The Redevelopment Agency at a meeting on March 18, 1991 continued
this matter pending City Council action on CUP 90-08 (see attached
staff report dated March 18, 1991). Staff will be prepared to
provide supporting resolutions on the revised environmental
determination for the Design Review 88-20 and any action or
revisions to Design Review 88-20 requested by the Agency at their
meeting on April 1, 1991.

REQUEST: APPROVAL OF A REVISED BUILDING DESIGN FOR A
PREVIOUSLY APPROVED APARTMENT PROJECT, REDUCING
BUILDING HEIGHT FOR PORTIONS OF THE PROJECT FROM
TWO AND A HALF STORIES AND 29.5 FEET TO A MAXIMUM
OF ONE STORY AND 20 FEET.
RECOMMENDATION
It is recommended that the Community Redevelopment Agency:
1. Adopt Resolution No. RDA 91-5 recertifying the Final
Negative Declaration as adequate for the revision to
Design Review 88-20; and
2. Either: a. In the event that the City Council
approves CUP 90-08 adopt a RDA
Resolution to be provided by the City
Attorney approving the revised
architectural design and site plan for
Design Review 88-20 as submitted- or
revised, or;
b. Continue matter to April 1, 1991 RDA
Meeting pending City Council approval of
CUP 90-08.
BACKGROUND
On March 18, 1991, the City Council will hold a new public hearing
on Conditional Use Permit 90-08. Pursuant to the provisions of the
South/Central Redevelopment Plan, Design Reviews within the project

revised architectural design that might be stipulated by the City
Council's action on Conditional Use Permit 90-08 requires Agency
approval. This action does not require a public hearing.
Additional information and discussion on the architectural design
for the subject project are found in the March 18th City Council
report on CUP 90-08.
CONCLUSION
To ensure that revisions to Design Review 88-20 are consistent with
any modifications required by the City Council on CUP 90-08 it is
recommended that the Redevelopment Agency approve the attached
resolution or continue the matter to their meeting on April 1,
1991.

RESOLUTION NO. RDA 91-5
A RESOLUTION OF THE REDEVELOPMENT AGENCY OF
THE CITY OF TUSTIN, CALIFORNIA, RECERTIFYING
THE FINAL NEGATIVE DECLARATION FOR DESIGN
REVIEW 88-20 AS ADEQUATE FOR A REVISION TO
SAID DESIGN REVIEW, INCLUDING REQUIRED
FINDINGS PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT.
The Redevelopment Agency of the City of Tustin does
hereby resolve as follows:
I. The Redevelopment Agency finds and determines as.
follows:
A. Design Review 88-20 is considered a "project"
pursuant to the terms of the California
Environmental Quality Act.
B. A Negative Declaration has been prepared for
this project and has been distributed for
public review.
C. Whereby, the Redevelopment Agency of the City
of Tustin has considered evidence presented by
the Community Development Director and other
interested parties with respect to the subject
Negative Declaration.
D. The Redevelopment Agency has reviewed and
evaluated the proposed final Negative
Declaration and determined it to be adequate
and complete.
II. A Final Negative Declaration has been completed in
compliance with CEQA and State guidelines. The
Redevelopment Agency, having final approval
authority over Design Review 88-20, has reviewed
and considered the information contained in the
Negative Declaration prior to approving the
proposed project and found it adequately discussed
the environmental effects of the proposed project.
On the basis of the initial study and comments
received during the public review process, the
Redevelopment Agency has found that there is no
substantial evidence that there will be any
significant adverse environmental effects as a
result of the approval of the project because of
the project design and because mitigation measures
identified in the Negative Declaration have been
incorporated into the project which mitigate any
potential significant environmental effects to a

point where clearly no significant effects will
occur. The mitigation measures are identified in
Exhibit A to the attached Negative Declaration and
initial study and are adopted as conditions of
approval of the subject project and all conditions
of Exhibit A of City Council Resolution No. 91-41,
are incorporated herein by reference.
PASSED AND ADOPTED at a regular meeting of the
Redevelopment Agency held on the day of
