HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: TUSTIN RANCH ROAD AT SANTA ANA (I-5) FREEWAY INTERCHANGE (P.W. FILE NO. 897H) RECOMMENDATIONS: That the Tustin City Council adopt Resolution No. 91-123 accepting works of improvement on the Tustin Ranch Road at Santa Ana (I-5) Freeway Interchange and authorizing the recordation of Notice of Completion for said work. Assuming no claims or stop payment notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, that staff be authorized to release the retention monies in the amount of $486,595.89 that are being held in an escrow account at Bank of America. BACKGROUND: In April, 1989, the City Council awarded a contract to Steve P. Rados, Inc. in the amount of $10,041,836.40. This project consisted of the following improvements for the Tustin Ranch Road/ I-5 Interchange: * Overcrossing of the I-5 Freeway * Northbound I-5 off -ramp to Tustin Ranch Road * Southbound Tustin Ranch Road on-ramp to I-5 Freeway * Segments of freeway widening from six to twelve lanes * Soundwalls The remaining work of the interchange, consisting of the northbound I-5 on-ramp from Tustin Ranch Road and the southbound off -ramp from the I-5 freeway to Tustin Ranch Road was not included within this contract and is being constructed under a separate contract being administered by Caltrans as part of the freeway widening between Tustin Ranch Road and Newport Avenue. These ramps are scheduled for completion about Spring of 1992. The contractor, Steve P. Rados, Inc., previously requested an escrow account be set up with Bank of America for retention earnings required to be withheld pursuant to the construction contract entered into between the City and the contractor. These retention monies amount to 5% of the total monies earned by the contractor for the duration of the contract. DISCUSSION: All work has been completed to the satisfaction of the Tustin Engineering Division and the Caltrans Resident Engineer and has been accepted by both Caltrans and the City's staff. The final contract amount is $10,899,013.50 which is inclusive of $857,177.10 for contract change orders. Approximately $490,000 of this change order amount will be returned to the City by other agencies that required work to be done under the City's contractor so as not to delay project progress, the remaining change order amounts pertained to routine miscellaneous work items required under Caltrans contract administration procedures and items of work not included on the original plan preparation. Attached is a copy of the Caltrans recommendation of contract acceptance. It is recommended that the City Council accept the works of improvement on the subject project and authorize the recordation of the Notice of Completion for said work with the adoption of Resolution No. 91-123. Rados, Inc. , having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Tustin Ranch Road at Santa Ana (I-5) Freeway Interchange. AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be and is hereby authorized to execute and file a Notice of Completion and acceptance of said public work and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin on the 16th day of September, 1991. RECOMMENDED ACCEPTANCE CONTRACTOR DATE COMPLETED WORK ON CONTRACT: The work performed consisted of widening the Santa Ana Freeway and constructing an interchange at the Tustin Ranch Road Overcrossing in accordance with the plans and specifications. The work was completed on time. ESTIMATED FINAL COST: $10,899,013.50 It is recommended this contract be accepted by the Director of Public Works City of Tustin. RESIDENT ENGINEER: Enrique A.
