CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. PRESENTATIONS — o Tustin Legacy and Tustin Police Website Updates CONSENT CALENDAR ITEMS All matters listed under the Consent Calendar are considered to be routine and will be enacted by one motion without discussion. Persons wishing to speak regarding Consent Calendar matters should file a "Request to Speak" form with the City Clerk. (Agenda Items 1 through 9) 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Recommendation: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON APRIL 19, 2016 Recommendation: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on April 19, 2016. 3. RATIFICATION OF DEMANDS - PAYROLL The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Recommendation: Confirm and approve as submitted the following listing of demands issued on behalf of the City in accordance with Government Code Section 37208. 4. RATIFICATION OF DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. ACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE FRONTIER PARK PLAYGROUND RENOVATION (CIP NO. 20072) The Frontier Park Playground Renovation has been completed and the project is ready for acceptance and filing of the Notice of Completion. Recommendation: That the City Council: 1. Adopt Resolution No. 16-28 accepting the Frontier Park Playground Renovation (CIP No. 20072), and 2. Authorize the City Clerk to file the Notice of Completion with the County Recorder's office. RESOLUTION NO. 16-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE FRONTIER PARK PLAYGROUND RENOVATION (CIP NO. 20072) 6. APPROVAL OF THE CITY OF TUSTIN'S AGENCY SERVICE PLAN FOR THE OCTA SENIOR MOBILITY PROGRAM The Parks and Recreation Services Department is seeking approval of the attached Agency Service Plan as a requirement for continued participation in the Orange County Transportation Authority's (OCTA) Senior Mobility Program (SMP). Recommendation: That the City Council: 1. Adopt Resolution 16-26 which formally approves the City of Tustin's City Council May 3, 2016 Meeting Agenda Page 4 of 6 7. Senior Mobility Program Agency Service Plan. 2. Adopt Resolution 16-27 which authorizes the Director of Parks and Recreation Services to execute all documents related to the City of Tustin's Senior Mobility Program Agency Service Plan. RESOLUTION NO. 16-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE CITY OF TUSTIN'S SENIOR MOBILITY PROGRAM AGENCY SERVICE PLAN FOR CONTINUED PARTICIPATION IN THE ORANGE COUNTY TRANSPORTATION AUTHORITY (OCTA) SENIOR MOBILITY PROGRAM (SMP) RESOLUTION NO. 16-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING EXECUTION OF DOCUMENTS REQUIRED BY ORANGE COUNTY TRANSPORTATION AUTHORITY (OCTA) IN ORDER TO RECEIVE SENIOR MOBILITY FUNDING (SMP) WATER CONSERVATION UPDATE — MARCH 2016 As a result of the drought, the City of Tustin is required to provide the State Water Resources Control Board with data that will be used to determine if the City is meeting the required 28% conservation target and the various methods being utilized to ensure compliance with the State's mandates. This report summarizes the information provided to the State for the month of March 2016 and provides the City Council and the public with general information on previous and upcoming actions taken by the City. Recommendation: That the City Council receive and file this report. 8. APPROVE THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND SET A PUBLIC HEARING TO CONSIDER LEVYING FISCAL YEAR 2016-2017 ASSESSMENTS Recommendation: That the City Council: Adopt Resolution No. 16-29 approving the Engineer's Report for the Tustin Landscape and Lighting District for Fiscal Year 2016-2017; and 2. Adopt Resolution No. 16-30 declaring its intention to levy annual assessments for Fiscal Year 2016-2017 and setting a public hearing for June 7, 2016. RESOLUTION NO. 16-29 City Council May 3, 2016 Meeting Agenda Page 5 of 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT LEVY OF ANNUAL ASSESSMENTS FOR FISCAL YEAR 2016-2017 RESOLUTION NO. 16-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA DECLARING ITS INTENTION TO PROVIDE FOR AN ANNUAL LEVY OF ASSESSMENT FOR FISCAL YEAR 2016-2017 FOR THE IMPROVEMENT, MAINTENANCE AND SERVICING OF PUBLIC LANDSCAPING AND LIGHTING FACILITIES IN THE TUSTIN RANCH AREA WITHIN THE BOUNDARIES OF THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND TO LEVY AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND PROPOSITION 218 AND GIVING NOTICE THEREOF 9. DECLARATION OF SURPLUS PROPERTY The City has accumulated a quantity of obsolete and/or damaged computer and other equipment that are no longer usable or required for public use. Recommendation: That the City Council: 1. Declare the listed equipment surplus and not required for public use. 2. Authorized staff to sell/have auctioned serviceable equipment of value and dispose of assets beyond repair. OTHER BUSINESS/COMMITTEE REPORTS ADJOURNMENT — The next meeting is scheduled for Tuesday, May 17, 2016 for the Closed Session Meeting at 5:30 p.m. and the Regular Business Meeting at 7:00 p.m. in the Council Chamber, 300 Centennial Way, Tustin, California.
