SUBJECT: STEVENS, SQUARE PARKING STRUCTURE LITIGATION
The litigation regarding the repairs and reconstruction of the
Stevens square parking structure has reached a point where a
settlement has been reached which is acceptable to all of the other
parties to -the litigation. The proposed settlement involves
various other parties paying $410,000. All of this sum would be
paid to Stevens Square, a California limited partnership, which has
paid all of the .cost of the repairs and reconstruction. The actual
cost of the repairs totalled $552,895.98.
Enclosed is a copy of the proposed Settlement Agreement. *
I have spoken with the firm of Layman, Jones & Dye, which has
represented the plaintiffs in this action and that firm has
confirmed to me that no claim, lien or encumbrance of any kind or
nature whatsoever has been or will be asserted against the Tustin
Community Redevelopment Agency or its interest and rights in the
parking structure or in the Stevens Square Parking Structure
Condominium Association, which will remain unaffected and no claim
for reimbursement of any part of the cost or expense connected with
or related to the detects or repairs and reconstruction thereof
will be sought from the Tustin Community Redevelopment Agency.
It is recommended that the Agency approve this settlement and
authorize the execution of the Settlement Agreement.
