This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the City Council agenda books located in the Police Department and the Tustin Library. These same books are also provided for public use.in the Council Chamber during the Council meeting. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chamber; however, if you desire to smoke, an outside speaker has been provided. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. PROSPECT AVENUE UNDERGROUND DISTRICT NO. 12 On April 1, 1991, the City Council adopted Resolution No. 91-45 which set the time and place for a public hearing to consider the designation and adoption of an underground utility district requiring the removal of poles, overhead wires and associated structures within the area of the City located on Prospect Avenue between First Street and 289 feet north of Beneta Way. Recommendation: Following the public hearing, have first reading by title only and introduction of the following Ordinance No. 1064 as recommended by the Public Works Department/Engineering Division: ORDINANCE NO. 1064 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 12, PROSPECT AVENUE, AND DECLARING ITS INTENTION TO ORDER THE CONVERSION CITY COUNCIL AGENDA PAGE 1 APRIL 15, 1991 2. YORBA STREET DERGROUND DISTRICT NO. 13 On April 1, 1991, the City Council adopted Resolution No. 91-46 which set the time and place for a public hearing to consider the designation and adoption of an underground utility district requiring the removal of poles, overhead wires and associated structures within the area of the City located on Yorba Street between First Street and 683 feet north of First Street. Recommendation: Following the public hearing, have first reading by title only and introduction of the following Ordinance No. 1065 as recommended by the Public Works Department/Engineering Division: ORDINANCE NO. 1065 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT i/ NO. 13, YORBA STREET, AND DECLARING ITS INTENTION TO ORDER THE CONVERSION VI. PUBLIC INPUT - At this time members of the public may address the City Council regarding any items not on the agenda and within the subject matter jurisdiction of the City Council (NO action can be taken on off -agenda items unless authorized by law). CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - APRIL 1, 1991 REGULAR MEETING Recommendation: Approve the City Council Minutes of April 1, 1991. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $841,766.13 and ratify Payroll in the amount of $296,772.09. 3. AWARD OF CONTRACT FOR PARK LIGHTING IMPROVEMENTS AT MAGNOLIA TREE PARK Recommendation: Award contract in the amount of $28,700.00 to Building Energy Consultants for Park Lighting Improvements at Magnolia Tree Park as recommended by the Community Services Department. 4. REJECTION OF CLAIM NO. 91-13 - CLAIMANT, GORDON AND LESLIE ECKERLING; DATE OF LOSS, 1-20-91; DATE FILED WITH CITY, 3-18-91 Recommendation: Reject subject claim for personal injury damages of an undetermined amount as recommended by the City Attorney. RESOLUTION i._. 91-48 - A RESOLUTION OF AE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE MODIFICATION OF TRAFFIC SIGNALS AND INTERCONNECT AT VARIOUS LOCATIONS (PROJECT NO. 800043) AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS Recommendation: Adopt Resolution No. 91-48 approving plans and specifications for subject project and directing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. 6. AUTHORIZATION TO SOLICIT BIDS FOR RE -ROOFING CITY YARD BUILDINGS Authorize the Public Works Department to solicit bids to repair and re -roof the buildings at the City Yard as recommended by the Public Works Department/Field Services Division. 7. AUTHORIZATION TO SOLICIT PROPOSALS TO INITIATE A 11HAZARD COMMUNICATION STANDARD" FOR THE CITY OF TUSTIN Recommendation: Authorize the Director of Public Works to solicit proposals to establish a Hazard Communication Standard for the City as required by CAL/OSHA as recommended by the Public Works Department/Field Services Division. S. RESOLUTION NO. 91-47 - A RESOLUTION CITY OF TUSTIN, CALIFORNIA, APPROVING PROGRAM FOR EMERGENCY SERVICES Recommendation: Adopt Resolution Agreement for Public Works Mutual Services as recommended by the Engineering Division. OF THE CITY COUNCIL OF THE THE PUBLIC WORKS MUTUAL AID No. 91-47 approving the Aid Program for Emergency Public Works Department/ 9. RESOLUTION NO. 91-50 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 14188 Recommendation: Approve Final Tract Map No. 14188 by the adoption of Resolution No. 91-50, as submitted or revised, as recommended by the Community Development Department. 10. EL MODENA-IRVINE CHANNEL FROM LA COLINA-RED HILL CHANNEL TO RED HILL AVENUE Recommendation: Approve the County of Orange project for construction of improvements to the E1 Modena -Irvine Channel between the La Colina -Red Hill Channel and Red Hill Avenue, with said channel improvements designed to convey 100 -year storm flows as recommended by the Public Works Department/ Engineering Division. 11. RESOLUTION NO. 91-52 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR ASPHALT CONCRETE REHABILITATION AND OVERLAY PROJECT, AND WATER MAIN REPLACEMENT ALONG NISSON ROAD BETWEEN NEWPORT AVENUE AND RED HILL AVENUE, AND AUTHORIZING ADVERTISEMENT OF BIDS Recommendation: Adopt Resolution No. 91-52 approving plans and specifications for the Nisson roadway improvements and water main improvements between Newport Avenue and Red Hill Avenue, and authorize the removal and replacement of twelve trees along the southerly side of Nisson Road as recommended by the Public Works Department/Engineering Division. RESOLUTION ' 91-51 - A RESOLUTION OF 'E CITY COUNCIL OF THE CITY OF TUSTs_ _ , CALIFORNIA, APPROVING PLti , AND SPECIFICATIONS FOR THE IMPROVEMENT OF RED HILL AVENUE FROM BARRANCA ROAD TO WARNER AVENUE, AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 91-51 approving plans and specifications and authorizing advertisement for bids for subject project as recommended by the Public Works Department/ Engineering Division. VIII. ORDINANCE FOR INTRODUCTION 1. ORDINANCE NO. 1067 - DISORDERLY CONDUCT ORDINANCE NO. 1067 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 6330 OF PART 3 OF CHAPTER 3 "DISORDERLY CONDUCT" OF TITLE 6 "PUBLIC WELFARE" OF THE MUNICIPAL CODE RELATING TO INDECENT CONDUCT Recommendation: Have first reading by title only and introduction of Ordinance No. 1067. IX. ORDINANCE FOR ADOPTION 1. ORDINANCE NO. 1062 - TRANSPORTATION DEMAND MANAGEMENT REQUIREMENTS FOR SPECIFIED NEW DEVELOPMENT PROJECTS The following Ordinance No. 1062 had first reading by title only and introduction at the April 1, 1991 City Council meeting: ORDINANCE NO. 1062 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY - OF TUSTIN, CALIFORNIA, AMENDING ARTICLE 9 OF THE TUSTIN CITY CODE 1/ BY ADOPTING TRANSPORTATION DEMAND MANAGEMENT REQUIREMENTS FOR V SPECIFIED NEW DEVELOPMENT PROJECTS Recommendation: Have second reading by title only and adoption of Ordinance No. 1062 (roll call vote). X. OLD BUSINESS - None XI. NEW BUSINESS 1. SELECTION OF MAYOR AND MAYOR PRO TEM At the second Council meeting in April of each year, the City Council votes to select those members of the City Council who will serve as Mayor and Mayor Pro Tem. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - APRIL So 1991 All actions of the Planning Commission become final unless appealed by the City Council or member of the public.
