BACKGROUND PUBLIC HEARING N0. 1 4-1-91 Inter - Com At a regular Planning Commission meeting on February 25, 1991, the applicant, TheoPacific Corporation, requested an extension of a 30 - day Temporary Use Permit to allow two temporary banners to be displayed for six months at the Key Inn Motel located at 1611 El Camino Real. The Commission allowed one banner reading "Exit Jamboree & Come Back" to be displayed for six months; a second -- banner with the copy of 11$29.95 for Two" was allowed for only 60. days. The applicant is appealing that decision and requests that the City Council consider allowing the price information to be displayed for the full six months. The property is to the east of Red Hill Avenue, on a section of E1 Camino Real which parallels the freeway. The motel occupies two noncontiguous land parcels separated by a commercial use (carpet store). See Attachment A (location map). Section 9270 (c) of the Tustin Zoning Code allows the Director of Community Development to grant temporary use permits to be in effect for time periods up to one month; the Planning Commission has the authority to grant Temporary Use Permits for up to six months, subject to use permit procedures which include a public hearing. Display of the banners for longer than six months requires approval of a Conditional Use Permit. The Commission authorized a waiver of the use permit processing fees should the applicant apply for such a permit. A public hearing notice identifying the time, date and location of the public hearing for the proposal was published in the Tustin News. Property owners within 300 feet of the site were notified of the hearing by mail and notices were posted on the site, at City Hall and the Police Department. The applicant was forwarded a copy of the meeting's agenda and staff report for this item. I__ City Council Report Extension of Temporary Use Permit 91-01 April 1, 1991 Page 2 DISCUSSION The purpose of a temporary banner is to announce a special event, such as a grand opening or clearance sale. Banners are not intended as an advertising device and generally price information 'is not allowed. However, the Planning Commission and City Council have the authority to approve price -related sign copy if it is found necessary or appropriate. The applicant states the time extension and price information copy are necessary due to road work on the nearby I-5 Freeway which includes widening and elevating the road bed and construction of a high retaining wall. The applicant's letter requesting the extension is enclosed as Attachment B. The Commission recognized the hardship incurred during roadway construction by businesses adjacent to the freeway; however, a majority of the members expressed concern about setting a precedent by allowing price -information signage and the aesthetics of displaying such a banner for six months. CONCLUSION After reviewing the information provided by the applicant and making an inspection of the site, Community Development Department staff and Planning. Commission have determined that it would be appropriate to display price -related information. Due to roadway construction, the closure of freeway off -ramps and on -ramps, additional temporary signage is warranted. The Director of Community Development recommends that the City Council provide direction, via Minute Order, regarding the display of the price information banner by: A) Approving the appeal allowing a banner reading 11$29.95 for Two" to be displayed until August 19, 1991, the expiration day of the previously -approved 6 -month extension of Temporary Use Permit 90-01, or D) Denying the appeal. 3P ula R ki A socia e Planner Community Christine A.
