAL OF MINUTES - AUGUST 19, 1991 REGULAR MEETING
Recommendation: Approve the City Council Minutes of August 19,
1991.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $1,525,334.52
and ratify Payroll in the amount of $278,286.58.
3. REJECTION OF CLAIM NO. 91-37 - CLAIMANT, JENNIFER JOUBRAN; DATE OF
LOSS, 7/22/91; DATE FILED WITH CITY, 8/2/91
Recommendation: Reject subject claim for property damages in
the amount of $316.30 as recommended by the City Attorney.
4. VESTING TENTATIVE TRACT MAP NO. 14381
RESOLUTION NO. 91-114 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL
IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR
85-21, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA)
IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE
TRACT MAP NO. 14381 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN
INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT
Recommendation: Approve the environmental determination for the
project by adopting Resolution No. 91-114; and
RESOLUTION NO. 91-115 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE TRACT MAP
NO. 14381
Recommendation: Approve Vesting Tentative Tract Map No. 14381
by adopting Resolution No. 91-115 as recommended by the
Community Development Department.
5. REJECTION OF CLAIM NO. 91-35 - CLAIMANT, ERIC KOLLWITZ; DATE OF
LOSS, 2/7/91; DATE FILED WITH CITY, 8/6/91
Recommendation: Reject subject claim for general and special
damages of an undetermined amount as recommended by the City
Attorney.

6. AUTHORIZATT" TO ADVERTISE FOR BIDS FOr 'AUREL GLEN PARK
Recommenk on: Approve plans and s, ifications to authorize
advertisements for bids for construction of Laurel Glen Park as
recommended by the Parks and Recreation Commission and Community
Services Department.
UTION NO. 91- 44 - A RESOLUTION OF THE CITY COUNCIL OF THE

CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR INSTALLATION
OF EAST TUSTIN MEDIAN ISLAND LANDSCAPING AND IRRIGATION ON TUSTIN
RANCH ROAD, JAMBOREE ROAD, IRVINE BOULEVARD, PORTOLA PARKWAY, AND
LA COLINA DRIVE
Recommendation: Accept the improvements constructed and
authorize the recordation of the Notice of Completion for said
improvements with adoption of Resolution No. 91-114 as
recommended by the Public Works Department/ Engineering Division.
S. CIVIC CENTER EDISON COMPANY EASEMENT
Recommendation: Authorize the granting of an easement to the
Southern California Edison Company for the relocation of an
electrical service to the City Hall facility and authorize the
Mayor to execute said easement document as recommended by the
Public Works Department/Engineering Division.

%I. NEW BUSINESS
1. FEE WAIVER/REFUND (PAQUETTE/KUMAGAI)
Co -applicants, Stephen Paquette and Henry Kumagai, are requesting
that the Council refund the application fees for Conditional Use
Permit 91-10, Design Review 91-07 and Amendment to Conditional Use
Permit 89-25; additionally they are requesting a waiver of appeal
fees.
Recommendation: Pleasure of the City Council.
2. SOUNDING OF LOCOMOTIVE WARNING EQUIPMENT
At the City Council meeting of August 19, 1991, Councilmember
Edgar requested a report regarding the sounding of locomotive
warning equipment when approaching railroad at -grade crossings
with streets and roads.
Recommendation: Receive and file subject report as recommended by
the Public Works Department/Engineering Division.

All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.

2. INVESTMENT SCHEDULE AS OF JUNE 30, 1991
Investment schedule with maturities, 12 months or less.
Recommendation: Receive and file subject report as recommended by
the Finance Department.
3. OLIVE TREE PLANTING - IRVINE BOULEVARD WESTERLY OF NEWPORT AVENUE
At the August 16,. 1991 City Council meeting, Councilmember Edgar
requested staff study the feasibility of planting an olive tree
within the recently modified median island on Irvine Boulevard
between Newport Avenue and Plaza Drive.
Recommendation: Receive and file subject report as recommended by
the Public Works Department/Engineering Division.
