PARKER, CITY MANAGER "" FROM: DOUGLAS STACK, DIRECTOR OF PUBLI WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 16-22 TO APPROVE THE SUBMITTAL OF THE MAIN STREET IMPROVEMENT PROJECT APPLICATION TO THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR FUNDING UNDER THE BICYCLE CORRIDOR IMPROVEMENT PROGRAM 2016 CALL FOR PROJECTS SUMMARY: City Council adoption of Resolution No. 16-22 will approve the submittal of an application for the Main Street Improvement Project to the Orange County Transportation Authority (OCTA) under the Bicycle Corridor Improvement Program (BCIP) 2016 Call for Projects. The application will be for funding of the construction phase of the Main Street Improvement Project. RECOMMENDATION: It is recommended that the City Council adopt Resolution No. 16-22 approving the submittal of the application to the Orange County Transportation Authority for the funding of the construction phase of the Main Street Improvement Project under the Bicycle Corridor Improvement Program 2016 Call for Projects. FISCAL IMPACT: The City is required to provide minimum match funding of twelve percent (12%) for the project. The maximum $3,000,000 will be requested for the project. If the project is selected, Tustin's estimated matching cost plus administration will total approximately $360,000. Funding for Tustin's match will be requested through the Measure M2 Local Fair Share Program in the City's Fiscal Year 2016-2017 and 2017-2018 Capital Improvement Budget. Public Works April 19, 2016 Page 2 CORRELATION TO STRATEGIC PLAN: The project contributes to the fulfillment of the City's Strategic Plan Goal B: Public Safety and Protection of Assets. Specifically, the project implements or fosters the implementation of strategy #3, which among other items, is to ensure continuous maintenance and improvement of transportation facilities. BACKGROUND AND DISCUSSION: The BCIP is funded using the federal Congestion Mitigation and Air Quality Improvement Program (CMAQ) authorized under Moving Ahead for Progress in the 21st Century (MAP -21) and the Fixing America's Surface Transportation (FAST). The CMAQ program provides funding through annual appropriations to Orange County to be used for transportation -related projects that reduce congestion and improve air quality. The OCTA is responsible for selecting regionally significant projects for Orange County and working with the California Department of Transportation (Caltrans) in administering selected projects that are required to be CEQA/NEPA compliant due to the federal funds involved. The Main Street Improvement Project meets the program objectives by creating a more pedestrian and bicycle -friendly environment with traffic calming features. To maintain eligibility for BCIP funding the City Council must approve the application for this program. The application for the Main Street Improvement Project will be submitted to the OCTA on or prior to the deadline of May 9, 2016. Adoption of the City's resolution serves to complete the initial administrative process for receipt of the application. Therefore, staff is requesting City Council adoption of Resolution No. 16-22 approving the submittal of the application to the Orange County Transportation Authority for the funding of the construction phase of the Main Street Improvement Project under the Bicycle Corridor Improvement Program 2016 Call for Projects. Resolution 16-22 (BCIP Grant App 2016) RESOLUTION NO. 16-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING APPLICATION FOR FUNDS FOR THE BICYCLE CORRIDOR IMPROVEMENT PROGRAM FUNDED WITH CONGESTION MITIGATON AND AIR QUALITY IMPROVEMENT PROGRAM FUNDING UNDER THE MOVING AHEAD FOR PROGRESS IN THE 21ST CENTURY AND FIXING AMERICA'S SURFACE TRANSPORTATION FEDERAL TRANSPORTATION ACT FOR THE MAIN STREET IMPROVEMENT PROJECT WHEREAS, the United States Congress enacted the Moving Ahead for Progress in the 21st Century (MAP -21) Federal Transportation Act on July 6, 2012, and Fixing America's Surface Transportation (FAST) Federal Transportation Act on December 4, 2015, which makes Congestion Mitigation and Air Quality Improvement Program (CMAQ) funds available to the Orange County Transportation Authority (OCTA); and WHEREAS, OCTA has established the procedures and criteria for reviewing proposals; and WHEREAS, the City of Tustin possesses authority to nominate bicycle projects funded using Congestion Mitigation and Air Quality Improvement Program funding and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action the City of Tustin City Council authorizes the nomination of the Main Street Improvement Project, including all understanding and assurances contained therein, and authorizes the person identified as the official representative of the City of Tustin to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Tustin will maintain and operate the property acquired, developed, rehabilitated, or restored for the life of the resultant facility; and WHEREAS, with the approval of the California Department of Transportation (Caltrans) and/or OCTA, the City of Tustin or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Tustin will give Caltrans and/or OCTA's representatives access to and the right to examine all records, books, papers or documents related to the bicycle project; and WHEREAS, the City of Tustin will cause project work to commence within six months following notification from the State or OCTA that funds have been authorized to proceed by the Federal Highway Administration or Federal Transit Administration and that the project will be carried to completion with reasonable diligence; and WHEREAS, the City of Tustin commits $360,000 of general funds and will provide 12 percent of the total project cost as match to the requested $3,000,000 in OCTA CMAQ funds for a total project cost estimated to be $4,000,000. WHEREAS, the City of Tustin will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the American with Disabilities Act, Federal Title VI, Buy America provision, and any other federal, state, and/or local laws, rules and/or regulations; and WHEREAS, the City of Tustin's City Council authorizes the execution of any necessary cooperative agreements between the City of Tustin and OCTA to facilitate the delivery of the project; and WHEREAS, City of Tustin will amend the agency Capital Improvement Program (CIP) to include the project if selected for funding; and NOW, THEREFORE, BE IT RESOLVED that the City of Tustin hereby authorizes Douglas S. Stack, Director of Public Works/City Engineer, as the official representative of the City of Tustin to apply for the Congestion Mitigation and Air Quality funding under the Moving Ahead for Progress in the 21st Century Federal Transportation Act and Fixing Americas Surface Transportation Act for the Main Street Improvement Project. BE IT FURTHER RESOLVED, that the City of Tustin agrees to fund its share of the project costs and any additional costs over the identified programmed amount.
