CALL TO ORDER ROLL CALL PUBLIC INPUT - Members of the public may address the City Council on items on the Closed Session Agenda. CLOSED SESSION - The City Council shall convene in closed session to confer with the City Attorney regarding: 1) Claim of Janice Ohman, Claim No. 03-14; and 2) Significant exposure to litigation pursuant to Government Code Section 54956.9(b)(2)(A) one (1) case. REGULAR MEETING- 7:00 P.M. PUBLIC HEARING (ITEMS 1 THROUGH 2 ) , JOINT CITY COUNCIL/REDEVELOPMENT AGENCY PUBLIC HEARING AND ADOPTION OF THE MCAS TUSTIN REDEVELOPMENT PLAN Mayor Worley will call to order the joint session of the Tustin Redevelopment Agency and the City Council of the City of Tustin. The City Clerk will recall the roll of the City Council and call the roll of the Tustin Redevelopment Agency. The City Council and Redevelopment Agency are being requested to conduct a joint public hearing on the MCAS Tustin Redevelopment Plan and to make the findings necessary to approve and adopt said Redevelopment Plan. The City Council is being asked to approve the introduction of the Ordinance approving and adopting the Redevelopment Plan. Staff recommends that the Agency and City Council take the following actions: 1. Open and conduct the Joint Public Hearing on the proposed MCAS Tustin Redevelopment Plan; 2. Close the Joint Public Hearing and direct staff to prepare written responses to any written objections to the Redevelopment Plan. Staff recommends that the Redevelopment Agency take the following actions: 1. Adopt Resolution No. RDA 03-10: A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, FINDING AND DETERMINING THAT THE USE OF MONIES FROM THE LOW AND MODERATE INCOME HOUSING FUND OUTSIDE THE BOUNDARIES OF THE MCAS TUSTIN REDEVELOPMENT PROJECT AREA WILL BENEFIT THE PROJECT AREA AND AUTHORIZING THE EXPENDITURE OF SUCH FUNDS. 2. By Minute Action, receive and approve the Supplement to the Report to City Council for the MCAS-Tustin Redevelopment Plan. Staff recommends that the City Council take the following actions: 1. Adopt Resolution No. 03-78: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING AND DETERMINING THAT THE USE OF MONIES FROM THE LOW AND MODERATE INCOME HOUSING FUND OUTSIDE THE BOUNDARIES OF THE MCAS TUSTIN REDEVELOPMENT PROJECT AREA WILL BENEFIT THE PROJECT AREA AND AUTHORIZING THE EXPENDITURE OF SUCH FUNDS. Adopt Resolution No. 03-79: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MAKING FINDINGS UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WITH RESPECT TO THE ADOPTION OF THE REDEVELOPMENT PLAN FOR THE MCAS TUSTIN REDEVELOPMENT PROJECT. 3. Adopt Resolution No. 03-81: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING FINDINGS IN RESPONSE TO WRITTEN OBJECTIONS RECEIVED FROM AFFECTED TAXING ENTITIES OR PROPERTY OWNERS ON ADOPTION OF THE REDEVELOPMENT PLAN FOR THE MCAS-TUSTIN REDEVELOPMENT PROJECT. 4. Introduce and have first reading by title only of the following Ordinance No. 1276: ORDINANCE NO. 1276- AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AND ADOPTING THE REDEVELOPMENT PLAN FOR THE MCAS- TUSTIN REDEVELOPMENT PROJECT. Mayor Worley will close the joint public hearing of the City Council and the Redevelopment Agency and reconvene the City Council meeting. 2. ANNEXATION 158 This item is the annexation of LorettalBonnedMedfordlGrovesite county island properties from the Orange County unincorporated territory into the City of Tustin. Council approved prezoning of these properties on January 6, 2003. Recommendation from the Community Development Department: 1. Open and Close a Public Hearing; and 2. Adopt the following Resolution Nos. 03-75 and 03-76: RESOLUTION NO. 03-75- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR ANNEXATION NO. 158 AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. RESOLUTION NO. 03-76- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MAKING APPLICATION TO AND REQUESTING THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY TO TAKE PROCEEDINGS PURSUANT TO THE CORTESE-KNOX-HERTZBERG LOCAL GOVERNMENT ORGANIZATION ACT OF 2000 FOR THE CITY OF TUSTIN TO ANNEX APPROXIMATELY 11.41 ACRES OF PROPERTY WITHIN ITS SPHERE OF INFLUENCE AND FILE ANNEXATION NO. 158. CONSENT CALENDAR (ITEMS 3 THROUGH 11 ) All matters listed under Consent Calendar are considered routine and will be enacted by one Agenda - City Council June 2, 2003 - Page 3 motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. , APPROVAL OF MINUTES - MAY 19, 2003 REGULAR MEETING Recommendation: Approve the City Council Minutes of May 19, 2003. . APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $963,963.59 and ratify Payroll in the amount of $451,019.81. . AWARD OF CONTRACT FOR CUSTODIAL SERVICES FROM JULY 1, 2003 THROUGH JUNE 30, 2004 WITH THE OPTION OF THREE, ONE-YEAR EXTENSIONS Recommendation: Award the Custodial Services Contract, for Fiscal Year 2003/2004 to Pacific Building Care, Inc., in the amount of $203,364.12, and authorize the Mayor and City Clerk to execute the contract documents on behalf of the City. o APPROVAL OF AMENDMENT NO. 6 TO COOPERATIVE AGREEMENT NO. C-95-993 WITH ORANGE COUNTY TRANSPORTATION AUTHORITY FOR PROJECTS FUNDED BY MEASURE M Recommendation: Approve Amendment No. 6 to Cooperative Agreement No. C-95-993 with the Orange County Transportation Authority, and authorize the Mayor and City Clerk to execute the Agreement on behalf of the City. . SET PUBLIC HEARING FOR JUNE 16, 2003 AT 7:00 P.M. TO CONSIDER PLACING SOLID WASTE RATES ON THE COUNTY TAX ROLL Recommendation: Set a public hearing for June 16, 2003 at 7:00 p.m. to consider placing residential solid waste fees on the tax roll. . GASB 34 COMPLIANCE VALUATION SERVICES FINAL REPORT Recommendation: 1. Adopt the report entitled "Final Report, GASB 34 Compliance Valuation Services;" 2. Adopt the recommended capitalization policy for capital and infrastructure assets at $100,000; 3. Adopt the capitalization policy for the City's fixed assets at $5,000 as recommended by the City's Audit Committee; and 4. Adopt the useful life of infrastructure assets as recommended by the Consultants and detailed on Page 8 of the report. . RESOLUTION NO. 03-77 APPROVING REVISED GOVERNING DOCUMENTS FOR THE CALIFORNIA INSURANCE POOL AUTHORITY Recommendation: Adopt Resolution No. 03-77 approving the changes to the California Insurance Pool Authority Joint Powers Authority Agreement, the JPA By-Laws, the General Liability Insurance Plan Document, and the CIPA Workers' Compensation Pool Program. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING REVISED GOVERNING DOCUMENTS FOR THE CALIFORNIA INSURANCE POOL AUTHORITY. Agenda - City Council June 2, 2003 - Page 4 10. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORTS Recommendation: Receive and file the reports. 11. EXCLUSIVE AGREEMENT TO NEGOTIATE WITH VESTAR DEVELOPMENT II, LLC FOR THE TUSTIN LEGACY RETAIL SITE (PARCELS 10 AND 11) Recommendation: Authorize the City Manager's execution of the Exclusive Agreement to Negotiate (ENA) between the City of Tustin and the Developer, Vestar Development II, LLC, subject to approval of the City's special real estate counsel Gilchrist & Rutter. REGULAR BUSINESS (ITEMS 12 THROUGH 14 ) 12. ORDINANCE NO. 1271 - APPROVING CODE AMENDMENT 03-003 RELATING TO SECOND RESIDENTIAL UNITS The amendment provides standards to second residential units in several residential zoning districts and allows second residential units without discretionary review or hearing, in accordance with State law. Recommendation by the Office of the City Clerk: Have second reading by title only and adoption of the following Ordinance No. 1271 (roll call vote): ORDINANCE NO. 1271 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING TUSTIN CITY CODE SECTIONS 9222.a.5 AND 9223.a.7; AMENDING SECTIONS 9224.b, 9225.a.2, 9226.a.1, and 9297; AND REPEALING TUSTIN CITY CODE SECTIONS 9222.b.3, 9222.b.4, 9223.b.1, 9226.b.6, AND 9226.b.7 RELATING TO SECOND RESIDENTIAL UNITS. 13. FISCAL YEAR 2003-04 BUDGET WORKSHOP Staff is requesting the City Council schedule its first workshop to review the budget for Fiscal Year 2003-04. The draft budget will be submitted to the City Council prior to the budget workshop. Recommendation by the Office of the City Clerk: Pleasure of the City Council. 14. FINAL PARCEL MAP 2002-106 Final Parcel Map 2002-106 is a request to subdivide a 1.62-acre site at 535 E. Main Street into two (2) parcels for the purpose of conveyance. (Owners/Applicants: Tustin Auto Wash/Tom Baumgartner). Recommendation by the Community Development Department: Adopt Resolution No. 03-73: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL PARCEL MAP 2002-106 TO SUBDIVIDE A 1.62 ACRE PARCEL CURRENTLY DEVELOPED WITH A CAR WASH, CONVENIENCE STORE, AND FUELING STATION CANOPY AND A RETAIL BUILDING INTO TWO (2) PARCELS FOR CONVEYANCE PURPOSES.
