The Pledge of Allegiance was led by Mayor Pro Tem Pontious. INVOCATION The Invocation was given by Rev. Dr. James Witty, Tustin Presbyterian Church. ROLL CALL Council Present: Charles E. ETHEL REYNOLDS, PARENTS WHO CARE Mayor Puckett read and presented a proclamation to Ethel Reynolds recognizing her involvement with Parents Who Care. Ethel Reynolds accepted the proclamation and thanked the Council for the honor. She also thanked members of the Parents Who Care organization for their dedication and commitment, and encouraged community participation. 2. TILLER DAYS/PARADE COMMITTEE Mayor Puckett read and presented proclamations to the Tustin Tiller Days/Parade Committee! members for a successful 1991 Tiller Days fair and parade. PUBLIC HEARINGS 1. 1992-93 PROPOSED USE OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (18TH YEAR APPLICATION) Dana Ogdon, Senior Planner, �eported that the County of Orange solicited funding applications for the City's future participation in the Community Development Block Grant program for fiscal year 1992/93 4 hoVever, prior to submittal of the application, the City must, obtain citizen input through a Citizen Participation Commiti-ee, conduct a formal hearing, and receive endorsement by the Council. The Citizen Participation Committee prioritized public works projects above residential rehabilitation projects and 'included several suggestions for additional projects. Staff disagreed with the committee's prioritization and favored emphasizing housing rehabilitation and graffiti removal in the southwest portion through the Community Improvement Partnership Program. Council/staff discussion followed regarding project funding apportionment; and acquiring entitlement status. Mayor Puckett opened the public hearing at 7:20 p.m. There were no speakers on the subject and the public hearing was closed. It was moved by Edgar, seconded by Pontious, to adopt the following Resolution No. 191-143 approving the 1992-93 application for the proposed use of Community Development Block Grant (CDBG) funds: RESOLUTION NO. 91-143 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE CITY'S 1992-93 APPLICATION FOR HOUSING AND'COMMUNITY DEVELOPMENT FUNDS AND AUTHORIZING SUBMISSION OF SUCH APPLICATION TO THE COUNTY OF ORANGE CITY COUNCIL MINUTES Page 3, 11-4-91 3. 2. ORDINANCE TO ESTABLISH (AGENDA ORDER) MINIMUM PROPERTY MAINTENANCE STANDARDS Dana Ogdon, Senior Planners reported that due to a decline in property maintenance in he community, particularly in the southwest neighborhood, stff developed a revised Property P P Y Maintenance Nuisance ordinance. The proposed ordinance defined property conditions I considered maintenance nuisances; penalties for continuing violations; provided additional administrative remedies, thereby facilitating conflict resolution at the staff level; provided proceedings for the abatement of eminent dangerous buildings; recovery of City expenses incurred in obta*ping compliance associated with continual code enforcement 'problems; and clarified previous ordinance amendments. Council/staff discussion followed regarding the appeal filing fee. Mayor Puckett opened the public hearing at 7:25 p.m. There were no speakers on the subject and the public hearing was closed. ORDINANCE TO ESTABLISH THE GRAFFITI/SPRAY PAINT PROGRAM (AGENDA ORDER) Dana Ogdon, Senior Planner,' reported the proposed ordinance provided a comprehensive approach to the control of graffiti occurring within the commun'tspray P Y y including prohibition of the sale of spray paint to mino�s; possession of s paint in public by minors; defacing oIf any public or private property; required retailers to post 'signs indicating prohibition of sales to minors; and established administrative procedures, awards, and penalties. Councilmember Potts requested imposing the maximum penalty fines allowable by the bail schedule. Council concurred. CITY WATER SYSTEM BYDRAULI0 NETWORK ANALYSIS MODEL Recommendation: Authorize staff to solicit proposals for the preparation of a computer hydraulic network analysis model of the City's wator system as recommended by the Public Works Department/W�ter Division. 10. VESTING TENTATIVE TRACT MAP14366 RESOLUTION NO. 91-144 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-21 AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA)IS,ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE BRACT MAP 14366 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUJiLITY ACT Recommendation: Approve the Environmental Determination for the project by adopting ROsolution No. 91-144; and RESOLUTION NO. 91-145 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE TRACT MAP 14366 TO CREATE 91! DECLARATION OF SURPLUS VEHICLES AND WORK EQUIPMENT Recommendation: Declare specified equipment surplus, not required for public use, and authorize the Public Works Department to dispose of equipment in accordance with Ordinance No. 871 as recommended by the Public Works Department/Field Services'Division. CONSENT CALENDAR ITEM NO. 4 - REJECTION OF CLAIM NO. 91-36 - CLAIMANT, RICHARD A. VASILIA; DANE OF LOSS, 7/16/91; DATE FILED WITH CITY, 8/6/91 Councilmember Potts questioned whether the City had to continue reviewing nuisance lawsuits, or if the Bar Association had future plans to discourage attorneys from representing these kinds of claims. James Rourke, City Attorney, responded that there were no restrictions to prevent these types of claims being filed against the City. CONSENT CALENDAR ITEM NO. 6 - AVARD OF BID FOR LAUREL GLEN PARR - TRACT 12763 Councilmember Edgar reported that the low bid amount was approximately $140,000 less than the Engineer's estimate and noted that the excess budgeted amount could be applied toward future park projects. Councilmember Potts requested the $140,000 be applied to the Sports Complex. William Huston, City Manager, replied that the monies saved on this project were in the Park Development Fund and earmarked for Tustin Ranch parks. Council/staff discussion followed regarding appropriating the funds to the Sports Complex. It was moved by Edgar, seconded by Pon_tious, to award subject contract for construction of IA!urel Glen Park, Tract 12763, to Valley Crest Landscape in the amount of $292,486.80; and appropriate the savings from "this project to the Tustin Ranch Sports Complex. Motion carried 5-0. VIII. ORDINANCES FOR INTRODUCTION - Nome I8. ORDINANCE FOR ADOPTION 1. ORDINANCE NO. 1078, ZONE CHANGE 91-01 (FOOTHILL COMMUNITY BUILDERS) It was moved by Edgar, secoAded by Pont-ious, that Ordinance No. 1078 have second reading by title only. Motion carried 5-0. Following second reading by title only of Ordinance No. 1078 by the City Clerk, it was moved by Edgar, seconded by Pontious, that the following' Ordinance No. 1078 be passed and adopted: ORDINANCE NO. 1078 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,APPROVING ZONE CHANGE 91-01 TO AMEND THE EAST TUSTIN SPECIFIIC PLAN LAND USE MAP TO CHANGE THE LAND USE CATEGORY IN THE VICINITY OF LOT 11 OF TRACT 13627 FROM LOW DENSITY TO MEDIUM DENSITY RESIDENTIAL WITH A MAXIMUM DENSITY OF TEN DWELLING UNITS PER ACRE Motion carried 5-0 (roll call vote). REVIEW OF STATE CONTROLLE*IS REPORT ON THE COMPREHENSIVE FISCAL ANALYSIS FOR INCORPORATION OF NORTH TUSTIN Christine Shingleton, Assistant City Manager, reported that the State Controller's office completed an audit of the Comprehensive Fiscal Analysis For. Incorporation of North Tustin. Upon review, staff believed there were several discrepancies in the report and asked for Council's direction as to whether the.concerns should be forwarded to LAFCO. Councilmember Edgar stated that it was critical to forward staff's concerns before the next LAFCO meeting on November 6; and include reaffirmation of Council's position to not re -zone land in North Tustin annexation. It was moved by Edgar, se onded by Pontious to reaffirm Council's intention to reta'n the present North Tustin land zoning upon annexation to the City. Motion carried 5-0. Council/staff discussion followed regarding LAFCO delays in annexation procedures; and difficulty in identification of North Tustin representation. Councilmember Prescott requested LAFCO conduct the annexation hearings on December 4, 1991,, without further delay. It was moved by Prescott econded b Edgar, that Council forward a letter to LAFCO Is November 6 meeting requesting the three North Tustin annexation hearings be held on December 4, 1991; and include staff's concerns regarding the State Controller's report on the Comprehensive Fiscal Analysis for Incorporation of North Tustin. Motion carried 5-0. 2. ALCOHOL DRUG AND RECOVERY FACILITIES Rita Westfield, Assistant Director of Community Development, reported that at a previous Council meeting, a group of residents from the Yorba/Lind4/Rosalind neighborhood presented a petition to the Council regarding the neighborhood's concern over establishment of a third alcohol and drug rehabilitation facility in the area. Staff investigated the State regulations regarding the licensing of these types of facilities; potential code violations occurring at the facilities; and modifications to State law that might allow more local control. She highlighted the State licensing requirements; Health ana Safety Code provisions; zoning/building code standards; and separation/concentration requirements. She summarized the proposed modifications to State Law including requirement of proposed community care or CITY COUNCIL MINUTES Page 9, 11-4-91 drug and alcohol facility to apply for a permit of lot zoned for single-family dwellings; stipulation that no residential community care facility or drug or alcohol recovery facility serving six or fewer persons be closer than a distance of 31000 feet from any structure housing similar facilities; the Department of Social Services and the Department of Alcohol and Drug Programs shall be 'required to formally contact one another as well as the impacted local jurisdiction to ensure that adequate separation is pjrovided before licensing requests are processed; or consolidate the administration and licensing of community care facilities and drug and alcohol recovery facilities so that the function was handled by one State agency; each responsible agency shall notice local jurisdictions and receive city verification that a permit had been processed and approved; and the Department of Social Services and the Department of Alcohol and Drug Recovery shall respond to complaints about the subject facilities in writing within hin 10 days with a copy of response to complaints forwarded to the local jurisdiction. Mayor Pro Tem Pontious supported staff's recommendations and requested a progress review of this matter by Council in 3-6 months. Councilmember Edgar requested a resolution be presented at the Orange County League of Cities January meeting supporting staff's recommendations. Councilmember Potts requested sending the resolution to Assemblymember Mickey Conroy. Councilmember Prescott requested the residents who presented the petition receive all correspondence on this issue. William Huston stated that thje information should be forwarded to Senator Seymour and AOsemblymember Conroy requesting introduction of legislation. The following members of the,audience voiced their individual concerns and suggestions regiarding the subject: Al Shifberg-Mencher, Chamber of Commerce Director Gene Heileson, Rosalind Drive, Tustin Onalee Elliott, Yorba Street, Tustin Councilmember Edgar stressed that if the public witnessed any city code violations to immediately telephone the police department. It was moved by Edgar, seconded by Potts, to authorize the Mayor to transmit correspondlence to local State legislators, the League of California Cities, and surrounding cities requesting support for modification to State law relating to licensing of community care and drug and alcohol recovery facilities; instruct staff to initiate a code enforcement CITY COUNCIL MINUTES Page 10, 11-4-91 action against Recovery Homes of America facilities at 13682 Yorba Street, 13 671 Rosal incl Drive and 13 681 Rosalind Drive and to take whatever follow+ -up activities necessary to gain code compliance including initiating legal action through the City Attorney's office; a#d prepare a resolution to be forwarded to the League of Cities and local legislators. Motion carried 5-0. BI. NEW BUSINESS 1. FEE WAIVER - DINOSAUR DASH (TUSTIN PUBLIC SCHOOLS FOUNDATION) Gary Magill, Recreation Supervisor, reported the Tustin Public Schools Foundation was conducting a 5K Dinosaur Dash on December 11 1991, and requested fee waivers for police and public works services. The following member of the alldience spoke in favor of the fee waiver: Ben DeMayo, representative of the Tustin Schools Foundation Councilmember Prescott requestled donating the use of the banner poles to promote the event. It was moved by Edgar, seconded by Potts, to approve waiver of fees not to exceed $750 and use of banner poles to advertize the event. Motion carried -5-0. 2. YORBA STREET TREE REMOVAL/REPLACEMENT Robert Ledendecker, Director of Public Works, reported that as staff prepared to remove ficus trees on the east side of Yorba Street, residents voiced concern that removal of the trees would create a negative impact to the neighborhood. He said staff prepared three options including: remove all trees, including eucalyptus, and replace with recommended species; remove only ficus trees and replace with recommended species; and remove alternating ficus trees and divide project into phasing of either one or two years. Council/staff discussion followed regarding ficus tree inventory; removal/replacem4nt program; tree planting procedures; tree maintenance program; and estimated tree growth time period. It was moved by Potts, seconded by Pontious, to approve removal of the ficus trees along the east side of Yorba Street between Vinewood Avenue and Jacaranda Avenue phased over. a two to three- year period, and a replacement program utilizing a 15 -gallon size bradford pear tree. PLANNING COMMISSION ACTION AGENDA - OCTOBER 28, 1991 It was moved by Pontious, seconded by Edgar, to ratify the Planning Commission Action Agenda of October 28, 1991. Motion carried 5-0. 2. SIGNAL TIMING ON CARROLL WAY AT SEVENTEENTH STREET It was moved by Edgar, seconded by Pontious, to receive and file subject report. Motion carried 5-0. 3. LOCAL PROGRAMMING ON COMMUNITY CABLEVISION It was moved by Potts, seconded by Pontious, to receive and file subject report. Motion carried 5-0. 4. RESTRIPING OF NEWPORT AVENUE BETWEEN NISSON ROAD AND EL CAMINO REAL AS WELL AS EL CAMINO WAY' It was moved by Edgar, seconded by Pontious, to receive and file subject report. Motion carried 5-0. S. AMENDMENT TO CONFLICT OF INTEREST CODE Berklee Maughan requested action on earlier request to agendize amendment to Conflict of Intertest Code. CITY COUNCIL MINUTES Page 12, 11-4-91 Council/staff/speaker discussion followed regarding survey of Orange County cities; and timeperiod required for an ordinance affecting the April 1992 election. It was moved by Pontious, seconded by Potts, to agendize the matter for the December 2, 1901 Council meeting. Motion carried 5-0. 2. CONTINENTAL/COMMUNITY CABLEVI4ION BROADCASTING LOCAL EVENTS Nick Burkey, Continental Cabl4vision, reported his company was working with Community Cablevision supplying broadcast tapes of local events. TILLER DAYS/PARADE COMMITTEES Councilmember Edgar commended the Tiller Days/Parade Committees for presenting a positive family-oriented event to the community. 2. ALLEYS Councilmember Edgar requested study in 30 days on the problem to maintain cleanliness of concrete alleys; and suggested the use of volunteer organizations to participate in the upkeep of the alleys. Councilmember Potts requested a study on number of unpaved private alleys in the City. 3. CONVERSION OF FLEET VEHICLES TO ALTERNATE FUEL USE Councilmember Potts requestecl a report on converting fleet vehicles to alternate fuel use. 4. UNDERGROUNDING UTILITIES - CIVIC CENTER Councilmember Prescott questioned the possibility of undergrounding utilities during the Civic Center construction. Christine Shingleton, Assistant City Manager, responded that staff would submit a report at the November 18 Council meeting. S. TUSTIN HIGH SCHOOL FOOTBALL TEAM UNDEFEATED Mayor Puckett reported that the Tustin High School Football team remained undefeated and was featured on NBC television. CLOSED SESSION Mayor Puckett announced the City Council would recess to Closed Session to consider personnel matters pursuant to Government Code Section 54957; and pursuant to Government Code Section 54956.9 (a) to confer with the City Attorney regarding pending litigation which had been initiated formally and to which the City was a party. The title of the litigation was Gertru4e Page vs. the City of Tustin and the case number was 62-27-43; and Richard Page vs. the City of Tustin, case number SACV 900010AHS (RWRX). BVI.
