SUBJECT: AWARD OF CONTRACT FOR PARR LIGHTING IMPROVEMENTS AT MAGNOLIA
TREE PARR
RECOMMENDATION:
To award a contract in the amount of $28,700.00 to Building Energy
Consultants for Park Lighting Improvements at Magnolia Tree Park.
BACKGROUND:'
The lighting improvements to be accomplished in this contract are
a result of a lighting study conducted by electrical engineers from
RWR Pascoe and a result of concerns expressed to staff during a
meeting with the Peppertree Homeowners' Association. The work to
be done will replace the lighting fixtures on 17 existing poles,
and will add 10 new lights around the tennis courts.
On January 21, 1991, the City Council approved the Plans and
Specifications and directed the City Clerk to advertise for bids
for the 'proj ect .

John Withers & Sons, Inc. was the lowest bidder, however, this bid
was submitted without a bidder's bond. Initially, the City
Attorney determined that a lack of a bidder's bond would not
constitute grounds for disqualification of the Withers bid.
However, upon closer scrutiny of the circumstances surrounding the
submittal of the Withers bid, the City Attorney determined that a
legal appeal of a decision to award the contract to Withers would
probably be filed. Such an appeal would drastically delay the
project, and the defense against such an appeal would probably
exceed the $4,876.61 saved by using the lower bid.
Staff has conducted a reference check of the second bidder,
Building Energy Consultants. Through this check, it was learned
that this company has successfully completed similar projects for
other cities throughout Orange County. The electrical engineer for
the project has reviewed the bid and has determined that it was
thoroughly prepared, taking into account all elements of the
project. Based on a final review of the bids, the electrical
engineer's review of Building Energy Consultant's proposal and the
contractor's references, Staff recommends that Building Energy
Consultants, Inc. of Nipomo be awarded the contract.
The contract amount of $28,700.00 falls well within the $50,000
budgeted for the project. Following the award of contract, it is
expected that the construction period will be May 15 through July
26, 1991.
