SUBJECT: YORBA STREET UNDERGROUND UTILITY DISTRICT NO. 13
RECOMMENDATION:
That the Tustin City Council at their meeting of April 1, 1991,
pass and adopt the attached resolution which sets the time and
place of a public hearing to consider the designation and adoption
of the Yorba Street Underground Utility District No. 13.
BACKGROUND:
The proposed Underground Utility District No. 13 provides for
conversion of all overhead distribution utilities to underground
utilities along Yorba Street between First Street and 683 feet more
or less, north of First Street. It has been determined that there
are no overhead Edison Company facilities that would require
undergrounding. The overhead facilities belong to Pacific Bell
and/or Continental Cablevision. In addition to the overhead
distribution utilities being undergrounded, it will be necessary to
require the undergrounding utility services for the private
properties as follows:

DISCUSSION:
City of Tustin Ordinance 411 (Tustin City Code, Section 7500)
authorizes the city council from time to time to call public
hearings to ascertain whether the public necessity, health, safety
or welfare requires the removal of poles, overhead wires, etc.
within certain designated areas of the city and to consider the
underground installation of the above-mentioned appurtenances for
supplying electric, communication and other similar services.
Ordinance No. 411 also requires the City to notify all affected
property owners and all concerned utilities by mail of the time and
place of said hearings at least ten (10) days prior to the date of
said hearing to determine whether to form an underground utility
district.
The attached resolution sets the date of the public hearing for
Underground Utility District No. 13 on Monday, April 15, 1991, at
7:00 P.M. in the City Council Chambers, 300 Centennial Way.
Pacific Bell and Continental Cablevision will be responsible for
funding the cost of undergrounding their respective facilities.
The undergrounding of the utility services for the affected private
properties will be at the property owners' expense.
A preliminary cost breakdown of this proposed project will be
included within the engineer's report for said District No. 13
which will be available at least ten days prior to the public
hearing date of April 15, 1991.
It is anticipated that the project would take between 12 and 18
months to complete. We would attempt to accelerate this project as
much as feasible, depending upon the workloads of the affected
utility companies.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
SETTING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER
THE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY
DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE
CITY OF TUSTIN LOCATED ON YORBA STREET BETWEEN FIRST
STREET AND 683 FEET NORTH OF FIRST STREET, WHICH AREA IS
MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED
HERETO AND ON THAT CERTAIN MAP ON FILE IN THE OFFICE OF
THE CITY CLERK AND CITY ENGINEER OF THE CITY OF TUSTIN.
WHEREAS, Ordinance No. 411 of the City of Tustin authorizes
the City Council from time to time to call public hearings to
ascertain whether the public necessity, health, safety or welfare
requires the removal of poles, overhead wires and associated
overhead structures within certain designated areas of the City and
to consider the underground installation of the aforementioned
appurtenances for supplying electric, communication, or similar
associated services to the residents of the City of Tustin; and
WHEREAS, by the aforementioned Ordinance No. 411, the City
Clerk is required to notify all affected property owners, if any,
as shown on the last equalized assessment roll and also to notify
all concerned utilities by mail of the time and place of hearings
to determine whether to form an underground utility district and of
the availability of the City Engineer's report of the details of
the district in the office of the City Clerk prior to said hearing;
and
WHEREAS, said notice is required to be given to the afore-
mentioned property owners and concerned utilities at least ten (10 )
days prior to the date of the public hearing; and
WHEREAS, the City Engineer has advised that this report is on
file in the office of the City Clerk; and
WHEREAS, the City Council has determined that a public hearing
should be set on April 15, 1991 at the hour of 7:00 P.M. in the
City Council Chambers at 300 Centennial Way in the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said Council hereby sets Monday, April 15, 1991, at
7:00 P.M. in the City Council Chambers at 300 Centennial Way in the
City of Tustin, California, as the time and place for a public
hearing to ascertain whether the public necessity, health, safety
or welfare requires the removal of poles, overhead wires and
associated overhead structures and the establishment of an
underground utility district within the area of the City of Tustin
generally located on Yorba Street between First Street and 683 Feet
north of First Street, as shown on that certain map on file in the

office of the City Clerk and the City Engineer of the City of
Tustin.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized to notify all affected property owners, if any, as shown
on the last equalized assessment roll and to also notify all
utilities affected by this proposal by a notice through the United
States Mail of the time and place of said hearing, and of the
availability of the City Engineer's report of the details of the
district in the office of the City Clerk prior to said hearing, ten
(10) days prior to the date thereof.
