REGUL2, MEETING OF THE TUSTIN CIT.-OUNCIL
APRIL 1, 1991
The City Council meets the first and third Monday of each month at 7:00 p.m.
in the City Council Chamber at 300 Centennial Way.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk's office for clarification. Except as otherwise provided by law,
no action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for public
use in the City Council agenda books located in the Police Department and
the Tustin Library. These same books are also provided for public use in
the Council Chamber during the Council meeting. Listening devices for the
hearing impaired are available upon request from the City Clerk. Smoking is
prohibited in the Council Chamber; however, if you desire to smoke, an
outside speaker has been provided.

V. PUBLIC HEARINGS
1. EXTENSION OF TEMPORARY USE PERMIT 91-01 (THEOPACIFIC
CORPORATION)
The Planning Commission has approved one banner reading "Exit
Jamboree & Come Back" to be displayed for six months; a second
banner with the copy of $29.95 for Two" was allowed for only 60
days. The applicant is appealing and requests that the City
Council consider allowing the price information to be displayed
for the full six months.
Recommendation: Pleasure of the City Council.
2. CONDITIONAL USE PERMIT 90-08, 15642 PASADENA AVENUE
On March 18, 1991, the City Council opened and continued the
public hearing on Conditional Use Permit 90-08.
Recommendation: Pleasure of the City Council.

3. ORDINANCE , 1062 - ADOPTING TRANSPC TION DEMAND MANAGEMENT
REQUIREMEI%_.r FOR SPECIFIED NEW DEVELk,,,AENTS; AND APPROVAL OF
CONGESTION MANAGEMENT PROGRAM COMPONENTS
- With voter approval of Proposition 111, Assembly Bill 1791
automatically became effective. In order to qualify for new gas
tax funds, AB 1791 requires urbanized cities and counties to
prepare, adopt, and implement a Congestion Management Program
(CMP). Further, in order to be eligible for the new funding,
the City must adopt and annually demonstrate an integration and
application of CMP requirements into the land use decision-
making process.
Recommendation by the Congestion Management Team:
a. Have first reading by title only and introduction of the
following Ordinance No. 1062:
ORDINANCE NO. 1062 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AMENDING ARTICLE 9 OF THE TUSTIN
CITY CODE BY ADOPTING TRANSPORTATION DEMAND MANAGEMENT
REQUIREMENTS FOR SPECIFIED NEW DEVELOPMENT PROJECTS
b. Approve the Congestion Management Plan Level of Service
Calculations.
c. Approve the Seven Year Congestion Management Program Capital
Improvement Program.
d. Authorize staff to submit the required Congestion Management
Program components to the Orange County Transportation
Authority.
4. PROPOSED ORDINANCE TO ESTABLISH A WATER CONSERVATION AND
RATIONING PROGRAM
Staff report and proposed ordinance based upon a mandatory 15%
consumer reduction.
Recommendation: Pleasure of the City Council.

VII. CONSENT CALENDAR - All matters listed under Consent Calendar are
considered routine and will be enacted by one motion. There will be
no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request
specific items be discussed and/or removed from the Consent Calendar
for separate action.

1. APPROVAL OF WTES - MARCH 18, 1991 RE AR MEETING
Recommenda_,on: Approve the City Coutx.,.Ll Minutes of March 18,
1991.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $2,833,620.86
and ratify Payroll in the amount of $288,889.21.
3. DECLARATION OF SURPLUS VEHICLES AND WORK EQUIPMENT
Recommendation: Declare specified equipment "surplus" and not
required for public use and authorize the Public Works
Department to dispose of the equipment in accordance with
Ordinance No. 871 as recommended by the Public Works Department/
Field Services Division.
4. APPOINTMENT LIST - COMMISSIONS/COMMITTEES/BOARDS
Recommendation: Approve the Appointment List of Commissions,
Committees and Boards; and direct staff to post the list and
provide copies to the public upon request as recommended by the
Office of the City Clerk.
S. RESOLUTION NO. 91-45 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, SETTING A TIME AND PLACE OF A PUBLIC
HEARING TO CONSIDER THE DESIGNATION AND ADOPTION OF AN UNDERGROUND
UTILITY DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE CITY OF
TUSTIN LOCATED ON PROSPECT AVENUE BETWEEN FIRST STREET AND 289
FEET NORTH OF BENETA WAY, WHICH AREA IS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND ON THAT CERTAIN MAP
ON FILE IN THE OFFICE OF THE CITY CLERK AND CITY ENGINEER OF THE
CITY OF TUSTIN
Recommendation: Adopt Resolution No. 91-45 which sets the time
and place of a public hearing to consider the designation and
adoption of the Prospect Avenue Underground Utility District No.
12 as recommended by the Public Works Department/Engineering
Division.
6. RESOLUTION NO. 91-46 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, SETTING A TIME AND PLACE OF A PUBLIC
HEARING TO CONSIDER THE DESIGNATION AND ADOPTION OF AN UNDERGROUND
UTILITY DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE CITY OF
TUSTIN LOCATED ON YORBA STREET BETWEEN FIRST STREET AND 683 FEET

Recommendation: Adopt Resolution No. 91-46 which sets the time
and place of a public hearing to consider the designation and

as recommended by the Public Works Department/Engineering

Recommendation: Award a contract in the amount of $23,825.39 to
John Withers & Sons for park lighting improvements at Magnolia
Tree Park as recommended by the Community Services Department.
VIII. ORDINANCES FOR INTRODUCTION
1. ORDINANCE NO. 1056 - PROPOSED AMENDMENT TO TUSTIN CITY CODE
SECTION 1140
This amendment is to update the Tustin City Code to be consistent
with the latest amendment to California Code of Civil Procedure
Section 1094.6.
ORDINANCE NO. 1056 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE RELATIVE TO
ADMINISTRATIVE MANDAMUS
Recommendation: Have first reading by title only and
introduction of Ordinance No. 1056.
IX. ORDINANCES FOR ADOPTION - None
X. OLD BUSINESS
1. MAIN STREET OVERHEAD UTILITY CONFLICTS
Decorative street light installations along Main Street between
"C" Street and the Route 55 Freeway were previously authorized by
the City Council. Due to the size and configuration of these
street lights, a conflict resulted between the overhead utilities
and the new street lights.
Recommendation: Authorize the use of surplus decorative street
lighting funds (Project No. 700070) to fund the relocation of
overhead Pacific Bell utilities along Main Street at specified
areas between "C" street and the Route 55 Freeway as recommended
by the Public Works Department/Engineering Division.
2. FEEDBACK FOUNDATION REQUEST FOR FUNDS
The Feedback Foundation has requested $21,205 from the City to
make up a funding short -fall that the Foundation is experiencing.
The Council has authorized a $5,000 partial payment; and Feedback
feels the City should forward the remaining balance of $16,205.
Recommendation: Pleasure of the City Council.
XI. NEW BUSINESS
1. IRVINE BOULEVARD/BRITTANY WOODS ANNEXATION NO. 153
On February 25, 1991, the Irvine Boulevard/Brittany Woods
Annexation No. 153 petition was received by the City. The
proposed annexation is 54 acres in size; and the area includes 191
single-family residences with an estimated 612 residents and 327
registered voters.
Recommendation: Pleasure of the City Council.

2. YOUTH BASXE" I AND SOCCER LEAGUES
At the March 18, 1991 Council meeting, Councilmember Potts
requested an informational report regarding implementation of a
volunteer City -sponsored summer youth basketball and soccer league
program.
Recommendation: Pleasure of the City Council.
XII. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - MARCH 25, 1991
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of
March 25, 1991.
2. ORANGE STREET IMPROVEMENTS
Follow-up to previous status report regarding the concerns raised
by Ms. Alice Acosta and her property on Orange Street.
Recommendation: Receive and file subject report as recommended by
the Public Works Department/Engineering Division.
