APPROVAl. OF MINUTES - September 21, 1970 meeting. 2. APPROVAL OF DEMANDS in the amount of $76,664.77. 3. REIMBURSEMENT FOR PAVEMENT CONSTRUCTION ON BROWNING AT MITCHELL AVE. - In accordance with agreement with Zink Construction Co., recommended that the Council authorize a 90% payment of $2,798.66 and if no claims or liens are filed that payment of the final 10% in the amount of $310.96 and termination of the agreement be authorized as of October 19, 1970. Moved by Councilman L. Miller, seconded by Councilma~ Marsters that the Consent Calendar be approved. Carried unanimously. VII. ORDINANCES FOR ADOPTION ORDINANCES FOR ADOPTION: 1. ORDINANCES FOR INTRODUCTION ORDINANCES FOR INTRODUCTION 1. ORDINANCE NO. 484 An Ordinance of the City of Tustin, California, AMENDING THE TUSTIN CITY CODE 'RELATIVE TO PERMITS FOR CERTAIN ANIMALS. Ordinance readby title only by consent of the Council. RESOLUTIONS RESOLUTIONS 1. RESOLUTION NO. 70-46 A Resolution of the City Council of the City of Tustin, California, PETITIONING AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO ANNEX CERTAIN TERRITORY TO THE CITY OF TUSTIN. (Red Hill - Lowana Housing Annexation No. 63. ) Moved by Councilman Oster, seconded by Councilman Larry Marsters that further reading be waived and' that Resolution No. 70-46, petitioning and requesting the Board of Supervisors of the County of Orange to annex certain territory to the City of Tustin be adopted. Carried unanimously. OLD BUSINESS OLD BUSINESS 1. AMENDMENT TO THE ZONING ORDINANCE TO ESTABLISH A COMMERCIAL PLANNED DEVELOPMENT DISTRICT. Cont'd from September 21, 1970. An amendment to the Zoning Ordinance, initiated by the Planning Commission on its own motion, to establish a Commercial Planned Development (CPD) District. Proposed district would be applicable to commercial property within the town center area and specify criteria for planned commercial development. Said proposal authorizes consolidated development of property, provides buffers for adjacent residential properties, and authorizes consolidated off-site parking accommodations. Moved by Councilman C. Miller, seconded by Councilman Oster, that the Amendment to the Zoninq Ordinance to establish a Commercial Planned Development District be continued to the October 19, 1970 meeting of the City Council. Carried Unanimously. XI. NEW 1. AWARD OF BID - WIDENING OF BRYAN AVE. FROM CINDY BUSINESS LANE TO APPROXIMATELY 550' WEST OF CINDY LANE Moved by Councilman L. Miller, seconded by Councilman Oster that the bid from R. J. Noble for widening of Bryan Ave. from Cindy Lane to approx. 550' west of Cindy Lane be accepted as recommended by the City Engineer. Carried. 2. AWARD OF BID - CONSTRUCTION OF STREET IMPROVEMENTS ON LAGUNA RD. BETWEEN NEWPORT AVE. AND EL CAMINO REAL; ON NEWPORT AVE. BETWEEN LAGUNA RD. AND BONITA ST. AND ON BROWNING AVE. BETWEEN NISSON RD. AND YOLANDA WAY. Moved by Councilman L. Miller, seconded by Councilman C. Miller that the bid from R. J. Noble for construction of street improvements on Laguna Rd. between Newport Ave. and E1 Camino Real; on Newport Ave. between Laguna Rd. and Bonita St. and on Browning Ave. between Nisson Rd. and Yolanda Way be accepted as recommended by the City Engineer. Carried. 3. APPOINTMENT OF TWO MEMBERS OF THE DEVELOPMENT PREVIEW COMMISSION. Moved by Councilman L. Miller, seconded by Councilman Oster that Mr. William Hockenberry and Mr. Donald Chris~eson be appointed to the Development Preview Commission for two year terms to expire August 31, 1972. Carried. XII. OTHER . VOLUNTEER FIREMEN PAY SCHEDULE iUSINESS Mr. Gill suggested that upon recommendation by the Fire Chief that Council Policy 20-12 be revised by the adoption of Resolution 70-47. This actiQn will establish the pay schedule for volunteer fire personnel of the City of Tustin on an hourly basis and terminate the former "point" system and would be retroactive to July 1, 1970. Moved by Councilman Oster, seconded by Councilman L. Miller that Resolution No. 70-47, adopting Council Policy No. 20-12 to revise the Volunteer Firemen Pay Schedule, be adopted. Carried unanimously. 2. PROMOTION OF INVESTIGATOR RILEY Mr. Gill stated that Police Chief Sissel had recommended the promotion of Investigator Riley to Senior Investigator but with a pay rate increase of five percent rather than ten percent which is provided for in the present personnel rules, Section 5-~ and to make the effective date October 19, 1970. This change could be done by a Minute Order. Moved by Counciman L. Miller, seconded by Councilman Marsters that Investigator Riley be promoted to Senior Investigator with pay rate increase of 5%, effective October 19, 1970, as recommended. Carried. City Council October 5 ]970 Page 5 Mr. Gill stated that the staff as well as the llcalth Department and the Animal Control Shelter had been involved in regard to the complaint submitted by Mr. Reich and that he felt that proper action had been taken and me problem resolved at this point in time. Mayor Coco stated that Mr. and Mrs. Reich had a definite right to ask that these questions be answered, however, felt that it should be done in a private session and that the questions be answered in detail to the satisfaction of Mr. and Mrs. Reich. If, however, they felt that the questions had not been answered to their satisfaction, they were invited to return to the next Council meeting for further discussion.
