SUBJECT: PROPOSED ORANGE COUNTY FIRE DEPARTMENT FEES
RECOMMENDATION
The Orange County Fire Department recommends that the
City Council adopt Resolution 91-56 establishing Orange
County Fire Department fees.
BACKGROUND '
The City of Tustin contracts with the County of Orange for the
Orange County Fire Department to provide fire services.
On July 18, 1990, the Orange County Board of Supervisors passed
Resolution 90-1011 establishing a fee schedule for fire prevention,
false alarms and miscellaneous services provided by the Orange
County Fire Department to become effective July 1, 1991. The
amount of each fee is to recover operating costs incurred in
providing those services. Adopting the recommended fee schedule
was originally deferred pending contract negotiations with the
County.
The Board of Supervisors requested each contract city to adopt the
fee schedule and to authorize collection of those fees. One of the
recommendations contained in the Fire Financial Equity Study (to be
considered by the City Council under New Business) is that the fire
prevention, false alarm and miscellaneous fees be implemented. The
contract cities concluded that the fees set forth in the resolution
are reasonable and consistent with a user fee approach used by the
cities. Regardless of how the County Fire Department is
restructured, the contract cities all agreed that the fees are
needed to maintain the financial viability of the Fire Department.
The City of Tustin will collect fees relating to plan check and new
construction inspection services for the Fire Department and add an
administrative fee for doing so. Other specified fees will be
collected by the Fire Department directly.

Fees for false alarms are included in the fee schedule. The Fire
Department will not be able to collect those fees until the City
Council adopts an ordinance which specifically authorizes
collection of a fee for false alarms. The ordinance will be
submitted to the City Council within approximately thirty (30)
days.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN TO ENACT FEES FOR FIRE PREVENTION, FALSE
ALARMS AND MISCELLANEOUS SERVICES PROVIDED BY THE
ORANGE COUNTY FIRE DEPARTMENT AND TO AUTHORIZE THE
COUNTY OF ORANGE TO ADMINISTER COLLECTION AND
ENFORCEMENT OF CERTAIN FEES.
The City Council of the City of Tustin does hereby resolve as
follows:
I. The City Council finds and determines as follows:
A. After a public hearing on July 18, 1990 by
Resolution No. 90-1011, the Board of Supervisors of
the County of Orange adopted a fee schedule for
fire prevention, false alarms and miscellaneous'
services provided by , the Orange County Fire
Department to be effective July 1, 1991; and
B. The City of Tustin contracts with the County ofl
Orange for the Orange County Fire Department to
perform city fire services which are mandated by
Government Code Section 38611 for general law
cities; and
C. The Board of Supervisors of the County of Orange
has requested that each of the Orange County Fire
Department's contract cities adopt the above -
referenced fee schedule to partially offset the
costs of fire prevention services provided to the
cities and to provide uniformity; and
D. The proposed fees are for the purpose of meeting
operating expenses and are therefore exempt from
the California Environmental Quality Act in
accordance with Public Resources Code Section
21080(b) (8) ; and
E. A Notice of Public Hearing on the City of Tustin
enactment of the proposed fee schedule was given
and published in accordance with Government Code
Sections 54994.1(a) and 6062a and all interested
persons have had the opportunity to make oral or
written presentations relative thereto; and
F. The Board of Supervisors of the County of Orange is
hereby authorized to provide by Resolution the
amount of each fee which shall be.charged to those'
city residents who request, require or incur fire'
prevention, false alarm and other miscellaneous)
services provided by the Orange County Fire

Department subject to approval of said fees by the
City of Tustin.
II. The City of Tustin does hereby establish the following
Orange County Fire Department fees as shown on Exhibit
"A" to be effective July 1, 1991.
III. The County of Orange Fire Department is hereby authorized
to administer the fee schedule shown in Exhibit "A" and
take said collection and enforcement action as may be
necessary, with the exception that the City of Tustin
shall collect plan check and new construction inspection
fees only for the Orange County Fire Department, plus an
administrative fee to defray costs incurred by the City
of Tustin for this service. Collection of permit,
reinspection, false alarm and miscellaneous fees shall
remain the responsibility of the Orange County Fire
Department. Fire Alarm fees can not be collected until
and unless authorized by ordinance of the City of Tustin.
IV. The Orange County Fire Department Fee Schedule and the
City of Tustin Administrative Fee, as shown in Exhibit
"A", shall be automatically adjusted annually beginning'
July 1, 1992 through June 30, 1994, based on changes to!
the Consumer Price Index (CPI) for the period of March to
March of the previous year.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin, held on the 20th day of May, 1991.
