FINAL PARCEL MAP 2002-106
SUMMARY:
Final Parcel Map 2002-106 is a request to subdivide a 1.62-acre site at 535 E. Main Street
into two (2) parcels for the purpose of conveyance. Parcel 1 will contain an existing 4,773
square foot retail building and Parcel 2 will contain an existing carwash, 1,236 square foot
convenience store, and gas fueling station canopy. On August 26, 2002, the Planning
Commission recommended that the City Council approve Tentative Parcel Map 2002-106
and on September 3, 2002, the City Council approved Tentative Parcel Map 2002-106 by
adopting Resolution 02-81 with conditions to ensure compliance with the Subdivision Map
Act. All conditions have been fulfilled and the final map may be approved and recorded.

RECOMMENDATION:
That the City Council adopt Resolution No. 03-73 approving Final Parcel Map 2002-106.
FISCAL IMPACT:
Final Parcel Map 2002-106 is an applicant-initiated project. The applicants have paid
applicable fees for the processing of this map.
ENVIRONMENTAL:
Final Parcel Map 2002-106 is Categorically Exempt pursuant to Section 15315, Class 15
of Title 14, Chapter 3 of the California Code of Regulations (Guidelines for the California
Environmental Quality Act).
DISCUSSION:
The project site is developed with an existing 4,773 square foot retail building and a car
wash, 1,236 square foot convenience store, and gas fueling station canopy at 535 E. Main
Street (Attachment A - Location Map).

The applicant wishes to subdivide the site into two (2) parcels for conveyance purposes as
follows:

Each parcel of the subdivision would meet the development standards of the Central
Commercial and Parking Overlay zoning district, including the minimum site area, lot
width, setbacks, number of parking spaces, and driveway widths. However, the two
parcels would maintain reciprocal ingress, egress, and parking and share a common trash
enclosure and utilities (Attachment B -Submitted Map). To ensure reciprocity and
continuous maintenance of the common areas, a covenant of easement with maintenance
provisions has been prepared and approved by the City Attorney, which will be recorded
with the final parcel map.
The final parcel map is in substantial conformance with the requirements of the Tentative
Parcel Map, the City's Zoning and Subdivision Codes, and the State Subdivision Map Act.
Staff recommends that the City Council adopt Resolution 03-73 (Attachment- C)
approving Final Map 2002-106, subject to compliance with all applicable requirements to
the satisfaction of the City Engineer prior to recordation.

APPROVING FINAL PARCEL MAP 2002-106 TO SUBDIVIDE A 1.62
ACRE PARCEL CURRENTLY DEVELOPED WITH A CAR WASH,
CONVENIENCE STORE, AND FUELING STATION CANOPY AND A
RETAIL BUILDING INTO TWO (2) PARCELS FOR CONVEYANCE
PURPOSES.
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:
A.
Final Parcel Map 2002-106 to subdivide a 1.62 acre parcel with existing
development into two (2) parcels of 0.57 and 1.05 acres located at 535
E. Main Street, for conveyance purposes, was submitted by Tom
Baumgartner on behalf of Tustin Car Wash for consideration. The 0.57
parcel (Parcel 1) will contain a 4,773 square foot retail building and the
1.05 parcel (Parcel 2) will contain the carwash, 1,236 square foot
convenience store, and fueling station canopy;

The Planning Commission recommended that the City Council approve
Tentative Parcel Map 2002-106 on August 26, 2002, and the City
Council approved Tentative Parcel Map 2002-106 on September 3,
