Green- wood thanked the Council and those with whom he had worked on the T.N.T. Committee, and expressed the hope that as future projects ev61ve in the City, the Council will again seek input from a citizen '. group, and reactivate the Committee with a new Chairman. V. Council Minutes 9/20/71.~,,Page 2 Mayor Coco announced that this hearin~ would allow an opportunity.for protest by anyone objecting to the construction of certain im- provements pursuant to Chapter 27 of the Improvement Act of 1911 in the locations set forth in Resolution No. 71-39A. He opened the public portion of the hearing at 7:45 p.m. In response to the Mayor, the clerk stated that Notices to Construct Missing Improvements, setting forth a time and place for hearing, were duly and regularly posted and delivered, all as prescribed by laW, and that affidavits showing such compliance are on file in the City Clerk's office. The clerk further stated that there had been no written protests received. There being no comments'or objections, the Mayor closed the public portion of the hearing at ' 7:55 p.m. At the Mayor's request, the clerk read Resolution No. 71-60 by title only. Moved by L. Miller, seconded by Oster that further reading be waived and that Resolution No; 71-60, ORDERING THE SUPERINTENDENT OF STREETS TO PRO- CEED WITH THE CONSTRUCTION OF DRAINAGE FACILITIES UNDER THE PROVISIONS OF CHAPTER 27 OF THE "IM- PROVEMENT ACT OP 1911" (CHAPTER 27 PROJECT 71-1), be passed and adopted. Mr. Gill stated that the City's request for County cooperation in the project would be con- sidered by the Board of Supervisors on September 21, 1971. 2. CODE AMENDMENTS a. ORDINANCE NO. 516 An Ordinance of the City of Tustin, California, AMENDING THE TUSTIN CITY CODE RELATIVE TO ELECTRICAL REGULATIONS, AND ADOPTING THE 1968 NATIONAL ELEC- TRICAL CODE. b. ORDINANCE NO. 517 An Ordinance of the City of Tustin, Califorhia, AMENDING THE TUSTIN CITY CODE RELATIVE TO BUILDING REGULATIONS, AND ADOPTING THE 1970 UNIFORM BUILDING CODE, 1970 UNIFORM MECHANICAL CODE AND 1970 UNIFORM PLUMBING CODE. Council Minutes 9/20/71 Page 3 Mr. Gill explained that changes in SeCtions 110.7 and 310.1 of the Electrical Ordinance, relative to aluminum wiring, were being pro- posed by the City Building Official based on a recommendation by the Orange County Chapter of the National Electrical Contractors Association. Mr. Rex Waldo, Building Official, in response to Councilmen's questions, stated that the in- tent had been to prohibit all aluminum con~ ductors based on the number of failures in residential and commercial uses in Tustin, occurring primarily in smaller sizes of alum- inum wire in residential use. Larger sizes of aluminum wire, when terminating in a specific type of connection, would be acceptable under the proposed amendments. Public utilities companies utilize the larger aluminum wire, properly terminated, with a minimum of problems. Mr. Waldo stated that Mr. John Fielder, manager of the Orange County Chapter of the National Electrical Contractors Association, was present to answer any questions the Council may wish to pose. Mayor Coco opened the public portion of the hearing at 8:10 p.m. Mr. John Fielder, manager of the Orange County Chapter of the National Electrical Contractors Association, 501 North Golden Circle Drive, Suite 200, Santa Ana, recommended adoption of the Ordinance as proposed by the Building Department with the amendments, stating that aluminum wiring does lend itself to industrial and commercial applications in larger sizes. Mr. Carl Koenes, president of the Orange County Chapter of the National Electrical Contractors Association, agreed with previous comments, adding that it would be a wise decision to control this type of conductor. There being no further comments or objections, MaTor COco closed the public portion of the hearing at 8:20 p.m. Moved by L. Miller, seconded by C. APPROVAL OF MINUTES September 7, 1971 September 14, 1971 2. APPROVAL OF DEMANDS in the amount of $83,606.29. 3. STREET IMPROVEMENTS RED HILL, CENTENNIAL[ AND PROSPECT. MASTER RECREATION AGREEMENT - TUSTIN ELEMENTARY SCHOOL DISTRICT. Approval of renewal of agreement with Tustin Elementary School District as recommended by the Parks and Recreation Director. Moved by L. Miller, seconded by Oster that Items 1 through 4 of the Consent Calendar be approved. Carried unanimously. VII. ORDINANCES FOR ADOPTION 1. ORDINANCE NO. 522 An Ordinance of the City of Tustin, Calif- ornia, AMENDING ORDINANCE NO. 435 RELATIVE TO WALLS REQUIRED. An amendment in-conjunction with PZ-69-117 which rezoned subject property to the Planned Community DiStrict subject to condition that a block wall 6'8" in height be constructed along the northerly property line. Site fronts approximately..465 feet on the west sfde of Yorba Street. Moved by L. Miller, seconded by Oster that Ordinance No. 522rhave second reading by title only. Carried unanimously. ORDINANCES FOR INTRODUCTION 1. ORDINANCE NO. 523 'An Ordinance of the City of Tustin, Calif- ornia, REZONING PROPERTY ON APPLICATION NO. ZC 71-225 OF SIEGEL. Rezoning approximately 2.8 acres from the R-3 (1600) (Multi-family) District to the P-C (C) (Planned Cummunity-Commerclal) Dis- trict for Portion A of subject parcel and to the C-1 (Retail Commercial) District for Portion B. Site fronts approximately 257 feet on the north side of First Street, approximately 160 feet westerly of the centerline of Fashion Lane, 2. ORDINANCE NO. 518 An Ordinance of the City of Tustin, Calif- ornia, PROVIDING REGULATIONS FOR THE CON- STRUCTION, FENCING AND MAINTENANCE OF POOLS, AND PROVIDING FOR THE BONDING OF CONTRACTORS THEREFOR. Moved by C. Miller, seconded by L. Miller that Ordinance No. 523 have first reading by title ' only. Carried, Councilmen L. Miller and Oster abstaining. Title of Ordinance No. 523 read by the clerk. In response to questions by Councilman Marsters, Mr. Waldo stated that the five-foot fence height requirement is the same as that of most other jurisdictions in Orange County. This height is considered effective for purposes of child safety, with a greater problem caused by poorly-maintained gates. While these conditions are not checked routinely because of manpower problems, spot checks are made when an opportunity arises; the Fire Department tries to inspect apartment houses bi- monthly, or at least quarterly. Re-inspections 'of pool electrical work are made when the inspec- tor has occasion to be on the premises. Regard- ing cleaning and curb breakage, etc., the City Engineer felt that the provisions of this Ordinance would be adequate. Above motion to read Ordinance No. 518 by title carried unanimously. RESOLUTION NO. 71-58 A Resolution of the City Council of the .City of Tustin, California, FINDING AND 'DETERMINING NO PROTESTS TO U.S.M.C. - IRVINE ANNEXATION NO. 71-A TO THE CITY OF TUSTIN. 2. RESOLUTION NO. 71-59 A Resolution DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DE- SCRIBED HEREIN, AND DESIGNATED AS "NISSON - RED HILL - MITCHELL ANNEXATION NO. 72" TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. For purposes of clarification of the above motion, Mayor Coco asked the COuncil whether it was their intention that an ordinance be prepared annexing property in the U.S.M.C. Irvine Annexation No. 71-A tO the City of Tustin, as recommended by the Staf'f. The Council concurred in this. Moved D~ Oster, Seconded by L. OTHER BUSINESS 1. PARKS AND RECREATION COMMISSION VACANCY It was the consensus of the Council that this matter be continued to the meeting of October 4, 1971, as requested by Jack Harrison. 2. MAINTENANCE DEPARTMENT VACANCIES In response to a question by Mayor Coco, Mr. Gill stated that artificial turf in center islands would probably not be an answer to maintenance manpower problems, because of the need to "de- grease" the turf and vacuum it in some areas. He stated further that the two positions vacant in the Maintenance Department are included in the twenty positions budgeted. Moved by Oster, seconded by Marsters that the two vacancies in the Maintenance Department be filled. Carried unanimously. 3. JACK-IN-THE-BOX Letter expressing Council appreciation of efforts resulting in discontinuing revolving of the Jack Head at the Jack-In-The-Box Restaurant at New- port and Laguna to be directed to Foodmaker, Inc., owner of the facility. The Mayor said that he will sign and hand-deliver the letter to Robert Harvey, Mayor of Cypress, who is a real estate representative w~th Foodmaker, Inc. 4~ HOUSE ON ANDREWS PROPERTY Council discussed Jay Andrews' offe~ to donate the house located on the northwest corner of Irvine Boulevard and Prospect Avenue. Noaction was taken. The Mayor suggested that civic organ- izations might b~ interested in the house for its historical value. Council Minutes 9/20/71 Page 7 5. FIRST AND "C" STREET PARK DEVELOPMENT Mr. Bill Sommerville, 12152 Country Lane, Santa Ana, president of the Tustin National Little League, introduced his Board of Directors, and went on to state that he had been working with Jack Harrison and Archie Currie and had resolved the problem of the use of the Little League field at the Southerly end of the park site. Mayor Coco stated that the Council had been briefed on this, The Council'concurred in park development plans which would include: 1. Removal of two large pepper trees at "B" and First Streets. 2. Proposed alignment of "B" Street according to Plan B. 3. Removal of several large palm trees in park site at "C" and Second Streets for development of a picnic area. 4. Delay in development of the southwest corner of the park for approximately four months-in order to. provide a third temporary Little League diamond. XIII.
