SUBJECT: PROSPECT AVENUE UNDERGROUND UTILITY DISTRICT NO. 12
RECOMMENDATION:
That the Tustin City Council at their meeting of April 1, 1991,
pass and adopt the attached resolution which sets the time and
place of a public hearing to consider the designation and adoption
of the Prospect Avenue Underground Utility District No. 12.
BACKGROUND:
The proposed Underground Utility District No. 12 provides for
conversion of all overhead distribution utilities to underground
utilities along Prospect Avenue between First Street and 289 feet
more or less, north of Beneta Way. Preliminary determination by
the utility companies indicates that there will be no property
owner conversion expense.
DISCUSSION:
City of Tustin Ordinance 411 (Tustin City Code, Section 7500)
authorizes the city council from time to time to call public
hearings to ascertain whether the public necessity, health, safety
or welfare requires the removal of poles, overhead wires, etc.
within certain designated areas of the city and to consider the
underground installation of the above-mentioned appurtenances for
supplying electric, communication and other similar services.
Ordinance No. 411 also requires the City to notify all affected
property owners and all concerned utilities by mail of the time and
place of said hearings at least ten (10) days prior to the date of
said hearing to determine whether to form an underground utility
district.
The attached resolution sets the date of the public hearing for
Underground Utility District No. 12 on Monday, April 15, 1991, at
7:00 P.M. in the City Council Chambers, 300 Centennial Way.
It is proposed to fund Underground Utility District No. 12 with
Southern California Edison Company Rule 20A monies, except for the
cost of five (5) additional street lights which are required. The
preliminary cost estimate for the proposed underground work is
$300,000.00 and the Southern California Edison Company has agreed
to advance to the City the necessary Rule 20A funds. The
preliminary cost estimate for the five (5) additional street lights
is $5,000.00 and the City will be required to fund this amount.
The City Engineer's report for said District No. 12 will be
available at least ten days prior to the public hearing date of
April 15, 1991.
It is anticipated that the project would take between 12 and 18
months to complete. We would attempt to accelerate this project as
much as feasible, depending upon the workloads of the affected
utility companies.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
SETTING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER
THE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY
DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE
CITY OF TUSTIN LOCATED ON PROSPECT AVENUE BETWEEN FIRST
STREET AND 289 FEET NORTH OF BENETA WAY, WHICH AREA IS
MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED
HERETO AND ON THAT CERTAIN MAP ON FILE IN THE OFFICE OF
THE CITY CLERK AND CITY ENGINEER OF THE CITY OF TUSTIN.
WHEREAS, Ordinance No. 411 of the City of Tustin authorizes
the City Council from time ,to time to call public hearings to
ascertain whether the public necessity, health, safety or welfare
requires the removal of poles, overhead wires and associated
overhead structures within certain designated areas of the City and
to consider the underground installation of. the aforementioned
appurtenances for supplying electric, communication, or similar
associated services to the residents.of the City of Tustin; and
WHEREAS, by the aforementioned Ordinance No. 411, the City
Clerk is required to notify all affected property owners, if any,
as shown on the last equalized assessment roll and also to notify
all concerned utilities by mail of the time and place of hearings
to determine whether to form an underground utility district and of
the availability of the City Engineer's report of the details of
the district in the office of the City Clerk prior to said hearing;
and
WHEREAS, said notice is required to be given to the afore-
mentioned property owners and concerned utilities at least ten (10)
days prior to the date of the public hearing; and
WHEREAS, the City Engineer has advised that this report is on
file in the office of the City Clerk; and
WHEREAS, the City Council has determined that a public hearing
should be set on April 15, 1.991 at the hour of 7:00 P.M. in the
City Council Chambers at 300 Centennial Way in the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said Council hereby sets Monday, April 15, 1991, at
7:00 P.M. in the City Council Chambers at 300 Centennial Way in the
City of Tustin, California, as the time and place for a public
hearing to ascertain whether the public necessity, health, safety
or welfare requires the removal of poles, overhead wires and
associated overhead structures and the establishment of an
underground utility district within the area of the City of Tustin
generally located on Prospect Avenue between First Street and 289
Feet north of Beneta Way, as shown on that certain map on file in

the office of the City Clerk and the City Engineer of the City of
Tustin.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized to notify all affected property owners, if any, as shown
on the last equalized assessment roll and to also notify all
utilities affected by this proposal by a notice through the United
States Mail of the time and place of said hearing, and of the
availability of the City Engineer's report of the details of the
district in the office of the City Clerk prior to said hearing, ten
(10) days prior to the date thereof.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tustin, California, on the 1st day of April, 1991.

Beginning at the point of intersection of the centerlines of First
Street and Prospect Avenue as shown on a map of Tract No. 4842;
Thence, westerly along said centerline of First Street, a distance
of 40 feet more or less to the point of intersection with a line
parallel with a distant 40.00 feet westerly of, as measured at
right angles to, said centerline of Prospect Avenue;
