Pleasure of the City Council.
BACKGROUND:
At the April 1, 1991, City Council meeting, the Council took action
to fund the Congregate Site Program at the Tustin Area Senior
Center at a "not to exceed" amount of $9,973. Staff has since
clarified with the Feedback Foundation staff that the City's
remaining obligation on the Congregate Program is $2,727. --to wit:
$90,973 Feedback request for funds
50,000 Council funding through non-profit
assistance in December 1990
2,246 Money raised by Nick Ogden at Senior
Center
$2,727 Balance (This amount was authorized at
the Council meeting April 1, 1991.)
Regarding the Home -Delivered program, Feedback has provided
statistical data, pursuant to the Council's request. This data is
attached, as well as the staff report from the April 1 City Council
meeting. Feedback staff has reduced the request for the home -
delivered program from $11,232 to $8,649 on the basis on Tustin
residents served.
Still to be considered, therefore, is the Feedback Foundation
request for $8,649 for home -delivered meals. City staff has
noti f ied Feedback staf f that they are welcome to attend the Council
meeting.

Dear Royleen White:
Per our telephone conversation earlier this month, I am enclosing
additional information on our home meal program in Tustin as
requested:
1. Statistical, sheet showing year-to-date services.
to Tustin area and column two shows services to
Tustin City residents only.
2. Copy of delivery list for 4/5/91 and 4/30/91 (meals
have to be ordered 3-5 days ahead in order to prepare
the proper quantities). This list denotes street
names, number and type of meal and zip code for Tustin
City residents of 92680.
3. Copy of letter addressed to Richard Edgar dated Febru-
ary 5, 1991'which shows on page two the demographics
for the Tustin area for 7/l/89 - 6/30/90.
Since inception of the concept of requesting a "fair share" of
financial support from each host city, we have included financial
and program information on both of our programs in Tustin; congregate
and home meal services. The proposal submitted in November 1990
to the City of Tustin included both programs also. 'therefore,
we were dismayed to learn earlier this month that the Council only
acted upon part of our request -- support to the congregate program.
The "fair share" financial request submitted in November 1990 to
the City of Tustin for home meals included: $11,232.00 for 58,�
a .meal) based on serving. 19,500 meals during the period of 7/1/90
- 6/30/91, averaging 40 persons a day.
Our

revised request to the City of Tustin is for: $8,649.00 (or
a meal) for 14,800 meals, averaging service to 26 persons a
residing within the Tustin City limits.

This request is reduced by 23% to match the reduction in estimated
home meals to accomodate the city's wish to not support meals to
seniors residing outside of the 92680 zip code Area.
I would appreciate your attention to this matter as soon as possible.
We are continuing to deliver meals. Without funds from the City
of Tustin to help support this program, we will need to curtail
services immediately.
Please advise us if the council wishes further information or would
allow a member of Feedback to address the council during a scheduled
hearing.

Dear Mayor Edgar:
I enjoyed talking with you at the terrific Tustin Senior
Center on Thursday, January 24th. Your presence as well
as others shows your support for this much- needed program.
Whenever Y attend a special function at Tustin, I am
reminded of how hard we fought to get 'a nutrition program
for the Tustin area elderly residents and I am proud
bf our efforts.
In response to your letter dated January 14, 1991, many
thanks for the $5, 000.00 check as an interim donation.
1 believe that Peggy Weatherspoon, Director of the Area
Agency on Aging responded in detail to your concerns and
requests for audits. please refer to her letter dated
January 31, 1991.
Please be assured that we have already been thoroughly
reviewedt assessed, audited and questioned by various
County departments, as well as independent auditors.
When we realized that we had financial problems last
spring, we went directly to the County, to Peggy Weath--
erspoon, Director of the Area Agency on Aging, as is
apppropriate. we have certainly not tried to hide our
financial cordition...it has been shared with everyone.
We recently reviewed our proposal to the County dated 1981-
82
98182 -- ten years ago. Our cost per meal in 81-82 was within
10� of today's cost. According to normal inflation.
over the past ten years, a meal, that cost $3.58 should
be $6.05 today. It is $3.68. It would seem, after -
very thorough investigation by many County departments
and outside auditors that "our crime" was that we did
not ask for City support sooner or reduce services,
based on funds available.

As I stated on January 24thr Feedback Foundation seem*
to have a talent for hiring dedicated people and having
them work very hard for very low wages in order to
provide better meals and more services for the elderly.
But it really isn't fair or productive to expect our staff
to continue working year after year without any increases,
I recently attended a area City Council "Work" session. The
Mayor Pro Tem made me feel as though our staff's hard work over
the years was worthwhile when he said; "I ant embarrassed by this.
This program does so much good and is asking for so little, give
them whatever they need.
In addition to the very visible meal program at the, Tustin Area
Senior Center, Feedback Foundation provides meals for the homebound
elderly residents of. Tustin. We average 40 clients per stay,
about half of *them also receive an evening meal and weeXend meals.

In our programs, it is a federal requirement that donations,
toward the cost of the meal are confidential and voluntary
and no Qns can be denied a meal because of inability' to contribute,,
our averages donation in the home meal program is approximately 530*
If the City of Tustin is unable to support our efforts,
please contact us directly so that we can arrange to meet with
you and discuss options. As I stated previously, federal
funds have remained the same in Oranqa County for eight years.
Costs have increased during this period and participant dona-
tions have been dwindling. we cannot providd'quality meal
services -for the elderly residents of Tustin unless there is
money to pay for them. '

ALTERNATIVES
1. Fund the entire amount requested for both home -delivered
meals and congregate site meals which is $16,205:
2. Fund only congregate site, which is the program at the
Tustin Area Senior Center; this amount is $4,973 or
$9,973, depending on Feedback staff interpretation.
3. Fund nothing, which puts the program at the Senior Center
site at risk of closing down.
4. Guarantee to Feedback that donations will meet cost for
congregate site, or that City will make up the
difference, as Laguna Beach has done.
5. Direct staff to renegotiate with Feedback in order to
address the issues of "fair share" formula, lack of
credit for in-kind services, and lack of credit for the
$3,000 that Nick Ogden has raised on the Tustin site.
BACKGROUND
As Council will recall in January of 1991 the staff updated Council
regarding Feedback Foundation's request for funding. That report
is attached. The Feedback Foundation has requested $21,205 from
the City of Tustin to make up a short -fall that the Foundation is
experiencing in its funding. Thus far, the Council has authorized
a $5000 partial payment as recommended by the Non-profit Assistance
Task Force. This leaves a balance of $16,205 that Feedback feels
the City should forward to Feedback.
-- Staff had concerns regarding the Feedback Foundation's financial
controls as well as oversight on the part of the Orange County Area
Agency on Aging. Toward that end, City Council authorized staff to
contact the Feedback Foundation and the Area Agency on Aging. In
the last two months, the Foundation and the County have been in
touch with staff, and each Agency has made a diligent effort to
provide staff with all the materials requested. The Council
conditioned a previous donation in June of 1990 on several actions
including an independent audit, a management audit, and
recommendations that stipulations from both audits be included in
the next contract. These items have been accomplished to some
extent. For example, the management audit was a review by the
County, and not done by an outside auditor. This could be
justified, however, in considering the County's financial problems.
Research shows that the Feedback Foundation has made a good faith
effort; however, many of their practices would not be classified
"ideal." This is understandable, since this is a non-profit
organization with limited resources.
Feedback Foundation, in partnership with the City of Tustin,
provides a hot lunch program at the Tustin Area Senior Center. The
City provides program and dining space, custodial support, office
space, utilities, and staff supervision at no cost to the Feedback
Foundation. The City also provides $5,355 to the Cohsolidated
Transportation Services Agency for senior transportation. The
Feedback Foundation contracts with the County of Orange to provide
this program with federal funding, through the Older Americans Act.
In 1990, Feedback stated that it had a serious emergency on its
hands in the form of a cash deficit of nearly $200,000, and the
Council granted emergency funds at that time.
In researching this matter, staff has found that in determining its
"fair share" cost of over $21,000, Feedback is charging the City of
Tustin for home -delivered meals. This is an excellent program;
however, the City has no contract with Feedback Foundation to
provide home -delivered meals; the only contract is regarding the
site at the Tustin Area Senior Center. Should it so choose, the
City Council could fund only the congregate site meals and not the
home -delivered meals. Staff certainly understands the dilemma of
having insufficient funding to do all that one needs to do;
however, this is a problem all agencies have. There are
alternatives other than just closing nutrition sites. Feedback has
stated that if the City does not pay the $21,205, then we would
have to look at closing the nutrition site at the Tustin Area
Senior Center; however, no mention was made of cutting back the
home -delivered meals, which is the larger of the expenses.
Staff continues to feel that the "fair share formula" is not fair
at all and that adjustments could be made to reduce Tustin's

donation; however, the County and Feedback have not been receptive
to this idea thus far. The solutions other cities have created are
attached to this staff report.
Staff strongly supports the Feedback Foundation and its mission.
Staff feels that our relationship with Nick Ogden and the other on-
site people is excellent and the program .delivers a much needed
service. Staff does not desire to jeopardize this program in any
way; however, staff is concerned that the $21,205 now will become
a "baseline" for future increases and charges from the County.
