HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: ADOPTION OF RESOLUTION FOR AUTHORIZATION OF DESTRUCTION OF COMMUNITY DEVELOPMENT DEPARTMENT RECORDS RECOMMENDATION Request the City Council adopt a resolution authorizing the destruction of Community Development Department records pursuant to the authority granted by Sections 34090, 34090.5 of the Government Code of the State of California. BACKGROUND In coordination with the City Hall temporary relocation and -as part of the routine purging of the Department's filing system the records listed in Exhibit "A" were determined to be no longer required for the conduct of city business. Government Code Section 34090 authorizes the head of a City department, with approval of the. City. Council by resolution and the written consent of the City Attorney, to destroy City records, under his/her charge, without making a copy thereof, after such documents are no longer required. Examples of those documents requested for destruction at this, time where copies will not be made; include items such as check requests, department correspondence, Planning Commission and City Council agendas, consultant references, purchase orders, and payroll records. The City Attorney has determined that duplicate records are required for any conditional use permit, variance, and zone change application where there has been activity in the past 2 years. The Community Development Department has reproduced these files by microfilm pursuant to the procedure established by Governmental Section 34090.5. Although City Council approval is not required for the destruction of these records the listing of use permits, variances, site plan reviews, temporary use permits and zone changes to be destroyed are identified in Exhibit A. Shinglet Assistant City Manager CAS:kbc\records.cas 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25' 26 27 28 RESOLUTION NO. 91-63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESTRUCTION OF CERTAIN COMMUNITY DEVELOPMENT DEPARTMENT RECORDS WHEREAS, except for records affecting title to real property or liens thereon, court records, records less than two years old, records required to be kept by ordinances, or resolutions of the City Council and other City boards or commissions, Government Code Section 34090 authorizes the head of a city department to destroy any city record, document, instrument, book or paper, under this charge, without making a copy thereof, after the same is no longer required, with the approval of the City Council, by Resolution and the written consent of the City Attorney; and WHEREAS, the Council, upon request of the Director of Community Development, desires to approve immediate destruction of certain Community Development Department files as listed in Exhibit "A" attached. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Tustin, California: Pursuant to Sections 34090, et. seq., of the Government Code of the State of California, approval is hereby granted for the immediate destruction of the items on the attached list which have been retained for more than two years.
