The City Council meets the first and third Monday of each month at 7:00 p.m. in the City Council Chambers at 300 Centennial Way. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City Council agenda books located in the Police Department and the Tustin Public Library. These same books are also provided for public use in the Council Chambers during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you. desire to smoke, an outside speaker has been provided. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. INVOCATION - The Invocation will be given by Father MacCarthy, St. Cecilia's Catholic Church. III. ROLL CALL PUBLIC HEARINGS 1. FINAL SOURCE REDUCTION AND RECYCLING (ERRE) AND HOUSEHOLD -HAZARDOUS WASTE ELEMENTS (HHWE) The --purpose of- t -he SRRE and HHWE is to identify how the -City will divert -s©lid--waste - from the landfill through source reduction, recycling and composting by the following increments: 25% by 1995 and 50% or the maximum amount feasible by 2000. Recommendation by the Community Development Department: a. Approve the environmental determination for the Source Reduction and Recycling Element (SRRE) and Household Hazardous Waste Element (HHWE) by adopting the following Resolution Nos. 91-154 and 91-155: RESOLUTION NO. 91-154 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR THE FINAL SOURCE REDUCTION AND RECYCLING ELEMENT (SRRE) INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT -- RESOLUTION NO. 91-155 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR THE FINAL HOUSEHOLD HAZARDOUS WASTE ELEMENT (HHWE) INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT CITY COUNCIL AGENDA PAGE 1 DECEMBER 2, 1991 b. Approv :he Final Source Reducti and Recycling Element (SRRE) and Household Hazardous Waste Element (HHWE) by adopting the following Resolution No. 91-153: RESOLUTION NO. 91-153 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE CITY'S FINAL SOURCE REDUCTION AND RECYCLING ELEMENT (SRRE) AND HOUSEHOLD HAZARDOUS WASTE ELEMENT (HHWE) 2. PRICING INFORMATION ON TEMPORARY BANNER (13102 NEWPORT AVENUE #106) - This item was continued from the November 18, 1991, City Council meeting at the applicant's request. Recommendation: Uphold the Planning Commission's denial of a request to place pricing information on a temporary banner to be located at 13102 Newport Avenue as recommended by the Community Development Department. V. CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request -- - specific items be discussed and/or -removed from the Consent -Calendar - for separate action. 1. APPROVAL OF MINUTES - NOVEMBER 18, 1991 REGULAR MEETING . Recommendation: Approve the City Council Minutes of November 18, 1991. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,394,947.38 and ratify Payroll in the amount of $290,696.40. 3. REJECTION OF CLAIM NO. 91-39 - CLAIMANT, DONALD ROBBINS; DATE OF LOSS, 7/22/91; DATE FILED WITH CITY, 8/16/91 Recommendation: Reject subject claim for property damage of an undetermined amount as recommended by the City Attorney. 4. VESTING TENTATIVE TRACT MAP NO. 14410 RESOLUTION NO. 91-150 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-21 AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE CITY COUNCIL AGENDA PAGE 2 DECEMBER 21 1991 TRACT MAP NO. 14410 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Recommendation: Approve the environmental determination for the ro'ect by adopting Resolution No. 91-150; and RESOLUTION NO. 91-151 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING VESTING TENTATIVE TRACT MAP NO. 14410 TO CREATE 146 NUMBERED AND 37 LETTERED LOTS,eFOR A SINGLE FAMILY DETACHED DWELLING PROJECT LOCATED ON LOTS 71 81 "N", "O" AND "U" OF TRACT 13627 Recommendation: Approve Vesting Tentative Tract Map No. 14410 by adopting Resolution No. 91-151, as submitted or revised, as recommended by the Community Development Department. 5. AWARD OF CONTRACT FOR WATER MAIN RELOCATION ON MAIN STREET AT I-5 FREEWAY Recommendation: Award the contract to Savala Construction Company, Irvine, in the amount of $200,290.37 for the subject project as recommended by the Public Works Department/ Engineering Division. 6. RESOLUTION NO. 91-152 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ADMISSION OF THE CITY OF LAKE FOREST AS A PARTY TO THE FOOTHILL/EASTERN TRANSPORTATION CORRIDOR AGENCY Recommendation: Approve the admission of the City of Lake Forest as a party to the Foothill/Eastern Transportation Corridor Agency and authorize the Mayor to execute Amendment No. 1 to the First Amended and. Restated .Joint Exercise of Powers Agreement creating the Foothill/Eastern Transportation Corridor Agency with the adoption of Resolution No. 91-152 as recommended by the Public Works Department/Engineering Division. 7. RESOLUTION NO. 91-156 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS- OF IMPROVEMENT AND REPAIR, AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION -FOR SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, 1990-91 FISCAL YEAR Recommendation: Adopt Resolution No. 91-156 accepting works of improvement and repair and authorizing the recordation of the Notice of Completion for the sidewalk and curb and gutter project for fiscal year 1990-91 as recommended by the Public Works Department/Engineering Division. S. STATE -LOCAL ENTITY MASTER AGREEMENT NO. SLTPP-5271 PROGRAM SUPPLEMENT NO. 1 (STATE -LOCAL TRANSPORTATION PARTNERSHIP PROGRAM) Recommendation: Approve and authorize the Mayor and City Clerk to execute subject agreement supplement as recommended by the Public Works Department/Engineering Division. 9. REVISED FACILITY USE POLICIES AND FEE SCHEDULE Recommendation: Adopt Revised Facility Use -Policies and Fee Schedule to be effective January 2, 1992, as recommended by the Parks and Recreation Commission and Community Services Department. RESOLUTION BE PRESENTED TO LEAGUE OF LIFORNIA CITIES RELATED TO COMMUNITY CARE FACILITIES Recommendation: Authorize transmittal of the draft resolution for consideration by the League of California Cities as recommended by the Community Development Department. 11. YORBA STREET -FIRST STREET TO IRVINE BOULEVARD AHFP NO. 1293 RIGHT OF WAY AGREEMENT Recommendation: Approve and authorize the Mayor and City Clerk to execute subject agreement as recommended by the Public Works Department/Engineering Division. 12. 1992 VACANCY LISTING FOR COMMISSIONS/COMMITTEES/BOARDS Recommendation: Approve 1992 vacancy listing of City Council - appointed Commissions, Committees and Boards for posting and distribution to the public as recommended by the Office of the City Clerk. VII. ORDINANCES FOR INTRODUCTION - None VIII. ORDINANCES FOR ADOPTION - None IX. OLD BUSINESS 1. FEASIBILITY STUDY TO PROVIDE A MEDIAN OPENING ON TUSTIN RANCH ROAD AT PALERMO At their meeting of November 18, 1991, the City Council directed staff to investigate the possible construction of a left turn pocket within the existing raised median on Tustin Ranch Road at Palermo for access into the Almeria Development. Recommendation: Pleasure of the City Council. 2.. FRANCHISE AGREEMENT - REFUSE,HAULING AND RECYCLING Councilmember Potts requested a staff report regarding the status of the City's agreement with Great Western Reclamation for trash hauling and recycling services. Recommendation: Pleasure of the City Council. X. NEW BUSINESS 1. AMENDMENT TO CONFLICT OF INTEREST CODE At the November 4, 1991 City Council meeting, Mr. Berklee Maughan requested the City Council agendize discussion of amending the City's Conflict of Interest Code to include campaign contributions. Recommendation: Continue this item to a future City Council meeting as recommended by the City Attorney. 2. REQUEST FOR REMOVAL OF ON -STREET PARKING PROHIBITIONS ON LAGIER WAY DURING THE HOLIDAY SEASON (11-27-91 TO 1-2-92) At the City Council meeting of November 18, 1991, Ms. Jane Anderson of 2473 Via Corella (Sevilla townhomes neighborhood of East Tustin) requested an easing of the on -street parking CITY COUNCIL AGENDA PAGE 4 DECEMBER 21 1991 prohibitio; )n Lagier Way during the he ay season (November 27, 1991 to January 2, 1992). Recommendation: Deny the request to remove existing on -street parking prohibitions on Lagier Way during the holiday period from November 270, 1991 to January 2, 1992; and advise the Sevilla Homeowners Association that additional on-site parallel parking is available for their use adjacent to curbs not painted red and labeled "Fire Lanes", as recommended by the Public Works Department/Engineering Division. XI. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - NOVEMBER 25, 1991 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of November 25, 1991. 2. ALCOHOLIC BEVERAGE SALES ESTABLISHMENTS On November 18, 1991, the City Council requested information on changes to Alcoholic Beverage Control licenses issued in Tustin during the past five years.
