PROJECT (CIP 70233)
SUMMARY
Authorization is requested to enter into a Consultant Services Agreement (CSA) with Michael Baker
International for design and environmental services for the Park Avenue Improvement Project (CIP
70233).
RECOMMENDATION
It is recommended that the City Council:
1. Authorize staff to enter into a Consultant Services Agreement with Michael Baker International
for design and environmental services in an amount not to exceed $280,000 to cover
professional services in the amount of $241,920 and a 15% design contingency.
FISCAL IMPACT
Sufficient funds have been budgeted in the Fiscal Year 2016/17 Capital Improvement Program for the
design phase of this project in the amount of $350,000 (Community Facilities District 07-1, Fund 437).
CORRELATION TO THE STRATEGIC PLAN
The completion of this project contributes to the fulfillment of the City's Strategic Plan Goal B: Public
Safety and Protection of Assets and contributes to the fulfillment of the City's Strategic Plan Goal A:
Economic and Neighborhood Development, specifically the project implementation of Strategy 1, which
among other items, is to continue development of critical phases of Tustin Legacy.
BACKGROUND AND DISCUSSION
Staff has initiated a number of requests to Vestar, the developer of the District, to identify and install
significant enhancements to the traffic circulation system in The District to address the many concerns
voiced by the public since The District was first opened. No improvements have been scheduled to be
constructed. A preliminary review has identified the widening of Park Avenue and the addition of one
lane along its' southern edge between District Drive and Warner Avenue as a viable solution to relieve
congestion along that roadway. The right-of-way for future work currently exists.
The project is located on Park Avenue between Tustin Ranch Road and Warner Avenue in the area
known as "Tustin Legacy" (see Attachment 1). The proposed improvements within the existing
landscape setback area are intended to provide an additional travel lane in the eastbound direction for
better flow of traffic between District Drive and Warner Avenue. Intersection treatments are also

proposed just east of Tustin Ranch Road and just west of District Drive. As previously mentioned, no
additional right-of-way acquisition is required for the project.
Proposals to perform design and environmental services were solicited from four (4) firms and three (3)
proposals were received. Following the qualifications based selection process involving three members
of the Public Works Department, two members of the Community Development Department, and one
member of the Economic Development Department, it was determined that Michael Baker International
and their team of sub -consultants are the most qualified to provide the design and environmental
services for this project. The negotiated fee for this work has been deemed fair and reasonable.
Staff is recommending the City Council authorize staff to enter into a Consultant Services Agreement with
Michael Baker International for design and environmental services for this project in the amount of
$241,920 and a fifteen percent (15%) design contingency.

SAMPLE CONSULTANT SERVICES AGREEMENT
CONSULTANT SERVICES AGREEMENT
THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into
this _ day of 20_, by and between the CITY OF TUSTIN, a municipal
corporation, hereafter referred to as "City", and ,MICHAEL BAKER INTERNATIONAL, a
Pennsylvania Corporation, hereinafter referred to as "Consultant".
RECITALS
WHEREAS, City requires the services of a consultant to furnish the necessary
design and environmental services for the Park Avenue Improvement Project (CIP
70233) hereinafter referred to as "Project"; and
WHEREAS, City has prepared a Request for Proposal (RFP) dated May 10, 2016,
a copy of which is attached hereto, marked as Exhibit "A" and is by this reference
incorporated into this Agreement; and
WHEREAS, in response to City's RFP, Consultant has submitted to City a
proposal dated June 14, 2016, a copy of which is attached hereto marked as Exhibit "B"
and is by this reference incorporated into this Agreement; and
WHEREAS, Consultant is qualified to provide the necessary services for the
Project and desires to provide said services to City; and
WHEREAS, City desires to retain the services of Consultant for said Project.
NOW, THEREFORE, for the consideration and upon the terms and conditions
hereinafter set forth, the parties agree as follows:
AGREEMENT
Section 1: Scope of Consultant's Services
Consultant shall perform all work necessary to complete in a manner satisfactory
to City, the services set forth in Exhibit "A" and Exhibit "B" in accordance with the terms
and conditions of this Agreement.
Section 2: Order of Precedence
In the event of a conflict between or among any of the documents comprising this
Agreement, the following order of precedence shall govern the provision in question:
1. This Agreement
2. City's Request for Proposal (Exhibit "A")
3. Consultant's Proposal (Exhibit "B")
Section 3: Time for Completion
The time for completion of the work to be performed by Consultant is an essential
condition of this Agreement. Consultant shall prosecute regularly and diligently the work
of this Agreement according to reasonable schedules established by the City for various
items described and as outlined within Consultant's proposal. Consultant shall not be
accountable for delays in the progress of its work caused by any condition beyond its
control and without the fault or negligence of Consultant.
Section 4: Compensation
A. The compensation to be paid under this Agreement shall be as set forth in Exhibit
"B", which shall not exceed a total cost of $241,920.
B. Consultant shall submit detailed invoices, based upon the actual work performed
accompanied by backup documentation as requested by the City.
C. Progress payments for work completed shall be paid by City as the work
progresses, within thirty (30) days of the date of Consultant's invoice.
D. Consultant shall provide City with a monthly itemization of all work performed, and
the fees accrued thereon, in complete and sufficient detail to fully apprise City
thereof.
Section 5: Independent Contractor
Consultant's relationship to City in the performance of this Agreement is that of an
independent contractor. Consultant's personnel performing services under this
Agreement shall at all times be under Consultant's exclusive direction and control and
shall be employees of Consultant and not employees of City. Consultant shall pay all
wages, salaries and other amounts due its employees in connection with this Agreement
and shall be responsible for all reports and obligations respecting them, such as social

security, income tax withholding, unemployment compensation, worker's compensation
and similar matters.
Section 6: Indemnification
Consultant agrees to indemnify, defend and hold City, its officers, agents,
employees, successors and assigns harmless from any loss, damage, injury, sickness,
death, or other claim made by any person and from all costs, expenses and charges
including attorney's fees caused by or arising out of Consultant's, its officers', agents',
subcontractors', or employees' negligent acts, negligent errors, or negligent omissions or
willful misconduct, or conduct for which the law imposes strict liability on Consultant in the
performance or failure to perform this Agreement.
Section 7: Insurance
A. Consultant shall maintain in full force and effect during the term of this Agreement
policies of commercial general liability and automobile liability insurance (each of
which shall include property damage and bodily injury) and each with limits of at
least $1,000,000 combined single limit coverage per occurrence.
B. Consultant shall maintain in full force and effect during the term of this Agreement
a policy of professional liability insurance coverage with limits of at least
$1,000,000 combined single limit coverage per claim or per occurrence. If
Consultant provides claims made professional liability insurance, Consultant shall
also agree in writing either (1) to purchase tail insurance in the amount required by
this Agreement or to cover claims made within five (5) years of the completion of
Consultant's service under this Agreement, or (2) to maintain professional liability
insurance coverage with the same carrier, or with an equivalent carrier in the
amount required by this Agreement for at least five (5) years after completion of
Consultant's services under this Agreement. Consultant shall also provide
evidence to the City of the purchase of the required tail insurance or continuation
of the professional liability policy by executing the attached Letter Agreement on
Consultant's letterhead.
C. Consultant shall carry and pay for such workers' compensation insurance as is
required to fully protect Consultant and its employees under California Worker's
Compensation Insurance Law. The insurance company shall agree to waive all
rights of subrogation against the City for losses paid under the policy, which losses
arose from the work performed by the named insured.
D. Other applicable insurance requirements are: (1) Name the City, its officials and
employees as additional insured on the commercial general liability and
automobile liability insurance policies. (2) The insurance shall be issued by a
company authorized by the Insurance Department of the State of California and

rated A, VII (seven) or better (if an admitted carrier) or A-, X (ten) or better (if
offered by a surplus line broker), by the latest edition of Best's Key Rating Guide,
except that the City will accept workers' compensation insurance rated B-, VII
(seven) or better, or from the State Compensation fund. (3) The insurance shall
not be cancelled, except after thirty (30) days written prior notice to the City; and
(4) The commercial general liability and automobile liability insurance shall each
be primary as respects the City, and any other insurance maintained by the City
shall be in excess of this insurance and not contribute to it.
E. Upon execution of this Agreement, Consultant shall provide to City certificates of
insurance and insurer endorsements evidencing the required insurance. Insurer
endorsements (or a copy of the policy binder if applicable) shall be provided as
evidence of meeting the requirements of Subsections (1)(3) and (4) of Section 7D
above and the waiver of subrogation requirement in Section 7C above. If self-
insured for worker's compensation, Consultant shall submit to City a copy of its
certification of self-insurance issued by the Department of Industrial Relations.
Section 8: Termination of Agreement
A. City and Consultant shall each have the right to terminate any or all of the services
covered by this Agreement at any time or any reason by giving ten (10) business
days written advance notice to the other party.
B. Upon termination of this Agreement, Consultant shall be paid for services
rendered by the effective date of the termination.
C. Upon termination of this Agreement or completion of the Project, all documents
relating to the Project shall become the sole property of City. Should City
terminate this Agreement pursuant to subparagraph A. of this Section, Consultant
shall within ten (10) business days of receipt of notice of termination, provide City
with all documents within Consultant's possession relating to this Agreement and
the Project, including but not limited to all completed documents and all drafts of
uncompleted documents.
Section 9: Notice
Any notice allowed or required to be given shall be effective upon personal
delivery thereof, or upon depositing thereof in the United States Postal Service, certified
mail, upon receipt requested, postage prepaid, addressed as follows:

Section 10: Miscellaneous Provisions
A. Consultant shall proceed immediately and diligently to perform the services
provided for in this Agreement upon receipt of notice from City to proceed
therewith.
B. No part of this Agreement may be assigned by Consultant without the prior written
approval of City.
C. This Agreement shall extend to and be binding upon and inure to the benefit of
heirs, executors, administrators, successors and assigns of the respective parties
hereto.
D. Consultant shall perform all services required under this Agreement using that
degree of care and skill ordinarily exercised under similar conditions in similar
localities, and shall be responsible for all errors and omissions for services
performed by Consultant under the terms of this Agreement.
E. Consultant certifies that there shall be no discrimination against any employee
who is employed in the work covered by this Agreement, or against any
application for such employment, because of race, religion, color, sex, or national
origin including but not limited to, the following: employment, upgrading, demotion
or transfer, recruitment, or recruitment advertising, lay-off or termination, rate of
pay or other forms of compensation, and selection for training, including
apprenticeship.
F. This Agreement shall be interpreted in accordance with California Law. The
parties agree that the Orange County Superior Court is the exclusive venue for
any lawsuits by either party regarding this Agreement.

PROJECT DESCRIPTION
The project is located on Park Avenue between Tustin Ranch Road and Warner Avenue in the
area known as "Tustin Legacy." The proposed improvements within the existing landscape
setback area are intended to provide an additional travel lane in the eastbound direction for
better flow of traffic between District Drive and Warner Avenue. Intersection treatments are
also proposed just east of Tustin Ranch Road and just west of District Drive. No additional right-
of-way acquisition is required for the project.
Improvements on Park Avenue include but not limited to the following:
• Widening the existing southerly curb of the roadway and modifying the landscape
setback including the removal of trees to provide the additional eastbound travel lane
between District Drive and Warner Avenue
• An 8 -foot to 14 -foot wide landscaped median shall be included or retained
• Installation of the necessary electrical circuits to provide power for relocated street
lights, street furniture, and lighting
• Modifying the existing traffic signal located at the intersection of Park Avenue and
District Drive (private street), if necessary
• Modifying the existing traffic signal and lane geometry located at the Park Avenue
intersection with Tustin Ranch Road by providing dual westbound left -turn lanes
• Modifying the existing traffic signal and lane geometry located at the Park Avenue
intersection with Warner Avenue, if necessary
Attachment 1 to this RFP includes graphic exhibits of conceptual street plans and other
design elements including the existing right-of-way and the landscape setback limits.

Ill. SCOPE OF WORK
The proposed Scope of Work, at a minimum, should include and address each of the tasks
which follow in sufficient detail to fully understand the proposed products and deliverables,
timelines for delivering progress plans, coordination meetings, and relationship of the
Consultant -In -Charge to others on the Consultant's team. Although the City is attempting to
identify the limits and services required, this should not unnecessarily limit the consultant in the
development of a scope it believes is necessary to meet the City's goals and objectives:
1. DESIGN SURVEY AND BASE MAPPING
A detailed topographic survey and map, plotted at a scale of 1" = 20'
supplemented with field inventories and verification shall be prepared and used by
the Consultant in the preparation of the improvement plans. All existing surface
features must be depicted clearly on these plans. A thorough investigation of
existing underground utilities shall be performed, including research of record
drawings on file at the City and all applicable utility companies and field
reconnaissance, including pot -holing as necessary. All existing utilities shall be
accurately depicted both horizontally and vertically on the improvement plans and
profiles.
This survey work shall also include the filing of corner records for the tie -out of existing
monuments with the Orange County Surveyor prior to and after construction.
2. GEOTECHNICAL
A complete geotechnical investigation shall be performed to evaluate the surface
and subsurface conditions along the project alignment. The report shall include, but
not be limited to the following: existing pavement conditions with in-place strength
test results, field core samplings with laboratory data and R -values,
recommendations for pavement design, recommendations for type and strength of
concrete to be used for structures, any special trenching requirements, and any
other recommendations for the construction of the project.
3. IMPROVEMENT PLANS
Complete street improvement plans and profiles, landscape/irrigation plans, traffic
signing and striping plans, electrical plans, and precise grading plan (landscaped
area modifications) shall be prepared in ink on standard 24" x 36" mylar (4 mill at a
scale of 1" = 20'. The plans shall include, but not be limited to the following:

identification of topographic features, existing underground utilities, curb and gutter,
sidewalks, asphalt concrete pavement, street lights and conduit, traffic signing and
striping, traffic signals, conduits and detector loops, traffic control, and all proposed
improvements clearly identified and dimensioned. The plans shall also include full
construction details, as required, including, but not limited to, details and
specifications for storm water treatment BMP's, and light poles/fixtures.
The Consultant is responsible for evaluating access ramps and driveway
approaches for compliance with the latest federal standards and, where
applicable, access ramps and driveway approaches shall be redesigned to meet
the current federal standards.
4. SPECIFICATIONS
The City of Tustin has adopted the Standard Specifications for Public Works
Construction ("Green Book" latest edition) for highway construction, and the State
of California Standard Specifications and Plans (latest edition) for traffic signal,
signing and striping construction. The Consultant shall prepare detailed project
technical specifications for bidding and construction purposes in accordance with
the standard City format and with the City's standard boiler -plate detailed
specifications where applicable. The Consultant is responsible for Detailed
Technical Specifications and the Bid Items Listing (to be included in Section C). The
City will prepare Sections A through D, excluding the Bid Items Listing, and Section E,
Part 1.
5. ESTIMATES
The Consultant shall calculate quantities and prepare preliminary and final itemized
cost estimates for the various bid items. The City requires unit breakdown of
construction items. Lump sum items will require City approval, and requires sufficient
back-up information to justify the estimated cost. The final estimate is to be
submitted with the final construction plans and specifications.
6. UTILITY COORDINATION
The Consultant shall provide full coordination with all affected utilities. This includes,
but is not limited to, distributing an initial notice with map of project area requesting
facility locations and a second notice with preliminary plans at the approximate 90%
completion stage. A utility log shall be maintained to track all correspondence,
responses, requests, and potential conflicts. It is the Consultant's responsibility to
ensure that a written response is received from all utility companies. Follow-up

correspondence will be required with utilities that need to be relocated or adjusted
prior to or during construction.
7. WATER QUALITY MANAGEMENT PLAN (WQMP)
The Consultant shall prepare a project specific Priority Water Quality Management
Plan (WQMP), utilizing the Santa Ana Region Model WQMP, the Technical Guidance
Document, and the Public Agency WQMP Template.
8. ENVIRONMENTAL
California Environmental Quality Act (CEQA):
The Consultant shall research and provide the determination as to whether or not
this project is categorically exempt from the provisions of CEQA or if a Negative
Declaration (ND) is required. Consultant shall include fees in the proposal for each
type of document that may be required. If a ND is required, Consultant shall
prepare the Environmental Initial Study and environmental review of the preliminary
plans and report. This work shall include preparation of complete environmental
documentation in accordance with CITY's procedures and pursuant to CEQA
requirements. It must address all relevant environmental impact issues that have
been specified in the Initial Study. Coordinate with City staff as necessary.
IV. PROPOSAL REQUIREMENTS
Although the City requires no specific format, this section is intended to provide guidelines to
the consultant regarding features that the City will look for and expect to be included in the
proposal.
1. CONTENT & FORMAT
The City requests that proposals submitted be organized and presented in a neat
and logical format and are relevant to these services. Consultant's proposals shall
be clear, accurate, and comprehensive. Excessive or irrelevant material will not be
favorably received.
Proposals shall contain no more than ten (10) typed pages using a 10 point minimum
font size, including transmittal/offer letter and resumes of key people, but excluding
Index/Table of Contents, tables, charts, and graphic exhibits. The purpose of these
restrictions is to minimize the costs of proposal preparation and to ensure that the
response to the RFP is fully relevant to the project.

The proposal should include the following:
• Transmittal/offer letter
• Page numbering
• Index/Table of Contents
• Approach
• Team Organization including an organization diagram and time commitment
of key staff
• Statement of Qualifications including descriptions of similar projects by key
staff to be assigned during the term of the contract
• Brief resumes of key staff
• Schedule of Hourly Rates and fees in a separate sealed envelope
2. APPROACH
A description of the firm's approach and work program to meet the city's objectives
shall be included. It should explain the technical approach, methodology, and
specific tasks and activities that will be performed to address the specific issues and
work items.
3. TEAM ORGANIZATION
The purpose of this section is to describe the organization of the project team
including subconsultants and key staff. A project manager and an alternaterp oject
manager shall be named who shall be the prime contact and be responsible for
coordinating all activities with the City. An organization diagram shall be submitted
showing all key team members and illustrating the relationship between the City, the
project manager, key staff, and subconsultants. There also should be a brief
description of the role and responsibilities of all key staff and subconsultants
identified in the team organization.
4. STATEMENT OF QUALIFICATIONS
The information provided in this section should describe the qualifications of the firm
and key staff in performing projects within the past five years that are similar in
scope and size to demonstrate competence to perform these services. The projects
listed should be those that the key staff members named for this project were
responsible for performing. Information shall include:
• Names of key staff that participated on named projects and their specific
responsibilities
• The client's name, contact person, addresses, and telephone numbers
• A brief description of type and extent of services provided

• Completion dates (estimated, if not yet completed)
• Total costs of the projects
There should be included in the section brief resumes of key personnel who will
provide these services demonstrating their qualifications and experience. Resumes
should highlight education, relevant experience, licenses, and specific
responsibilities for services described.
5. FEE PROPOSAL
Compensation for services provided shall be based upon the consultant's detailed
fee proposal to furnish the services detailed in their proposal.
A Fee Proposal shall be submitted in a separate, sealed envelope and marked as
"Fee Proposal" along with the name of the project.
A work program together with a breakdown of labor hours by employee billing
classification together with the cost of non -labor and subconsultant services shall be
included with the fee proposal. The labor breakdown shall be compiled based
upon a listing of work tasks that correlates with the consultant's defined scope of
work for the project proposal. This information will be used by the City staff to
evaluate the reasonableness of the fee proposal and may be used in negotiating
the final fee amounts for the contract agreement.
The fee proposal of the three top ranked consultants will be opened at the
conclusion of the consultant evaluation and selection process. Fees will not be used
to determine the ranking of the consultants. The Fee Proposals of those consultants
not ranked in the top three will be returned to them unopened upon award of
contract to the selected consultant.
The City will negotiate the final fee with the top ranked consultant.
Reimbursable expenses shall not be allowed unless negotiated prior to a contract.
Price escalations during the contract term are disfavored and will not be allowed
unless negotiated prior to execution of contract.
Although no public meetings are anticipated, the fee proposal shall include a unit
cost for a public meeting (e.g., $/public meeting) in the event a meeting or
meetings will be required.
The consultant shall prepare progress billings, reflective of the project schedule and
the scope of work completed, by line item and description.

STATEMENT OF OFFER & SIGNATURE
The Proposal shall contain a statement that the proposals are a firm offer for a 90 -
day period and signed by an individual authorized to act on behalf of the firm.
GENERAL REQUIREMENTS

The consultant shall furnish with the proposal proof of the following minimum
insurance coverage. These minimum levels of coverage are required to be
maintained for the duration of the project:
A. General Liability and Automobile Liability Coverage - $1,000,000 per occurrence
for bodily injury and property damage. If Commercial General Liability Insurance
or other form with a general limit is used, either the general aggregate limit shall
apply separately to this project/location or the general aggregate limit shall be
twice the required occurrence limit.
B. Professional Liability Coverage - $1,000,000 per occurrence (note: A "claims
made" policy is acceptable). If consultant provides "claims made" coverage,
consultant shall also agree in writing to either:
i. Purchase Tail Insurance in the amount required by the resulting
agreement to cover claims made within five years of completion of
consultant's services under the agreement.
ii. Maintain professional liability insurance coverage with the same carrier, or
with an equivalent carrier in the amount required by the resulting
agreement five years after completion of consultant's services under this
agreement.
The consultant shall provide written evidence of either form by executing the
attached letter agreement (Attachment 3) on consultant letterhead.
C. Worker's Compensation Coverage - State statutory limits.
Deductibles, Self -Insurance Retentions, or Similar Forms of Coverage Limitations or
Modifications, must be declared to and approved by the City of Tustin.
The consultant is encouraged to contact its insurance carriers during the proposal
stage to ensure that the insurance requirements can be met if selected for
negotiation of a contract agreement. The City shall be named as Additional Insured
and no policy may be modified or cancelled prior to thirty (30) days written notice.
Certificates of insurance and insurer endorsements evidencing the required
insurance shall be provided.

2. STANDARD FORM OF AGREEMENT
The consultant will enter into an agreement with the City based upon the contents
of the RFP and the consultant's proposal. The City's standard form of agreement is
included as Attachment 2. The consultant shall carefully review the agreement, and
include with the proposal a description of any exceptions requested to the standard
contract. If there are no exceptions, a statement to that effect shall be included in
the proposal.
3. DISCLAIMER
This RFP does not commit the City to award a contract, or to pay any costs incurred
in the preparation of the proposal. The City reserves the right to extend the due
date for the proposal, to accept or reject any or all proposals received as a result of
this request, to negotiate with any qualified consultant, or to cancel this RFP in part
or in its entirety. The City may require the selected consultant to participate in
negotiations and to submit such technical, fee, or other revisions of their proposals
as may result from negotiations.
4. ASSIGNED REPRESENTATIVES
The City will assign a responsible representative to administer the contract, and to
assist the consultant in obtaining information. The consultant also shall assign a
responsible representative (project manager) and an alternate, who shall be
identified in the proposal. The consultant's representative will remain in responsible
charge of the consultant's duties from the notice -to -proceed through project
completion. If the consultant's primary representative should be unable to continue
with the project, then the alternate representative identified in the proposal shall
become the project manager. The City's representative shall first approve any
substitution of representatives or subconsultants identified in the proposal in writing.
The City reserves the right to review and approve/disapprove all key staff and
subconsultant substitution or removal, and may consider such changes not
approved to be a breach of contract.
5. CITY BUSINESS LICENSE
A city business license will be required of the consultant and any subconsultants for
services under this agreement.

VII. CONSULTANT EVALUATION &SELECTION PROCESS
The City's consultant evaluation and selection process is based upon Qualifications Based
Selection (QBS) for professional services. The following criteria will be used in evaluating the
proposals using a point value system (100 points) based upon the weighting indicated below:
1. Approach and work plan to achieve specified City objectives. (40 points)
2. Qualifications and experience of the project manager and other key individuals. (40
points)
3. Clarity of proposal. (10 points)
4. Compliance with proposal requirements including the ten (10) page limitation. (10
points)
Reference checks will only be conducted for a short list of firms or the top rated firm.
The City may elect to interview a short list of qualified firms or to interview only the top rated
firm based upon the proposals submitted for the project.
The City staff will negotiate a contract with the best qualified firm for the desired consulting
services. Should the City staff be unable to negotiate a satisfactory contract with the firm
considered to be the most qualified, negotiations with that firm shall be formally terminated.
Negotiations will then be undertaken with the next most qualified firm. Failing accord with the
second most qualified firm, the City staff will terminate negotiations and continue the
negotiation process with the next most qualified firms in order of their evaluation ranking until
an agreement is reached and a firm is selected and an agreement is executed.
Additional information related to the consultant selection process will be made available in
the future once the City has executed this contract. Please refrain from making any verbal
inquires or requests for a formal debriefing related to the subject RFP until the City of Tustin
completes the ongoing contract process.
VII. ADMINISTRATION SPECIFICATIONS
1. THE CITY OF TUSTIN'S RIGHTS TO PROPOSALS
All proposals, upon submission to the City of Tustin shall become its property for use as
deemed appropriate. By submitting a proposal, the offer covenants not to make any
claim for or have any right to damages because of any misinterpretation or
misunderstanding of the specification, or because of any misinformation or lack of
information. The City of Tustin has the following prerogatives with regard to proposals
submitted:
- to accept or reject any or all proposals;
- to correct any arithmetic errors in any or all proposals submitted;

- to utilize any or all the ideas from proposals submitted;
- to change the proposal's due date upon appropriate notification;

Improvement Project for the City of Tustin (City). This important project will help alleviate traffic congestion along the
Park Avenue corridor by promoting through traffic movement to avoid delays caused by excessive traffic queues within
the corridor. We understand the City's need to improve traffic mobility and operational safety for the continued
prosperity for the community, therefore, Michael Baker has assembled a group of technical experts to accomplish the

To provide the City with exceptional engineering services, Michael Baker has selected Brian Anderson, PE to serve as
Project Manager and Fabio Escobar, PE to serve as Alternate Project Manager, as has been requested for this project.
These managers have been specifically selected based on their extensive experience working at Tustin Legacy and the
City of Tustin; as well as for their respective expertise. Mr. Anderson is a Transportation Manager with over 30 years of
roadway and transportation system design; and Mr. Escobar is a Land Development Manager with over 33 years of
commercial and infrastructure design experience. Our goal is to utilize our team members' knowledge, combined with
the knowledge and skills of our extensive in-house staff to deliver a complete and successful project.
Our expert in-house team is comprised of over 250 staff members including innovative urban designers, landscape
architects, traffic, and drainage engineers who have demonstrated the ability to deliver projects on schedule and in
budget.

provide geotechnical and pavement design, arborist expertise, and utility locating services, respectively, for the City.

Understanding
The project as described within the Request for Proposal
(RFP) consists of the widening of Park Avenue and associated
intersection improvements between Tustin Ranch Road and
Warner Avenue in the area known as "Tustin Legacy". The
proposed improvements include adding an additional
eastbound lane between District Drive and Warner Avenue;
median modifications to accommodate a second westbound
through lane at the west leg of the District Drive Intersection;
adding a shared left -turn and through lane at the intersection
of Tustin Ranch Road; and associated traffic signal
modifications at the intersections of Tustin Ranch Road,
Warner, and District Drive.
The proposed improvements will require significant
landscape modifications including removal/ relocation of
multiple trees, and the adjacent sidewalk. Existing utilities,
drainage, and street lighting facilities will be relocated to
accommodate the new eastbound travel lane. The proposed
widening is to occur within the existing landscape easement,
however, based on our preliminary review of the site
improvements, modifications to the existing property right-
of-way may be necessary to accommodate the proposed
relocated driveway entrances.
Approach
Our plan of approach is to develop the Park Avenue
Improvement Project (CIP No. 70233) to be consistent with
the planned traffic operational improvements based on
Linscot, Law and Greenspan recommendations as addressed
within the current Request for Proposal. At the start of the
project, Michael Baker will meet with the City to clarify the
proposed goals are consistent with the City's commitments.
The Michael Baker Team has a clear understanding of the
Tustin Legacy development, being that Michael Baker has
provided a significant contribution to design and
development of Tustin Legacy since the initial base
reallocation process. Therefore, the Michael Baker Team has
utilized our extensive catalog of project data, in the
development of the following work plan to address the
requested design services, with anticipated optional
professional services, to make this a successful project.
Methodology/ Werk Program
Our understanding of the project is based on information
obtained from the RFP, discussions with the City, and review
of our extensive reference library of Tustin Legacy. The
following scope of work provides a complete work plan
specific to the RFP and Michael Baker's understanding to
successfully complete this project. Only work tasks identified
below are included in our fee proposal.
Phase 1.0 Preliminary Design Development
Task 1.0; Project kickoff Meeting
1.1 Kick-off Meeting. Michael Baker will prepare and attend a
kick-off meeting to set, select and review project goals and
expectations. Distribute meeting notes to document/track
decisions and responsibilities.
Deliverables: Kick -Off Meeting/ Notes
Task 2: Review Existing Site Conditions and Utility
Coordination
2.1 Field Review Photo Log. Michael Baker will perform a site
visit to assess the street and site conditions. A photo -
document log of the site will be collected. Site review will
focus on needed design aspects, ADA compliance, signing and
striping, drainage, land contour, and utility appurtenances.
2.2 Utility Notification Letters. Michael Baker will prepare a
series of three (3) utility notification letters (under City
letterhead) for the project, and will be distributed to utility
agencies. Responses from the agencies will logged and base
map utilities will be incorporated in AutoCAD format as
background project data. Five (5) utility coordination
meetings will be provided, including general coordination
with owners via email and/or telephone.
2.3 Utility Potholing (Budgetary). Michael Baker will provide
field utility exploration services to supplement the record
data. For budgetary purposes, two (2) days of field pot -hole
investigation, approximately eight (8) potholes, are included
under this task in addition to traffic control, as necessary.
2.4 Collect City Reference Documents. Michael Baker will
research and obtain available data, including record data
supplied by the City, and other agency documents (utility,
developers, etc.) to supplement our field investigation.
Deliverables: Utility Notification Letters (3); Summary Table;
Utility Base Mapping; Pothole Investigation two (2) field days.
Task 3: Design Survey and Base Mapping
3.1 Project Control. Horizontal and vertical control will be
established at the site sufficient to support final design.
Unless otherwise directed by the City, the basis of horizontal
control will be California Coordinate System of 1983 (CCS 83),
Zone 6, Epoch 2007.00. Coordinates will be expressed as grid
values in terms of the U.S. survey foot. Coordinates will be
based on the published values from the Orange County
Surveyor. Vertical control will be provided in terms of the
North American Vertical Datum of 1988 (NAVD 88), based
locally upon County bench marks.
3.2 Topographic Survey. Topographic mapping will be
provided for design -level detail at a scale of 1"= 20' with one
(1) foot contour intervals. Mapping will meet the
requirements in "ASPRS Accuracy Standards for Large Scale
Maps", dated March 31, 1993, and will be provided in
AutoCAD format including a digital terrain model (DTM).
Design files prepared in AutoCAD Civil 3D 2013 format unless
specified by client. Spot elevation will be collected in

sufficient manner to provide design from right-of-way to
right-of-way.
3.3 Topographic Base Map. Prepare a topographic file of the
survey points to show the existing elevations and features of
the project. Prepare the plan at a 1"=20' scale.
3.4 Monument Preservation. In accordance with Section
8771 of the California Business and Professions Code, Michael
Baker will recover existing Land Survey controlling
monuments where proposed improvements are likely to
cause their destruction and establish local ties prior to
construction. Local ties will be memorialized on Corner
Records and/or a Record of Survey as appropriate and filed
with the County of Orange. This task includes rehabilitation of
monuments, as part of the post -construction activities.
Corner Records and/or a Record of Survey will be filed with
the County of Orange to update rehabilitated monument
records. A total of two (2) controlling Land Survey
monuments are estimated for this task.
Deliverables: Project Control; Topographic Survey;
Monument Preservation
Task 4: Geotechnical Investigation
4.1 Review of Readily Available Background Materials.
Review includes: published geologic and seismic hazards
maps, groundwater data, stereoscopic aerial photographs,
and reports and/or plans provided by the City.
4.2 Field Coordination. Project coordination and planning,
including preparation of traffic control plans, encroachment
permit acquisition, and coordination and scheduling for
subsurface exploration. We assume fees for encroachment
permits will be waived by the City. Geological site
reconnaissance to select and mark the proposed boring
locations and to coordinate with underground Service Alert
(USA) for utility verification.
4.3 Field Sampling. Drilling, sampling, and logging of four (4)
small -diameter borings to depths up to approximately 20 -feet
below adjacent grades. The purpose of the borings will be to
observe the existing structural pavement sections and
subgrade soil conditions and to collect soil samples for
laboratory testing. The boring holes will be backfilled with on-
site soils and sand and capped with dyed concrete.
4.4 Laboratory Testing. Geotechnical laboratory testing of
representative soils samples to evaluate in-situ moisture and
density, gradation, sand equivalency, corrosivity, and R -value
characteristics of the on-site soils. Data compilation and
geotechnical analysis of field and laboratory data.
4.5 Investigation and Testing Report. Preparation of a
written report presenting the results of our field exploration,
laboratory testing, and engineering analyses, as well as our
conclusions and recommendations relative to the
geotechnical aspects of project design and construction. The
report will include existing boring logs, existing pavement
conditions, laboratory test results, and recommendations for
design and construction, including pavement design,
concrete, and trenching.
Deliverables: Field Exploration; Investigation Report;
Pavement Design
Task S: Environmental Documentation
Environmental Documentation. As requested in the RFP,
Michael Baker has provided optional services to address the
determination of the appropriate environmental
documentation. Michael Baker will meet with the City Staff to
review requirements of both a IS/MND and CE. Based on the
outcome of this meeting, Michael Baker will prepare the
appropriate documentation to carry the project forward:
Initial Study/Mitigated Negative Declaration (IS/MND)
(Optional Service) under the California Environmental Quality
Act (CEQA). The following services shall be provided:
5.1 Technical Studies. Michael Baker will prepare the
following technical studies: Hazardous Materials, Cultural
Resources, Air Quality and Greenhouse Gases, and Noise:
5.1a Hazardous Materials. Michael Baker will document the
existing hazards and hazardous materials conditions at the
project site based on available public records. Past site usage
will be investigated, where necessary, through a review of
commercial database summaries, provided by Environmental
Data Resources, Inc. (EDR), regarding public agency records.
Regulatory sites within and surrounding the project site will
be mapped within a one (1) mile radius. The existing
regulatory conditions per the State Cortese Database Listing
will be verified. Potential hazardous materials conditions
within the project site will be considered based on the
sources described above.
Michael Baker will utilize the above referenced research to
analyze potential project -related impacts, as they pertain to
hazards and hazardous materials per the CEQA thresholds of
significance. An analysis of the proposed construction
activities and operations of the project will be conducted. The
handling of hazardous materials in soils and/or groundwater
during construction will be considered. Should a potentially
significant impact arise, Michael Baker will recommend
mitigation measures to reduce these impacts to the extent
feasible. This task assumes that no right-of-way acquisition
would be required as part of the project.
5.1b Cultural Resources. Our cultural resources
subconsultant will prepare a Cultural Resources Assessment
for the project. The Assessment will address archaeological,
historical, and paleontological resources under CEQA and will
consist of the following primary components:
Determination of impact area for basis of analysis
Native American consultation, including assistance to the
City with AB52 compliance
Literature/records searches for known resources,
including:

o Archaeological and historic records to be searched at
South Central Coastal Information Center
o Paleontological records to be searched at Natural
History Museum of Los Angeles County
o Review of historic aerials and topographic maps; and
o Review of previous studies in the area
Perform research to develop brief contexts for
paleontological, prehistoric and historic resources
Preparation of a report reflecting results and findings
The results of the Cultural Resources Assessment will be
summarized within the IS/MND. A description of existing
conditions, potential impacts, and mitigation measures (if
applicable) will be provided.
5.1c Air Quality and Greenhouse Gases. Fugitive dust and
equipment exhaust emissions from construction activities will
be quantitatively evaluated using CalEEMod. As the project is
a roadway widening project and would not generate
operational trips, the operational emissions analysis will be
qualitative. Where necessary, carbon monoxide hotspots will
be evaluated. Michael Baker will also qualitatively discuss
naturally occurring asbestos impacts. Michael Baker will also
prepare an inventory of the greenhouse gas (GHG) emissions
(i.e., nitrous oxide, methane, and carbon dioxide) from both
direct and indirect sources.
The results of the air quality and GHG analysis will be
summarized within the IS/MND. A description of existing
conditions, potential impacts, and mitigation measures (if
applicable) will be provided.
5.1d Noise. Michael Baker will review applicable noise and
land use compatibility criteria for the project area. Noise
standards regulating noise impacts will be discussed for land
uses adjacent to the proposed roadway widening. The
construction noise impacts will be evaluated in terms of
maximum levels (Lmax) and hourly equivalent continuous
noise levels (Leq) and the frequency of occurrence. A
screening level operational noise assessment will be
conducted to determine the change in ambient noise due to
implementation of the proposed roadway widening.
Compliance with applicable noise standards will be evaluated,
with recommended mitigation measures included where
appropriate. This scope excludes on-site noise
measurements.
The results of the noise analysis will be summarized within
the IS/MND. A description of existing conditions, potential
impacts, and mitigation measures (if applicable) will be
provided.
5.2 Research and Investigation. Michael Baker will initiate
the CEQA process by attaining and evaluating necessary
information with respect to the proposed project. Project
research will include coordination with the City to acquire
relevant environmental data, previous studies for the area
and other available files, exhibits, maps, and reference
documents. The investigation will include a site visit to review
existing land uses and environmental conditions, as well as a
photographic inventory of on-site and surrounding uses.
Based upon the detailed information obtained during project
initiation, Michael Baker will draft a preliminary project
description for incorporation into the Initial Study.
5.3 Preparation of the Initial Study. Michael Baker will
prepare an Initial Study in accordance with the CEQA
Guidelines. The Initial Study will include detailed explanations
of all checklist determinations and discussions of potential
environmental impacts. The analysis shall be in accordance
with Public Resources Code Section 21080 (c) and CEQA
Guidelines Section 15070. The Initial Study will be presented
as follows:
5.3a Introduction. This section will cite the environmental
review requirements of the project, pursuant to the CEQA
Guidelines. The Introduction will include the project location,
environmental setting, existing uses on- and off-site, the
Project Description (confirmed by City staff in Task 5.2,
Research and Investigation), project phasing, and relevant
background/history information.
5.3b Environmental Checklist. This section will include a
summary page of project information followed by an
explanation of factors considered for potential impacts. The
Initial Study Checklist will be presented in a four (4) column
layout, identifying: (1) potentially significant impacts, (2)
potentially significant impacts unless mitigated, (3) less than
significant impacts, and (4) issues resulting in no impacts.
5.3c Environmental Analysis. The Environmental Analysis
sections will provide vital supporting information for the
conclusions rendered for the Environmental Checklist. In
accordance with Appendix G of the CEQA Guidelines, this
section include a detailed review of the following issues:

topic will be provided, and a summary of the project's

5.3e Graphic Exhibits. The environmental document will
include a maximum of five (5) exhibits to enhance the written
text and clarify the project and potential environmental
impacts.
5.3f Administrative Draft Initial Study. Michael Baker will
submit five (5) copies of the Administrative Draft Initial Study
for review and comment by the City. Should additional copies
be required, additional copies will be provided by Michael
Baker at an additional fee. This scope of work assumes two
rounds of review by City staff prior to the 30 -day CEQA public
review process. Correspondingly, this scope is limited to two
rounds of revisions by Michael Baker in response to City
comments.
5.4 Preparation of the Public Review IS/MND. With the
anticipated conclusion in the Initial Study that no significant
environmental effects will occur, a Mitigated Negative
Declaration (MND) will be prepared. Following this
determination, Michael Baker will prepare the Notice of
Intent to Adopt (N01) and the MND for City review. The N0[
and MND will be attached to the Initial Study to fully explain
the proposed project and its effects. Twenty-five (25) copies,
one (1) camera-ready original, and an electronic file of the
IS/MND will be provided to the City. Michael Baker will
submit the IS/MND to the State Clearinghouse and additional
agencies/interested parties as directed by the City. This task
assumes that the City would be responsible for any radius
mailing or newspaper noticing required for public review. The
IS/MND would be subject to a mandatory 30 -day public
review period.
5.5 Preparation of the Final IS/MND. Michael Baker will
prepare a draft Final IS/MND for City review and approval.
Michael Baker will respond to City comments on the draft
final document. The final document will include a purpose
subsection, reference the review process, comments letters
received, responses to comments, and any required
edits/updates to the Public Review document. Also included
within this task is the Mitigation Monitoring and Reporting
Program (MMRP) in accordance with Public Resources Code
Section 21081.6 (AB 3180). Fifteen copies (15), one (1)
camera-ready original, and an electronic file of the Final
IS/MND will be provided to the City. Michael Baker will
provide the document to each agency/interested party who
submitted a comment letter during the 30 -day public review
period.
Due to the unpredictable nature of potential comment letters
received during the public review period, this task is limited
to a maximum of twelve (12) hours for Responses to
Comments. Additional effort necessary for the Responses to
Comments process (due to a high volume of comment letters,
complex issues raised in comment letters, etc.) would be
performed on a time and materials basis.
Upon adoption of the IS/MND by the City, Michael Baker will
prepare a Notice of Determination (NOD) and will file the
notices at the Orange County Clerk's Office. This scope of
work excludes any applicable CECIA filing fees required by the
CDFW.
5.6 Coordination and Meetings. Our Environmental lead will
undertake consultation and coordination of the project and
the environmental review for compliance with CEQA
requirements. The Environmental lead will attend up to two
(2) staff -level meetings and one (1) public hearing for the
project. Michael Baker will represent the project team at staff
meetings and the public hearing and make a presentation as
necessary.

5.7 Categorical Exemption (OPTIONAL SERVICE): If
determined appropriate by the lead agency, a Notice of
Exemption, as required under CEQA will be provided for the
project (in lieu of the IS/MND described above). The Notice of
Exemption (NOE) will cite the CEQA Guidelines, Section
15301, Existing Facilities. This Categorical Exemption applies
to the minor alteration of existing public facilities, including
roadways. The NOE will provide a brief project description, a
description of the project site and affected area, and
substantiation for the exemption. The NOE will be filed with
the County Clerk and State Clearinghouse upon approval by
the Lead Agency. This task specifically excludes the
preparation of an Initial Study, Negative Declaration, or
Environmental Impact Report
Categorical Exemption Deliverables: Notice of Exemption
(NOE) documentation and filing.
Task 6: Hydrology and Hydraulic Analyses
6.1 Hydrology and Hydraulics. Michael Baker will prepare a
drainage analysis to address the existing drainage condition
and the proposed mitigation and design. This report shall
consider the roadway drainage tributary area of Park Avenue
(project limits). This report will compare the existing street
conveyance based on normal depth calculations using
information provided by the City from previous hydrological
study as a basis for design. The proposed lines and grades will
be used to compare the capacity of the proposed street
section, and drainage improvements/ mitigation will be
recommended to maintain the existing levels of protection.

Hydraulic Calculations will be limited to street capacity
calculations, inlet interception calculations, and pipe normal -
depth calculations. Detailed Standard Step hydraulics (i.e.
WSPG) or multi -dimensional analysis (XP-SWMM) are not
expected to be required.
6.2 WQMP. Michael Baker will prepare a project specific
Water Quality Management Plan (WQMP) in accordance with
the Santa Ana Region Model WQMP, the Technical Guidance
Document, and the Public Agency WQMP Template as cited
in the Project RFP.

Phase 2.0 Final Design
Task 7: Final Design Drawings
Prepare Final Design Drawings. All plan types shall be
completed in conformance with City of Tustin standards.
Design drawings will be submitted to the City for review and
approval for each specified percent submittal. Plans will be
prepared in AutoCAD format. The following describes the
plan sheets.
7.1 Title Sheet. Prepare a project title sheet, vicinity map,
general notes, and benchmark with basis of coordinates, dig
alert information, list of utility companies with contact names
and telephone numbers, list of standard plans, and legend of
symbols in the drawing.
7.2 Typical Section and Details. Prepare and display right-of-
way lines, lane and parkway dimensions, existing pavement
surface and curb/gutter, existing pavement sections with
proposed improvements and cross fall of slopes in the
drawing. Pavement cross fall to maintain a 2% optimal.
Notwithstanding the foregoing, Michael Baker shall
coordinate with the City on allowable standards for arterial
roadways. Incorporate construction notes related to
proposed improvements on this Title Sheet and show the
details required for the design on the Roadway Plan.
7.3 Roadway Improvement Plans with Removals and
Utilities. Prepare plans and show the (a) utility and survey
information defining the limits of work, (b) design of curb and
gutter, sidewalk, pedestrian ramps and pavement
improvements, (c) adjustment of manholes, vaults and valves
to grade, and (d) location of right-of-way property impacts.
Incorporate and display the utility relocation work in the
plans and reference to utility owner design documents.
Identify the need for the preservation of existing survey
control monuments. Curb profiles will show existing and
proposed top of curb elevations with stations and elevations.
7.4 Signing and Striping Plan. Field -verify the existing signage
and striping and identify potential constraints due to the
(CIP No, 10233)
City, California Manual on Uniform Traffic Control Devices
("CA MUTCD"), and the latest Caltrans standard plans and
specifications.
7.5 Traffic Signal Modification (Tustin Ranch Road and
District Drive). Michael Baker will prepare a traffic signal
modification plan at the intersection of Park Avenue and
Tustin Ranch Road, and at the intersection of Park Avenue
and District Drive. Michael Baker will obtain specific
equipment requirements from the City. Interconnect
installation information will be shown as a detail, as
necessary. We assume standard Caltrans poles, foundations,
and appurtenant equipment will be utilized.
7.6 Street Lighting Relocation Plan. Michael Baker will
prepare a street lighting plan for Park Avenue between
District Drive and Warner Avenue. This plan will address
changes to the lighting layout impacted by the eastbound
widening. It is also assumed the lighting fixtures are a
specialty design, therefore, will be the property of the City
and maintained as such.
7.7 Traffic Control Plan. Michael Baker will prepare a two (2)
stage - traffic control plan for Park Avenue consistent with CA
MUTCD design standards. The traffic control plan will address
major items of work specific to the two primary construction
items. Stage 1: Raised Median work; and Stage 2: Eastbound
traffic lane widening from District Drive to Warner Avenue. It
is assumed a single lane of traffic will be maintained in both
directions during construction.
7.8 Drainage Plans. Michael Baker will prepare drainage plans
and details for modification of the existing drainage facilities
to accommodate the new street widening. The scope of the
drainage plans is based on utilization of existing cross culverts
and downstream drainage systems for tying in new or
relocated drainage systems or extending existing systems.
Deficient existing systems will be identified, whether due to
the new or modified pavement section, different hydrology
design criteria currently in place, or other reasons.
Deficiencies due to other reasons will be presented for a
policy decision by the City to incorporate into the project
design and construction. Previous reports will be utilized to
determine hydraulic control for any new storm drain facilities
that may be connected to these existing cross -culverts and
regional facilities. In the absence of such information, best
professional judgment will be used to establish the required
hydraulic controls. Permanent Water Quality Treatment BMP
facilities will be incorporated within the drainage plans. The
Treatment BMPs are anticipated to consist of bio -filtration
planters near existing catch basin locations where the under
drains can be readily connected to the existing storm drain
systems. Edge drain plans are not anticipated and are
excluded from the scope of work.

Water Efficient Landscape Ordinance. Median paving details,
a planting legend, and planting details will be included as part
of this task. The drawings will include three (3) Planting Plan
sheets and one (1) Planting Legend, Notes, and Details sheet
7.10 Irrigation Plans. Michael Baker will prepare 1"=20' scale
irrigation plans indicating type of irrigation equipment to be
used, such as the backflow preventer, master valve, irrigation
controllers, pipe, valves, quick -couplers, and bubblers or
dripline. The irrigation design will utilize low water use and
water efficient application techniques to be compliant with
the City's Water Efficient Landscape Ordinance. An irrigation
legend and irrigation details will be included as part of this
task. The drawings will include three (3) Irrigation Plan sheet,
one (1) Irrigation Legend and Notes sheet, and one (1)
Irrigation Detail sheet.
7.11 Electrical. Michael Baker will provide review of the
electrical systems impacted by the roadway widening. Work
includes street lighting, street furniture, and landscape
lighting. It is assumed no new power services will be required.
7.12 Structural Details. Michael Baker shall provide structural
design services for street lighting, traffic signal, and
monument sign foundations utilizing parameters provided
under the geotechnical task. Foundation details and
connections will be included upon the Construction Detail sheets.

Task 8: Specifications
8.1 Technical Specifications. Prepare technical specifications
and measurement/payment statements for each item of
work in accordance with the City formatted standard
specifications, and the Standard Specifications for Public
Works Construction ("Green Book") and the State of
California Standard Specifications for traffic signal, signing
and striping.

Task 9: Cost Estimate
9.1 Construction Cost Estimate. Prepare quantity calculations
and final construction cost estimates at the 60% and 100%
submittals for the project in accordance with City
requirements utilizing current construction cost data and bid
items from recent projects. Use recent City unit prices, if
available and applicable to this Project, and include a 5%
contingency.

10.1 Project Management and Administration. Provide

Reimbursable Expenses. Invoices clearly identifying
reimbursable expenses with supporting documentation shall
be submitted when Michael Baker is requesting payment for
the reproduction of notes, exhibits, drawings, technical
specifications, and other documents as needed.
Project Assumptions. This scope of work has been
prepared based on the RFP, Amendments, and our discussion
with City Staff. Only the work items identified in this Scope of
Services are included in this proposal. Work items not
addressed within this Scope of Services may be included by
the request of the City for additional scope and fee. The
following scope assumptions, exclusions and clarifications are
as follows:
1) City will provide all supporting traffic data necessary to
complete the design. Any traffic studies needed by
Michael Baker can be provided as an amendment to this
scope and fee.
2) SWPPP will be developed and maintained by the
successful Construction bidder.
3) Utility relocations/agreements/and right-of-way services
are assumed to be provided by the owner and are not
included in this scope of work.
4) Public Outreach/Presentations are not included in this
scope of work.
5) Hazardous waste investigation services are excluded
from this scope of work.
6) Arbor services specific to maintaining or relocating trees
is not included in this scope of work.
7) Right -of -Way mapping services are not included in this
scope of work.
Anticipated Challenges
Michael Baker has made some initial observations of the
project site that may require further review and evaluation:
Street Tree Removal and Replacement
The existing Palm trees located throughout the District
enhance the pedestrian experience. The proposed roadway
improvements and widening will impact a number of these
existing trees. As a cost savings measure, Michael Baker has
teamed with an Arborist to provide a technical specification
for the proper handling and protection of these trees such
that they can be re -used in the modified landscaping. If it is
the desire of the City, the Michael Baker Team can perform a
tree survey during design to determine what specific trees
are appropriate for relocating. This service for additional
scope and fee is optional and is at the sole discretion of the City.

Right -of -Way, Sidewalk, Utilities, and Landscape Design
The current right-of-way for Park Avenue varies in width,
however, the right-of-way dimension between District Drive
and Warner Avenue is a minimum width of 92 -feet. The 92 -
foot width allows for two (2) through lanes in both directions.
Therefore, no additional right-of-way is anticipated. The
proposed lane widening in the eastbound direction is
approximately 6 -feet, thereby the proposed roadway section
includes a 12 -foot wide and 14 -foot wide lane dimensions.
The adjacent landscape area will be reduced to accommodate
the new travel lane, which will impact the existing utility
appurtenances, and possibly the meandering sidewalk. The
existing sidewalk dimension is 10 -feet in width, and will be
maintained unless directed otherwise. The impacted utilities
include street lighting, fire hydrants, water meters, vaults,
other street furniture, and a drainage inlet that will require
relocation to accommodate the new curb line. Michael Baker
will coordinate with the utility agencies., and the City to
address impacted facilities, and ensure the new landscape
will be consistent with current water conservation standards.
Project Schedule
The project schedule is estimated to take approximately (6)
to (8) months for completion of the planning and design,
specifically for the environmental approval process. If it is
determined that a Categorical Exemption (CE) is the
appropriate process than the schedule could be reduced to
less than (6) months. We have included a project schedule in
the following pages.
TEAM ORGANIZATION
The Michael Baker Team is prepared to commit its personnel
and resources to the City of Tustin for the Park Avenue
Improvements project. Michael Baker offers an experienced
team that has completed numerous streetscape, pedestrian,
and bicycle enhancement projects throughout southern
California. Given the depth of our in-house services, Michael
Baker is prepared to support the key team members on any
project with over 250 additional technical and support staff
located in our Irvine office.
Our Organization Chart which illustrates our design staff
and the relationship between the project manager, key staff
and the City, is included in the proceeding pages. We have
also included the time commitment of our key staff for this
project.
Project Manager
Mr. Brian Anderson, PE will serve as Project Manager and
serve as a primary contact to the City on a day-to-day basis.
Mr. Anderson has served as project manager for a number of
projects including Alton Parkway Extension in Irvine,
Alessandro Boulevard Median in Moreno Valley, and
provided key transportation design coordination for Tustin
Legacy. He has proven experience working with Federal, State
and Local agencies, specifically on projects within Caltrans
District 12.
Alternate Project Manager
Mr. Fabio Escobar, PE, will serve as Deputy (Alternate)
Project Manager to support Mr. Anderson. Mr. Escobar has
worked closely with the City staff for over 10 years on
numerous City projects including Tustin Legacy, Legacy Villas,
Legacy Park, Armstrong, Barranca, Warner, and Tustin Ranch
Road Street Improvements, and he is familiar with the City
staff and procedures.
Project Principal/QA-QC
Mr. Michael Bruz, PE, has 35 years of experience of
successfully delivering transportation planning and
design/public works projects. He is an experienced leader
who is known as a pro -active, client service oriented manager
who fosters effective partnering relationships with his clients.
As Project Principal, Mr. Bruz has the authority to commit
staff and resources as needed for this project.
Subconsultants
The Michael Baker Team is enhanced by the subconsultant
firms we have selected for this project that have experience
in Orange County and surrounding areas, and can support the
City in its effort to obtain federal funds. Our subconsultants
include: C -Below (Utilities), Cogstone Resource Management
(Cultural Resources), Ninyo & Moore (Geotechnical), and
Dudek (Arborist).

Michael Baker has been working in and for the City of Tustin
for many years, including large scale planning projects, street
improvement plans, and detailed planting and irrigation
plans. Previous projects with the City include the SR-
55/Newport Avenue Tustin Gateway, the Tustin Legacy
backbone streets, Tustin Legacy Gateway Monument, and the
Edinger Avenue improvements.

Project Experience
Tustin Legacy
Michael Baker has been responsible for providing
professional planning and engineering services for the Tustin
Legacy project as part of the redevelopment of the Tustin
Marine Corps Air Station. Michael Baker prepared design
plans and specifications for over two and a half miles of new
roadway, a new bridge structure spanning 412 -feet over
Edinger Avenue and the SCRRA/OCTA railroad, and widening
approximately 1,000 -feet of Walnut Avenue, to support
redevelopment of the former Tustin Marine Corps Air Station.
Additionally, Michael Baker reconfigured portions of existing
arterial roadways to meet the new traffic modeling. In
addition, Michael Baker was responsible for the development
of improvement plans for landscape and water treatment
facilities (Legacy Park and Linear Park); and drainage facilities
including Barranca Channel, and Peters Canyon Channel.

Alessandro Boulevard Media (Indian Street to Perris
Boulevard)
Michael Baker evaluated, designed, and constructed raised
medians and turn pockets along Alessandro Boulevard at the
Perris Boulevard intersection. The project was funded by the
Federal Highway Safety Improvement Program (HSIP) under
Caltrans District 8 Local Assistance, requiring close agency
coordination of environmental, traffic, and civil
transportation services. The design and construction required
modification of a traffic signal, ADA -compliant pedestrian
ramps, and signing and striping. The improvements were
intended to provide improved safety for both vehicles and
pedestrians in the project area. Michael Baker recommended
alternative median types considering immediate cost versus
anticipated future cost if the client should desire a
landscaped median.

Alton Parkway Extension
Alton Parkway is designated as a major arterial highway on
the County's Foothill Circulation Phasing Plan and the Master
Plan of Arterial Highways. Michael Baker provided planning
and engineering services for the development of the "GAP"
closure including design of a six -lane arterial highway, a major
regional drainage course (Borrego Canyon Wash), and the
installation of traffic signal improvements at (Irvine
Boulevard, Commercentre Drive, and Towne Center). The
design incorporated curb, gutter, sidewalks, ADA access
ramps, and streetlights. Environmental documentation,
permitting, and successfully completed CEQA clearances in
2007. Michael Baker prepared plans, and specifications for
this approximately 1.25 mile reach of new roadway. The
roadway alignment was severely constrained due to its
immediate proximity to a portion of lands within the Nature
Reserve of Orange County, the proposed EI Toro Federal
Wildlife Refuge, the Borrego Canyon Wash and the ongoing
landfill activities by the Navy within the former MCAS EI Toro.
This project also included the design of a wildlife corridor that
provided a connection to the City of Irvine's Great Park.

Sand Canyon Avenue Grade Separation at the
Metrolink/BNSF Railroad
The City of Irvine constructed a grade separation for Sand
Canyon Avenue, a major arterial paralleling S.R. 133 between
1-5 and 1-405, at the Southern California Regional Rail
Authority (SCRRA)/Orange County Transportation Authority
(OCTA)/Metrolink railroad tracks.
The goal was to realign Sand Canyon Avenue to the
northwest and depress the roadway below the Metrolink
Railroad. The project consisted of a two -span steel and
concrete structure supporting Metrolink, Amtrak, and BNSF
trains. The structure included a steel deck and steel plate
girder bridge superstructure with two sacrificial exterior
concrete girders, abutments, wing walls, temporary shoring,
temporary double -track shoofly alignment southwest of the
new bridge structure and elimination of the existing at -grade
crossing. The grade separation required raising the existing
track elevations approximately 1.5 feet to allow roadway
clearance.
The project lowered Sand Canyon Avenue under the railroad
tracks and widened the roadway from four (4) lanes to six (6)
lanes.
Key challenges included:
• Complex construction staging for maintenance of
operations, including cars, bicycle, pedestrian traffic, rail,
and trucks
• Landscaped medians and parkways, including "heritage"
oak tree preservation
Traffic signal design, interconnect, queue cutter signal
design, and street lighting
Coordination with multiple utility agencies for major
transmission and distribution facility relocations

Mr. Anderson has over 30 years of experience in
transportation/public works engineering. He supervises

projects including complex roadway and highway system
development; Multi -use trails; Street Enhancement; and
