CITY COUNCIL REGULAR MEET1&...'
CITY OF TiUSTIN
NOVEMBER 18, 1991 - 7:00 P.M.
The City Council meets the first and third Monday of each month at 7:00 p.m.
in the City Council Chambers at 300 Centennial Way.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk for clarification. Except as otherwise provided by law, no
action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for public
use in the City Council agenda books located in the Police Department and
the Tustin Public Library. These same books are also provided for public
use in the Council Chambers during the Council meeting. Listening devices
for the hearing impaired are available upon request from the City Clerk.
Smoking is prohibited in the Council Chambers; however, if you desire to
smoke, an outside speaker has been provided.

1. RECOVERY OF CITY COSTS FOR THE ABATEMENT OF A PUBLIC NUISANCE AT
200 EL CAMINO REAL
Upon failure of the owner to remove violation, a work order was
issued on October 21, 1991, to clear subject property of weeds and
debris.
Recommendation: Adopt the following Resolution No. 91-147
confirming the schedule of costs associated with the abatement of
weeds and overgrown vegetation and directing that the same
constitute an assessment against subject property as recommended
by the Community Development Department. -

2. APPEAL OF CONDITIONAL USE PERMIT 91-20 (13112 NEWPORT AVENUE #D)
The applicant is proposing to establish the on-site sale of beer
and wine (ABC License Type 114111) for consumption on the subject
premises in conjunction with a 1,015 -square foot restaurant
located at 13112 Newport Avenue #D.

3. PRICING INFORMATION ON TEMPORARY BANNER (13102 NEWPORT AVENUE
#106)
On October 28, 1991, the Planning Commission denied the
applicant's request to place pricing information on a temporary
banner to be displayed at 13101 Newport Avenue #106. The
applicant has requested an appeal of the Planning Commission's
decision by the City Council.
Recommendation: Uphold the Planning Commission's denial of a
request to place pricing information on a temporary banner to be
located at 13102 Newport Avenue as recommended by the Community
Development Department.

Council regarding any items not on the agenda and within the subject
matter jurisdiction of the City Council (NO action can be taken on
off -agenda items unless authorized by law).

VI. CONSENT CALENDAR - All matters listed under Consent Calendar are
considered routine and will be enacted by one motion. There will be
no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request
specific items be discussed and/or removed from the Consent Calendar
for separate action.
1. APPROVAL OF MINUTES - NOVEMBER 4, 1991 REGULAR MEETING
Recommendation: Approve the, City Council Minutes of November 4,
1991.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $837,521.57
and ratify Payroll in the amount of $291,400.53.
3. PROJECT MANAGEMENT SERVICES FOR LAUREL GLEN PARR CONSTRUCTION
Recommendation: Authorize a contract for project management
services for Laurel Glen Park with Century Management, Inc. at
a rate of $62.50/hr., not to exceed $12,500 as recommended by
the Community Services Department.

4. VESTING T7 1TIVE TRACT MAP NO. 14499
RESOLUTION NO. 91-149 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL
IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR
85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA)
IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE
TRACT MAP NO. 14499 AND ALL FE4SIBLE MITIGATION MEASURES HAVE BEEN
INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT
Recommendation: Approve the Environmental Determination for the
project by adopting Resolution No. 91-149; and
RESOLUTION NO. 91-148 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE TRACT MAP
NO. 14499 TO CREATE TEN (10) NUMBERED AND SIX (6) LETTERED LOTS
FOR AN ATTACHED CONDOMINIUM DWELLING PROJECT LOCATED ON LOTS 4, R
AND S OF TRACT 13627
Recommendation: Approve Vesting Tentative Tract Map No. 14499
by adopting Resolution No. 91-148, subject to conditions
contained in Exhibit A of Planning Commission Resolution No.
2965 as recommended by the 'Community Development Department.
S. AWARD OF CONTRACT FOR LANDSCAPE IMPROVEMENTS, LAURELWOOD TOWNHOUSE
FREEWAY EDGE
Recommendation: Award the contract for subject project to John
C. Ettlin, Inc., of San Juan Capistrano, California, in the
amount of $63,773.00 as recommended by the Public Works
Department/Engineering Division.
6. AWARD OF CONTRACT FOR WATER MAIN RELOCATION ON EL CAMINO WAY
Recommendation: Award the contract for subject project tq John
T. Malloy and John T. Malloy, Inc., of Los Angeles, California,
a joint venture, in the amount of $82,918.40 as recommended by
the Public Works Department/Engineering Division.
7. AWARD OF CONTRACT FOR TRAFFIC SIGNAL INSTALLATION AND MEDIAN
MODIFICATION AT TUSTIN RANCH ROAD AND AUTO CENTER DRIVE
Recommendation: Award the contract for subject project to F. J.
Johnson, Inc., of Anaheim, California, in the amount of
$88,887.00 as recommended by the Public Works Department/
Engineering Division.
8.. ASSET FORFEITURE APPROPRIATIOIN
Recommendation: Appropriate $448.88 from the existing Narcotics
Asset Forfeiture Trust Fund to purchase a forfeited vehicle for
undercover use in the Narcotics Section as recommended by the
Police Department.

2. ORDINANCE NO. 1079 - GRAFFITI/SPRAY PAINT PROGRAM
The following Ordinance No. 1079 had first reading by title only
and introduction at the November 4, 1991 City Council meeting:

Recommendation: Have second reading by title only.and adoption of
Ordinance No. 1079 (roll call vote).
IX. OLD BUSINESS
1. MARINE CORPS AIR STATION CLOSURE
The City is currently at the initial stages of the organization
and planning processes for the closure of the Marine Corps Air
Station. This report outlines a number of actions within each
process that will be necessaty in proceeding over the next few
months.
Recommendation: (1) Authorize the Mayor to appoint two of the
City Council members to the; Base Closure Task Force and (2)
Confirm the remaining list of proposed Base Closure Task Force
members as recommended by the:Community Development Department.
X. NEW BUSINESS
1. TRAFFIC EVALUATION STUDY - IMPACT OF CONVERTING THREE EXISTING
NEIGHBORHOODS IN EAST TUSTIN TO GATED COMMUNITIES (ALMERIA,
MONTEREY, MARICOPA)
The City Council, at their meeting of October 21, 1991, continued
this item in order to provide time for the homeowners association
presidents to discuss the matter and for staff to obtain further
information.
Recommendation: (1) Deny thle request to gate Parkcenter Lane,
which serves as a public collector street and (2) Provide�-the
Almeria, Monterey, and Maricopa neighborhoods with a public forum
explaining the traffic and fitancial implications of the proposed
conversion of their neighborhoods to gated communities if
sufficient interest is formally expressed by the homeowners
associations of the effected neighborhoods as recommended by the
-Public Works Department/Engineering Division.
2. EAST TUSTIN HOTEL
The East Tustin Development Agreement required The Irvine Company
to construct a minimum 250 room hotel on the mixed use site within
the East Tustin Specific Plan.

3. LEGAL SERVICES

%I. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - NOVEMBER 12, 1991
All actions of the Planning Commission become final unless
appealed by the City Council ;or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of
November 12, 1991.
2. CONTINENTAL CABLEVISION RATE 'INCREASE
The City has received notification regarding proposed changes in
Continental Cablevision's monthly rate structure.
Recommendation: Receive and mile subject report as recommended by
the Public Works Department/engineering Division.
3. REQUEST FOR STOP SIGN ON YORBA STREET AT AMAGANSET WAY
The Public Works Department received a letter from Mr. Bruce A.
Traywick requesting the installation of a stop sign on Yorba
Street at Amaganset Way.
Recommendation: Direct staff to prepare a warrant study for the
intersection of Yorba Street and Amaganset Way as recommended by
the Public Works Department/Engineering Division.
4. INVESTMENT SCHEDULE AS OF SEPTEMBER 30, 1991
Investment schedule with maturities, 12 months or less.
Recommendation: Receive -and file subject report as recommended by
the Finance Department.
5. WATER CONSERVATION UPDATE
Status report on the City's Mandatory Water Conservation Program.
Recommendation: Receive and file subject report as recommended by
the Finance Department.

XIV. ADJOURNMENT
The City Council has scheduled a General Plan Workshop with the
Planning Commission on November :L9, 1991, 6:30 p.m., in the Council
Chambers. The next regular meeting of the City Council is scheduled
for Monday, December 2, 1991, at 7:00 p.m.
