WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading City Council June 7, 2016 Meeting Minutes Page 3 of 15 waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL AND TUSTIN HOUSING AUTHORITY HELD ON MAY 17, 2016 Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council and Tustin Housing Authority held on May 17, 2016. 3. RATIFICATION OF DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council confirm and approve Accounts Payable in the Amount of $3,514,895.60 as submitted the following listing of demands issued on behalf of the City in accordance with Government Code Section 37208. Type of Listing: Accounts Payable Total Amount Warrant Runs $ 1,526,114.97 EFTs $ 1,988,780.63 $ 3,514,895.60 Date: May 6, 2016 - May 26, 2016 4. ACCEPTANCE OF SUCCESSOR AGENCY PROPERTIES BY QUITCLAIM DEED TO THE CITY OF TUSTIN City Council approval is requested for the City of Tustin to accept title to two (2) Successor Agency to the Tustin Community Redevelopment Agency ("Successor Agency") properties by Quitclaim Deed. The properties are identified as follows: 1. 345 E. Main Street (APN: 401-592-19): Tustin Library 2. 200 S C Street (APN: 401-574-04): Tustin Senior Center Motion: That the City Council accept the two (2) Quitclaim Deeds and authorize the City Manager to execute the Certificate of Acceptances. 6. OFFICE LEASE EXTENSION FOR 276 CENTENNIAL WAY, SUITE 104 Authorization is requested to execute a five year lease extension through June 30, 2021, for the suite at 275 Centennial Way to provide office space for the Economic Development Division employees and certain operational functions. Motion: That the City Council authorize the City Manager to execute the City Council June 7, 2016 Meeting Minutes Page 4 of 15 attached lease extension for Suite 104 at 275 Centennial Way, consistent with the general terms identified in this Agenda Report. 6. NOVEMBER 8, 2016 GENERAL MUNICIPAL ELECTION Adoption of the proposed resolutions will call the election and consolidate election services with the County of Orange. Motion: That the City Council: 1. Adopt Resolution No. 16-24, calling of the holding of a General Municipal Election to be held on Tuesday, November 8, 2016, for the election of certain officers as required by the provisions of the laws of the State of California relating to general law cities; and 2. Adopt Resolution No. 16-25, requesting the Board of Supervisors of the County of Orange to consolidate a General Municipal Election to be held on November 8, 2016 with the Statewide General Election to be held on the date pursuant to section 10403 of the Elections Code. RESOLUTION NO. 16-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CALLING FOR THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 2016, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES RESOLUTION NO. 16-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO CONSOLIDATE A GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 8, 2016, WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THE DATE PURSUANT TO SECTION 10403 OF THE ELECTIONS CODE 7. POLICE DEPARTMENT VEHICLE PURCHASE Five (5) Police Department service vehicles and one (1) Police Department motorcycle are in need of replacement. The Department has determined the need to purchase four (4) Dodge Durango police packaged vehicles, one (1) Chevrolet quad -cab truck and one (1) Honda police packaged motorcycle. Additionally, there will be a need to award a contract for police equipment conversion work for the newly purchased police units. Motion: That the City Council authorize: City Council June 7, 2016 Meeting Minutes Page 5 of 15 1. The purchase of four (4) 2016 Dodge Durango police packaged vehicles from Tustin Chrysler Jeep Dodge Ram in Tustin, California, in the amount of $112,851.36 2. The purchase of one (1) 2016 Chevrolet Quad -Cab truck from Winner Chevrolet in Elk Grove, California, in the amount of $32,161.51. 3. The purchase of one (1) 2016 Honda police packaged motorcycle from Huntington Beach Honda in Huntington Beach, California, in the amount of $26,918.16 4. The purchase of police equipment conversion packages for the conversion of four (4) Dodge Durangos and one (1) Chevrolet quad -cab truck and one (1) Honda Motorcycle in the amount of $55,706.50 5. The additional change -over costs of Police graphic signs for three (3) of the four (4) 2015 Dodge Durango vehicles, and one (1) Chevrolet quad - cab truck from an additional vendor, in the amount of $1,668.92. 6. The additional change -over costs of an equipment box for the rear of vehicle for three (3) of the four (4) 2016 Dodge Durango vehicles from an additional vendor, in the amount of $12,321.30. 7. The additional change -over costs to build an equipment utility box to replace the bed of the 2016 Chevrolet Quad -Cab truck, and add a custom pull out tray, in the amount of $12,230.71. 8. The Public Works Department to dispose of the retired surplus vehicles at the next available public auction and credit net proceeds to the applicable City Revenue Fund. 8. AWARD CONTRACT FOR THE FISCAL YEAR 2015-16 ROADWAY REHABILITATION AND SIDEWALK REPAIR PROJECT (CIP 70015) Staff is requesting the City Council award a construction contract to the lowest responsive/responsible bidder for the Fiscal Year (FY) 2015-16 Roadway Rehabilitation and Sidewalk Repair Project CIP 70015. Motion: That the City Council award a construction contract to the lowest responsive/responsible bidder, Sequel Contractors, Inc. in the amount of $1,479,346.36, for the FY 2015-16 Roadway Rehabilitation and Citywide Sidewalk Repair Project CIP 70015 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. CONDUCT PUBLIC HEARING TO CONSIDER LEVYING OF ANNUAL ASSESSMENTS FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR FISCAL YEAR 2016-2017 The Tustin Landscape and Lighting District Engineer's Report was completed and approved by the City Council at their May 3, 2016 meeting. At that meeting, the City Council declared its intention to levy annual assessments and set a public hearing for June 7, 2016. In order to levy the annual assessments, the City Council is required to conduct a public hearing and, provided there is no majority protest, adopt Resolution No. 16-34 confirming the annual assessments for Fiscal Year 2016-2017. Public hearing opened at 7:34 p.m. Public hearing closed at 7:34 p.m. with no public comments. It was moved by Councilmember Puckett and seconded by Councilmember Murray to: 1. Conduct a public hearing to receive testimony on the proposed levy of annual assessments for the Tustin Landscape and Lighting District for Fiscal Year 2016-2017; and 2. Adopt Resolution No. 16-34 confirming the annual assessments for Fiscal Year 2016-2017. Motion carried: 5-0 RESOLUTION NO. 16-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA CONFIRMING THE LEVY OF ANNUAL ASSESSMENTS FOR THE LANDSCAPE MAINTENANCE AND PUBLIC STREET LIGHTING EXPENSES IN THE TUSTIN RANCH AREA WITHIN THE BOUNDARIES OF THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR FISCAL YEAR 2016-2017 10. CONDUCT PUBLIC HEARING AND ADOPT BY RESOLUTION NO. 16-33 APPROVING THE 2016 URBAN WATER MANAGEMENT PLAN The California Urban Water Management Planning Act of 1983 requires the City to develop and adopt an Urban Water Management Plan (UWMP) every five (5) years. It requires urban water suppliers providing water for municipal services of more than 3,000 connections or 3,000 acre-feet of water production annually, City Council June 7, 2016 Meeting Minutes Page 7 of 15 to prepare, conduct a public hearing and adopt a plan in accordance with the prescribed requirements of the Act. Public hearing opened at 7:35 p.m. Public hearing closed at 7:35 p.m. with no public comments. It was moved by Councilmember Puckett and seconded by Mayor Pro Tem Bernstein to conduct a public hearing, respond to public comments, and adopt by Resolution No. 16-33 approving the City's 2015 Urban Water Management Plan. Motion carried: 5-0 RESOLUTION NO. 16-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ADOPTING THE CITY OF TUSTIN 2015 URBAN WATER MANAGEMENT PLAN PURSUANT TO CALIFORNIA WATER CODE SECTIONS 10610 THROUGH 10656 REGULAR BUSINESS ITEMS 11-13 11. AUTHORIZATION TO SELL TUSTIN HOUSING AUTHORITY -OWNED AFFORDABLE HOMES AT 14542 NEWPORT AVENUE #3 AND 27 LOOK OUT LANE AT MARKET RATE The Tustin Housing Authority ("Authority") is seeking authorization to sell two (2) Authority -owned affordable homes at 14542 Newport Avenue #3 and 27 Look Out Lane at market rate. It was moved by Councilmember Murray and seconded by Councilmember Gomez that the Tustin Housing Authority Commission: 1) Authorize the sale of the Authority -owned affordable moderate income home at 14542 Newport Avenue #3, located in the Arbor Walk development, and the Authority -owned affordable low income home at 27 Look Out Lane, located in the Tustin Field I development, at market rate prices; and 2) Authorize the Housing Authority Executive Director to negotiate a sales price at the market rate; and 3) Direct the Housing Authority Executive Director to schedule Closed Session Meetings when prospective purchasers are identified in order to receive City Council June 7, 2016 Meeting Minutes Page 8 of 15 Commission approval for each negotiated sale. Motion carried: 5-0 12. WATER CONSERVATION UPDATE — APRIL 2016 As a result of the drought, the City of Tustin is required to provide the State Water Resources Control Board with data that will be used to determine if the City is meeting the required 21% conservation target and the various methods being utilized to ensure compliance with the State's mandates. This report summarizes the information provided to the State for the month of April 2016 and provides the City Council and the public with general information on previous and upcoming actions taken by the City. That City Council unanimously approved to receive and file this report. 13. LEGISLATIVE REPORT City Manager Jeffrey C. Parker provided an update regarding current legislation of interest. OTHER BUSINESS/COMMITTEE REPORTS CITY MANAGER JEFFREY C. PARKER Welcomed Carrie Woodward to the City Clerk's Office, who was recently promoted to a Management Analyst from the Parks & Recreation Department COUNCILMEMBER PUCKETT Attended five Transportation Corridor Agency Committee meetings in recent weeks May 19 Attended the Frontier Park Grand Re -Opening event; thanked Director of Parks & Recreation Dave Wilson May 21 • Attended the Tustin Relay for Life at Beckman High School and participated in the "Walk with Doc"; thanked Councilmember Bernstein for all he did in raising money to support cancer research • Attended the Tustin/Santa Ana Rotary Club 7h Annual Lobsterfest May 23 Attended the Hope International University 10th Annual Golf Tournament Fundraiser; City Council June 7, 2016 Meeting Minutes Page 9 of 15 announced that the event set a new record and raised $55,000 and thanked all those who pledged donations May 26 Attended the Goodwill of Orange County's Tierney Center for Veteran Services Dedication Ceremony May 30 Attended the Memorial Day Celebration at Santa Ana Cemetery; it was a good event and Mayor Nielsen and Mayor Pro Tem Bernstein provided great remarks June 3 Participated in the Orchard Hills Exit Interviews June 5 Attended the 32nd Annual Street Fair and Chili Cook -Off; thanked the Parks & Recreation staff and volunteers who always make the event a tremendous success COUNCILMEMBER GOMEZ May 13 Attended the Orange County Senior Citizens Advisory Council meeting in Mission Viejo; a member of the Mission Viejo Police Department discussed recent scams aimed at senior citizens and methods for reporting crimes online Announced that June 15th is World Elder Abuse Awareness Day; additional resources and information regarding education and advocacy for seniors is available at the Office on Aging website May 17 Attended a Women in Leadership Luncheon; the keynote speaker was former State Superintendent of Schools Delaine Eastin May 19 Attended the Frontier Park Grand Re -Opening event; mentioned that the splash pad is a welcome addition to the neighborhood May 21 Attended the Tustin Relay for Life at Beckman High School; thanked everyone who organized, participated, and raised money for a great cause June 1 • Attended the Tustin High School Scholarship Breakfast; honored to present the "Jonathan Dizon Memorial Scholarship" to a deserving senior baseball player • Attended the "Currie Street Fair", where students from Currie Middle School's Entrepreneurship Class taught by Zachariah Samarin, put their business skills to work City Council June 7, 2016 Meeting Minutes Page 10 of 15 and learned how to design a product and manage inventory, establish profit margins, and market their services • Attended the Citizen Academy Graduation Ceremony; thanked all the participants for their commitment to the community and the city staff involved • Attended the American Association of University Women (AAUW) Installation Dinner; the Name -Gift Honorees were Jack Paris and long-time Tustin teacher Jean Paris June 2 Participated in the Hillview High School Exit Interviews; mentioned that hearing about the obstacles students have overcome, who have taken advantage of a second chance and are on their way to graduation, was an incredible and overwhelming experience June 3 Attended the retirement ceremony for Beckman High School Principal Adele Heuer Mentioned that she received many positive comments from the community about the Chili Cook -Off and the organization and safety of the event; thanked the volunteers and staff involved in making the day a success Congratulated all Tustin Unified students who are promoting and graduating in the next couple weeks Congratulated Carrie Woodward on her promotion to the City Clerk's Office COUNCILMEMBER MURRAY May 18 Attended the Association of California Cities Board of Directors meeting May 19 Attended the Orange County Transportation Authority Legislative and Communications Committee meeting May 21 Attended the Tustin Relay for Life at Beckman High School; it was a great event May 23 Attended the Orange County Transportation Authority Board of Directors meeting; discussed the Interstate 405 Improvement and Expansion Project Financing Plan; the project will move forward after careful deliberation and analysis and will hopefully improve the busiest stretch of highway in the United States May 23 — May 25 Visited Washington D.C. with the Orange County Business Council to meet with various congressional members to discuss transportation, housing development, water, and infrastructure issues City Council June 7, 2016 Meeting Minutes Page 11 of 15 May 26 Attended the Orange County Fire Authority Board of Directors meeting and Executive Committee meeting Thanked City Manager Jeffery Parker for his ongoing involvement and efforts with the Orange County Task Force on homelessness, looking at options to address the issue in the County May 27 Attended the Association of California Cities Orange County Legislative and Regulatory Committee meeting May 30 Attended the Tri -City Memorial Day event; mentioned that his colleagues presented very well and it was a nice ceremony June 1 Attended the Citizen Academy Graduation Ceremony; staff did a great job June 2 Attended the memorial services for former Laguna Niguel Mayor and Councilmember and Orange County Fire Authority Board Member Jerry McCloskey; he will be missed greatly June 3 Attended the retirement ceremony for Beckman High School Principal Adele Heuer; Adele will be missed greatly, she has been in the public school system for 40 years and has done a lot for the community Announced that he is very proud of his daughter who is graduating from Beckman High School and received a special scholarship June 6 Attended the Orange County Transportation Authority Executive Board meeting Thanked Chili Cook -Off Committee Co -Chairs Marilyn Buescher and Donna Peery for a phenomenal job on the event, thanked the Parks & Recreation Department, Public Works, Finance Department, volunteers and Sergeant Ryan Coe MAYOR PRO TEM BERNSTEIN May 19 Attended the Orange County Mosquito and Vector Control District Board of Trustees meeting; community members were present to discuss aerial spraying of adulticides and the Board approved a modification to the budget and added one million dollars for a more robust outreach and educational program City Council June 7, 2016 Meeting Minutes Page 12 of 15 May 20 Attended the Orange County Water Summit; discussed all topics concerning water including the Bay Delta Project, the Groundwater Replenishment System in Orange County, and conservation issues; thanked Jeff Thomas for a wonderful seminar May 21 • Attended the Tustin Relay for Life at Beckman High School and participated in the "Walk with Doc"; mentioned that the funds raised set a record and surpassed those from last year and thanked everyone involved in making the event wonderful, particularly Erica Rabe, Christine Zepeda, Derick Yasuda, and Janine Hernandez • Attended the Tustin/Santa Ana Rotary Club 7th Annual Lobsterfest; mentioned that the event was great and thanked Professor and Mrs. Perkins for the invitation May 26 Attended the Goodwill of Orange County's Tierney Center for Veteran Services Dedication Ceremony; looking forward to working together and serving the veteran population May 27 Attended the Tustin Elementary School Memorial Day Assembly; had the privilege of speaking with Fred Whitaker, Sr. who was one of the liberators of the Buchenwald concentration camp May 30 Had the privilege of speaking at the Tri -City Memorial Day event at the Santa Ana Cemetery; thanked all veterans for their courage and sacrifices and mentioned that Tustin is doing everything possible to ensure there are no homeless veterans June 1 Attended the Citizen Academy Graduation Ceremony; congratulated all the graduates and thanked staff for a wonderful educational experience June 3 • Attended the Water Advisory Committee of Orange County meeting; the drought and the Bay Delta Project were key topics discussed, and Curt Schmutte of the Metropolitan Water District of Southern California provided a great presentation titled "Evolving Delta: Science to Reduce Conflict' • Participated in the Orchard Hills Exit Interviews; commented that it is amazing to see the maturity and growth of 8th graders and hear about their perspectives of the world June 5 Attended the 32nd Annual Street Fair and Chili Cook -Off; mentioned that it was a wonderful day and congratulated the Parks & Recreation staff and volunteers for a successful event Congratulated Carrie Woodward on her promotion and welcomed her to the City Clerk's Office Congratulated all graduates who are in middle school, high school, college, and graduate City Council June 7, 2016 Meeting Minutes Page 13 of 15 school Announced that the annual State of the City is coming up on Thursday, June gth and the Tustin Man and Woman of the Year event is on Friday, June 10th Mentioned that the City is doing an amazing job of conserving water and the staff involved in the Public Works Department are top-notch and doing a great job MAYOR NIELSEN May 19 Attended the Frontier Park Grand Re -Opening event; mentioned that the park features a frisbee golf course and recommended that the City Council host a tournament for charity May 21 Attended the Tustin Relay for Life at Beckman High School and participated in the "Walk with Doc"; thanked Councilmember Bernstein and staff for their efforts in raising money to support cancer research May 25 • Attended the Orange County Sanitation District Steering Committee meeting; discussed the Proposed Energy Strategy regarding treatment plants being 100% self-sufficient for energy and power and recycling an additional 30 million gallons of water per day • Attended the Orange County Sanitation District Board of Directors meeting: o Considered nominations for Chair and Vice Chair and unanimously re-elected John as Chair for the remainder of his term and elected Greg Sebourn from the City of Fullerton as Vice Chair o Approved contracts for odor -reducing chemicals used in the process of treating waste o Approved insurance renewals and discussed the upcoming transfer of Sewer Area 7 to East Orange County Water District May 26 • Attended the Orange County Council of Governments meeting;
