DOUGLAS FRANKS, CHIEF OF POLICE SUBJECT: LOITERING ORDINANCE Attached is a new loitering ordinance that has been drafted at our request by the City Attorney's office. The purpose of this ordinance is to provide us with an additional tool to combat the constant complaints we get of kids in the south end of our City continually loitering around various apartments and strip shopping centers. This ordinance was modeled after Santa Ana's ordinance, developed to combat a similar problem. Once this ordinance is passed, we will have the appropriate signage in the highly effected areas completed. We already have approval of various property owners to implement this program should it be approved. I would request that this item be added to the consent calendar for first reading for the next Council Meeting on 5/20/91. Thanks in advance for your assistance. W. Prohibition of Loitering So As To Obstruct Passage a. Public Property. No person, after first being warned by a law enforcement officer, shall loiter, stand, sit or lie in or upon any public street, sidewalk, curb, crosswalk, walkway area or mall so as to hinder or obstruct the free passage of pedestrians or vehicles thereon; nor shall any person block, obstruct or prevent the free access to the entrance of any building open to the public. b. Private Property Open to the Public. No person after first being warned by a law enforcement officer, or where a sign or signs have been posted in accordance with this section, shall loiter, stand, sit or lie in or upon any portion of private property utilized for public use, so as to hinder or obstruct the free passage of pedestrians or vehicles thereon; not shall any person block, obstruct or prevent the free access to the entrance of any building open to the public."
