ORANGE STREET IMPROVEMENTS -- STATUS REPORT
RECOMMENDATION:

BACKGROUND:
On March 4, 1991 at the City Council meeting, Ms. Alice Acosta
raised a concern that the proposed improvements along Orange Street
and the alley adjacent to her residence on Orange Street (A.P.
#500-152-13) appeared to be encroaching on her property.
DISCUSSION:
Staff has reviewed Ms. Acosta's concern and has determined the
following:
1. Ms. Acosta's property dimensions are 71.67 ft.
wide along Orange Street, and 50.00 ft. deep
along the alley. These dimensions were
determined by the grant deed for the property
recorded on December 10, 1965.
2. The dimension between the back westerly
property line fence and the fence located
along the Orange Street frontage of the
property was measured at 55 ft., resulting in
a five foot encroachment of the fence into
public street right-of-way.
3. The dimension between the fence on the
southerly property line and the fence along
the northerly side of the property line was 75
ft., resulting in a 3.67 foot encroachment of
the fence into the public alley right-of-way.
4. The fence installation as it exists today
encroaches with the public rights-of-way.
The Orange Street project proposes to relocate those portions of
the fence that encroach into the public rights-of-way at no cost to
Ms. Acosta. Additionally, with the elevation of the new curb and
gutter and the sidewalk, it will be necessary to install two area
drains in the front yard of Ms. Acosta' s property so as not to pond
water. This work will be done at no cost to the property owner.
Attached is a sketch of the Acosta property delineating the
improvements to be completed.
_ As of this date, staff has been unable to contact Ms. Acosta to
explain our findings to her. We will continue to try and contact
her prior to the City Council meeting of March 18, 1991, and will
Iprovide a verbal update at that time.
