HomeMy WebLinkAboutPC RES 4316 RESOLUTION NO. 4316 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN DETERMINING THAT THE CONVEYANCE OF TWO (2) RESIDENTIAL UNITS LOCATED AT 14542 NEWPORT AVENUE #3 AND 27 LOOK OUT LANE AND ONE (1) VACANT PARCEL LOCATED AT 140 SOUTH A STREET OWNED BY THE CITY OF TUSTIN TO HABITAT FOR HUMANITY OF ORANGE COUNTY, INC. IS 1N CONFORMANCE WITH THE APPROVED GENERAL PLAN. The Planning Commission does hereby resolve as follows: 1. The Planning Commission finds and determines as follows: A. That the Tustin Housing Authority (THA) wishes to sell two (2) affordable residential units located at 14542 Newport Avenue #3 and 27 Look Out Lane at market rate and deposit the funds into the Low and Moderate Income Housing Asset Fund (LMIHAF). The LMIHAF is used to administer and monitor the THA's affordable housing inventory. B. That the City of Tustin (City) wishes to convey, at no cost, one (1) City- owned vacant parcel located at 140 South A Street to Habitat for Humanity of Orange County, Inc., (Habitat) for the purpose of building two (2) affordable ownership units for the benefit of Veterans. C. That Section 65402(a) of Government Code provides that no real property shall be disposed until the location, purpose, and extent of the project has been reported upon by the local planning agency as to the conformity with the adopted general plan. D. That Section 65402 (a) of the Government Code authorizes the Planning Commission to determine whether the location, purpose, and extent of the proposed disposition of real property are consistent with the General Plan. E. The proposed disposition supports several General Plan Land Use Element goals, including the following: 1. Land Use Element Goal 1: Provide for a well-balanced land use pattern that accommodates existing and future needs for housing, commercial, and industrial land, open space and community facilities and services, while maintaining a healthy, diversified economy adequate to provide future City services. Land Use Element Goal 3: Ensure that new development is compatible with surrounding land uses in the community, the City's circulation network, availability of public facilities, existing development constraints, and the City's unique characteristics and resources. 3. Housing Element Goal 1: Provide an adequate supply of housing to meet the need for a variety of housing types and the diverse socio- economic needs of all community residents. 4. Housing Element Goal 3: Increase the percentage of ownership housing to ensure a reasonable balance of rental and owner- occupied housing within the City. 5, Housing Element Goal 4: Preserve the existing supply of affordable housing in the City. F. That the general plan conformity determinations required by Government Code Section 65402(a) are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that the location, purpose, and extent of the disposition of two (2) affordable residential units located at 14542 Newport Avenue #3 and 27 Look Out Lane at market rate and one (1) vacant parcel located at 140 South A Street owned by the City of Tustin to the Habitat for Humanity of Orange County, Inc. is in conformance with the approved General Plan.
