HomeMy WebLinkAbout00 AGENDA 05-20-91AGENDA REGULAR MEETING OF THE TUSTIN CITY COUNCIL MAY 20, 1991 The City Council meets the first and third Monday of each month at 7:00 p.m. in the City Council Chamber at 300 Centennial Way. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City Council agenda books located in the Police Department and the Tustin Library. These same books are also provided for public use in the Council Chamber during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chamber; however, if you desire to smoke, an outside speaker has been provided. WORKSHOP - The City Council will conduct a Park Financing Workshop at 5:30 p.m. in the Council Chambers. The Parks and Recreation Commission will also be in attendance. PUBLIC HEARINGS 1. PROPOSED ORANGE COUNTY FIRE DEPARTMENT FEES The City of Tustin contracts with the County of Orange for the Orange County Fire Department to provide fire services. Recommendation: Adopt the following Resolution No. 91-56 establishing Orange County Fire Department fees as recommended by the Orange County Fire Department: RESOLUTION NO. 91-56 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, TO ENACT FEES FOR FIRE PROTECTION, FALSE ALARMS AND MISCELLANEOUS SERVICES PROVIDED BY THE ORANGE COUNTY FIRE DEPARTMENT AND TO AUTHORIZE THE COUNTY OF ORANGE TO ADMINISTER COLLECTION AND ENFORCEMENT OF CERTAIN FEES 2, AMENDMENT TO URGENCY ORDINANCE NO, 1045 TO INCORPORATE THE AMENDMENTS TO THE COUNTY HAZARDOUS WASTE MANAGEMENT PLAN Each City is required to enact an ordinance adopting or incorporating applicable portions of the Orange County Hazardous Waste Management Plan. APPEAL OF VARIANCE 91-02 (EL DORADO BANK) Applicant has appealed the decision to deny portions of Variance 91-02 and is requesting approval of the request to allow supplemental text on the business identification sign and to place a 25 square foot wall sign on a building fascia. RESOLUTION NO. 91-72 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR CONSTRUCTION OF EMBOSSED CONCRETE MEDIAN PAVING IMPROVEMENTS AT VARIOUS LOCATIONS Recommendation: Adopt Resolution No. 91-72 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Engineering Division. 5. ORDINANCE NO. 1069 - LOITERING The purpose of Ordinance No. 1069 is to provide the Police Department with an additional tool to combat complaints of juveniles in the south end of the City loitering in the vicinity of various apartments and strip shopping centers. OLD BUSINESS 1. POLICE DEPARTMENT REORGANIZATION At the May 6, 1991 City Council meeting, Councilmember Potts requested further information regarding the cost of the Police Department's reorganization. Recommendation: Adopt the following Resolution No. •91-53 amending the City of Tustin Classification Plan as recommended by the Police Department: RESOLUTION NO. 91-53 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN 2. DECLARATION OF AN INTENTION TO CONDUCT A PUBLIC HEARING FOR A PUBLIC NUISANCE AT 1001 AND 1011 EL CAMINO REAL Over the past three years, Community Development Department staff has been actively pursuing the enforcement of a property maintenance violation at 1001 and 1011 E1 Camino Real. Recommendation: Adopt the following Resolution No. 91-66 declaring the City's intent to hold a public hearing on June 3, 1991, for the purpose of determining whether the condition of the property located at 1001 and 1011 E1 Camino Real constitutes a public nuisance pursuant to Article 5, Chapter 5 of the Tustin City Code as recommended by the Community Development Department: RESOLUTION NO. 91-66 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING THE INTENTION TO CONDUCT A PUBLIC HEARING TO DETERMINE WHETHER THE CONDITION OF THE PROPERTY LOCATED AT 1001 AND 1011 EL CAMINO REAL CONSTITUTES A PUBLIC NUISANCE TO BE ABATED 3. APPEAL OF CONDITIONAL USE PERMIT 91-04 (305 EAST MAIN STREET) At their meeting of May 6, 1991, the City Council considered this appeal request and referred the dedication requirement back to staff for reevaluation. Recommendation: Modify Planning Commission Resolution No. 2888, Condition No. 2.1(c)(2), by adopting the following Resolution No. 91-64 as recommended by the Community Development Department: RESOLUTION NO. 91-64 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MODIFYING CONDITION NO. 2.1(C)(2) OF PLANNING COMMISSION RESOLUTION NO. 2888 WHICH AUTHORIZED CONDITIONAL USE PERMIT 91-04 AT THE PROPERTY LOCATED AT 305 EAST MAIN STREET X. NEW BUSINESS 1. FIRE FINANCIAL EQUITY STUDY As a result of on-going complaints from some cities about the methodology used in pricing contracts for County Fire Department services, the County agreed to work with the cities in evaluating alternative funding mechanisms. Recommendation: Adopt the following Resolution No. •91-74 agreeing to work with the County and Fire Department contract cities in - studying the feasibility of reorganizing the County Fire Department as recommended by the City Manager: RESOLUTION NO. 91-74 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AGREEING TO WORK.WITH THE COUNTY OF ORANGE AND THE FIRE CONTRACT CITIES TO STUDY ALTERNATIVE ORGANIZATIONAL STRUCTURES AND FUNDING MECHANISMS FOR FIRE SERVICES XI. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - MAY 13, 1991 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of May 13, 1991. 2. I-5/SR-55 INTERCHANGE RECONSTRUCTION, STAGE II CONSTRUCTION SCHEDULE UPDATE This report is a brief update of the status and schedule of the I-5/SR-55 Interchange Project. CLOSED SESSION The City Council will recess to Closed Session pursuant to Government Code Section 54956.8 to give instructions to the City's negotiator regarding negotiations with the owner of the property concerning the purchase/sale/exchange/lease of the property located at Vandenberg Lane and the Orange County Flood Control District Channel. XV. ADJOURNMENT The City Council has scheduled a joint dinner meeting with the Tustin Unified School District Board of Education on May 23, 1991, at 7:00 p.m. at the Tustin Area Senior Center.
