SUBJECT: APPEALS BOARD - WATER RATIONING PROGRAM
RECOMMENDATION:
That the City Council appoint a Water Appeals Board.
DISCUSSION:
Section I (4) of the City's Water Rationing Ordinance provides that the
City Council can appoint a Water Appeals Board. The Board would
consider appeals of staff decisions about applications for relief from
the City's water rationing requirements. The Board's decisions can be
appealed to the City Council.
_ Based upon the initial response to the City's notification to water
customers regarding water allocations, staff expects that appeals will
be filed. Persons with larger meters (due to larger lot sizes)
represent the largest category of persons who feel the City's water
allocation is too low. As pointed out when the rationing program was
created, it was expected that some adjustments would be necessary.
Staff continues to feel the averaging approach to water allocation is
the most practical and fairest to most persons. However, we recognize
that it does create problems for some persons. The appeal procedure is
intended to provide a process for reviewing complaints about an
inadequate water allocation on a case-by-case basis.
Appointment of an Appeals Board would provide one more step in the
process to ensure that all persons are treated as fairly as possible.

It is my request the City Council place on the Agenda for the City
Council meeting of May 6th, discussion and support of your opposition
against Measure J which will be voted upon by the voters of the City of
Tustin and Orange County on May 14th. In light of Governor Wilson's -
proposal of an additional 1.25% increase in sales tax, combined with
the passing of Measure M which recently added .5% to Orange County's
sales tax, it is conceivable that within a few months the taxpayers of
this county could be paying as much as 8.25% sales tax. As a member of
the committee, "Taxpayers Against J", we are seeking your support in
speaking out against this Measure letting your constituents know that
you are also opposed to any new taxes. There are alternatives and
until these viable alternatives have been exhausted, there should be
"NO NEW TAXES".

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TUSTIN OPPOSING
MEASURE "J" ON THE MAY 14, 1991
SPECIAL ELECTION BALLOT
WHEREAS, the May 14, 1991 special election ballot
includes an initiative entitled "Measure J" whereby the voters
of Orange County will decide whether or not sales tax should be
increased by a half -cent to pay for jails and other criminal
justice facilities; and
WHEREAS, revenue estimates as a result of a half -cent
sales tax increase are inconclusive and do not substantiate the
actual cost of building new justice facilities; and
WHEREAS, alternatives to raising taxes for a new jail,
or other criminal justice facilities, have not been adequately
explored; and
WHEREAS, another sales tax increase will put Orange
County at an economic disadvantage.
NOW2 THEREFORE, BE IT RESOLVED that the City of Tustin
opposes Measure "J" as a regressive, premature, and unnecessary
action in addressing public safety needs for the citizens of
Orange County.
