HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT:TENTATIVE TRACT MAPS 13030 & 13038 'ONSENT CALENDAR NO. 5 5-6-91 Inter - Com RECOMMENDATION It is recommended that the City Council: 1) Approve the Environmental Determination for the projects by adopting Resolution Nos. 91-57 and 91-59. 2) Approve Tentative Tract Map 13030 by adopting Resolution No. 91-58 and Tentative Tract Map 13038 by adopting 'Resolution No. 91-60. BACKGROUND At their regular meeting on April 22, 1991, the Planning commission adopted Resolution Nos. 2903 and 2905 (attached), recommending to the City Council approval of Tentative Tract Maps 13030 and 13038. These subject maps were previously approved by the City Council on October 7, 1987. However, the applicant failed to satisfy Condition of Approval No. 8.10 of Planning Commission Resolution Nos. 2431 and 2435, which originally read: "Prior to recordation of a final map for condominium purposes, developer shall provide a statement documenting how the project once converted to condominiums will ensure compliance with the East Tustin Specific Plan, Development Agreement, EIR 85-2 and the Tustin Area General Plan as it relates to provision of affordable housing." The subject tentative maps are being submitted to renew condominium rights for properties which maintain apartment complexes that have already been built and are more commonly known as Rancho Maderas ( TTM 13 0 3 0 ) and Rancho Tierra ( TTM 13038). The subject maps do not propose any changes to the existing sites and will not result in the loss or creation of any units. Rancho Maderas, located at 13408 Heritage Way, maintains 266 units and is bounded on the north by a future commercial property, on the City Council Report Tentative Tract Maps 13030 & 13038 May 6, 1991 Page 2 south by Bryan Avenue, across Heritage Way on the east by townhomes and on the west by Jamboree Road. Rancho Tierra, located at Myford Road, maintains 252 units and is bounded on the north by Irvine Boulevard, across Heritage Way on the south by townhomes, across Myford Road on the east by 246 apartment units presently under construction and on the west by a future commercial property. DISCUSSION As a condition of approval of Tract No. 12763 (the sector level map for Phase II), an affordable housing program for East Tustin was outlined by the Irvine Company. In that program it was demonstrated that affordable housing would be provided in East Tustin by the development of apartment projects. Provided the projects remained apartment projects, the affordable housing requirements of the Specific Plan would be met. However, since Tentative Tract Maps 13030 and 13038 could ultimately authorize conversion of the two apartment projects to condominiums, it was determined that a revised housing program would need to be provided to ensure provision of affordability. The applicant has indicated that they have no immediate plans to convert the apartment projects given the current restrictions of bond programs they participate in which supported the original financing of each project. However, the Community Development Department received correspondence from the applicant on October 26, 1990, which requested that the following program be considered in the event that a condominium conversion were to be implemented in the future: Affordability at levels prescribed in the EIR 85-2 and the resulting Tustin Ranch Affordable Housing Plan (100 "Low" (50-80% of Median) units and 500 "Moderate" (80- 120% of Median) units) would expire for rental units at expiration of the initial 10 year period of the current bond financing arrangements unless additional subsidized financing is obtained. If the projects are converted to condominiums within 5 years after expiration of the initial 10 year period of the current bond financing arrangements, those units designated as "affordable" would be sold at prices within the income limits noted above. This program was reviewed by the City Attorney's office and, as proposed, the City Attorney's office has determined that this program meets the requirements stated in the Development Agreement as well as the Environmental Impact Report (85-2) certified for the East Tustin Specific Plan. The hearing on the issue was only delayed pending an application submittal and recirculation of the maps to outside agencies as required by law and tenant noticing. CONCLUSION Based on the above discussion, and as the applicant has been able to satisfy all other Conditions of Approval for the subject maps, it is recommended that the City Council adopt Resolution No. 91-58 approving Tentative Tract Map 13030 and Resolution No. 91-60 approving Tentative Tract Map 13038. c. lelf.NBonner Christine A. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. That Tentative -Tract Map 13030 and respective development plans are considered "projects" pursuant to the terms of the California Environmental Quality Act; and B. That the project is covered by a previously certified Final Environmental Impact -Report for the East Tustin Specific Plan which serves as a Program EIR for the proposed project. II. *The East Tustin Specific Plan Final Environmental Impact Report (85-2), previously certified on March 17, 1986 as modified by subsequently adopted supplements and addenda, was considered prior to approval of this project. The City Council hereby finds: this project is within the scope of the East Tustin Specific Plan previously approved; the effects of this project, relating to grading, drainage, circulation, public services and utilities, were examined in the Program EIR. All feasible mitigation measures and alternatives developed in the Program EIR are incorporated into this project. The City Council has found that the project involves no potential for any adverse effect, either individually or cumulatively, on wild life resources and; therefore, makes a De Minimis Impact Finding related to AB 3158, Chapter 1206, Statutes of 1990. The City Council finds and determines as follows: A. That Tentative Tract Map No. 13030 was submitted to the City Council by Irvine Pacific, for .consideration.. B. That a public hearing before the Planning Commission was -duly called, noticed and held for said map on April 22, 1991. C. That an Environmental Impact Report (EIR 85-2 for the East Tustin Specific Plan) has been certified in conformance with the requirements of the California Environmental Quality Act for the subject project area. D. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of single family detached dwellings. E. The 1.7556 acres of parkland required for this development was previously dedicated with recordation of Tract 12763. F. The Planning Commission hereby recommends to the City Council approval of Tentative Tract Map No. 13030 subject to the following conditions: A. The following verbiage shall be added to Condition 8.10 of Planning Commission Resolution No. 2435 accepting the following program: "Affordability at levels prescribed in the EIR 85-2 and the resulting Tustin Ranch Affordable Housing Plan (100 "Low" (50-800 of Median) units and 500 "Moderate" (80-120% of Median) units) would expire for rental units at expiration of the initial 10 year period of the current bond financing arrangements unless additional subsidized financing is obtained. All remaining Conditions of Approval attached as Exhibit A to Resolution No. 2435 remain in full force and effect. Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's_ check payable to the COUNTY CLERK in the amount of $25.00. (twenty-five dollars) pursuant to AB 3185, Chapter 1706, Statutes,of 1990, enable the City to file the Notice of Determination required under Public Resources Code Section 21152 and 14 Cal. Code of Regulations 15094. If within such forty-eight (48) hour period that the applicant has not delivered to the Community Development Department the above - noted check, the approval for the project granted herein shall be considered automatically null and void. In addition, should the Department of Fish and Game reject the Certificate of Fee Exemption filed with the Notice of Determination and require payment of fees, the applicant shall deliver to the Community Development Department, within forth -eight (48) hours of notification, a,cashier's check payable to the COUNTY CLERK in the amount of $850 (eight hundred -fifty dollars) pursuant to AB 3158_,. Chapter 1706, Statues of 1990. If this fee is imposed, the subject project shall not be operative, vested or final unless and until the fee is paid. D. Southern California Edison Company requires that in the event this development requires relocation of facilities on the subject property, which facilities exist by right of easement or otherwise, the owner/developer will be requested to bear the cost of such- relocation and provide Edison with suitable replacement rights. That an Environmental Impact Report (EIR 85-2 for the East Tustin Specific Plan) has been certified in conformance with the requirements of the California Environmental Quality Act for the subject project area. D. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of single family dwellings. E. The 1.6632 acres of parkland required for this development was previously dedicated with recordation of Tract 12763. , F. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2 with subsequently adopted supplements and addenda, the impacts of Tentative Tract 13038 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. G. That the site is physically suitable for the type of development proposed. H. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. J. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at -large, for access through or use of the property within the proposed subdivision. K. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. II. The Planning Commission hereby recommends to the City Council approval of Tentative Tract Map No. 13038 subject to the following conditions: A. The following verbiage shall be added to Condition 8.10 of Planning Commission Resolution No. 2431 accepting the following program: "Affordability at levels prescribed in the EIR 85-2 and the resulting Tustin Ranch Affordable Housing Plan (100 "Low" (50-80% of Median) units and 500 "Moderate" (80-120% of Median) units) would expire for rental units at expiration of the initial 10 year period of the current bond financing arrangements unless additional subsidized financing. is obtained. "If the projects are converted to condominiums within 5 years after expiration of the initial 10 year period of the current bond financing arrangements, those units designated as "affordable" would be sold at prices within the income limits noted above. All remaining Conditions of Approval attached as Exhibit A to Resolution No. 2431 remain in full force and effect. C. Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $25.00 (twenty-five dollars) pursuant to AB 3185, Chapter 1706, Statutes of 1990, enable the City to file the Notice of Determination required under Public Resources Code *Section 21152 and 14 Cal. Code of Regulations 15094. If within such forty-eight (48) hour period that the applicant has not delivered to the Community Development Department the above - noted check, the approval for the project granted herein shall be considered automatically null and void. In addition, should the Department of Fish and Game reject the Certificate of Fee Exemption filed with the Notice of Determination and require payment of fees, the applicant shall deliver to the Community Development Department, within forth -eight (48) hours of notification, a cashier's check payable to the COUNTY CLERK in the amount of $850 (eight hundred -fifty dollars) pursuant to AB 3158, Chapter 1706, Statues of 1990. If this fee is imposed, the subject project shall not be operative, vested or final unless and until the fee*is paid.
