HUSTON, CITY MANAGER PUBLIC HEARING N0. 1 3-4-91 Inter - Com PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION VACATION AND ABANDONMENT OF A PORTION'OF AUTO CENTER DRIVE RECOMMENDATION: It is recommended that pending the results of the public hearing, and if the City Council desires to vacate and abandon a portion of Auto Center Drive within the limits stated, that the attached Resolution be passed and adopted by the City Council at their meeting of March 4, 1991 and authorize the Mayor to execute the attached Corporation Quitclaim Deeds. BACKGROUND: At their meeting of February 4, 1991, the City Council adopted Resolution No. 91-19 declaring its intention to vacate and abandon a portion of Auto Center Drive and fixing a time and place for the public hearing thereof for March 4, 1991 at 7:00 p.m. A copy of the previous staff report dated January 21, 1991 is attached for the City Councils information. The public hearing has been duly posted and noticed for todays City Council meeting at 7:00 p.m. After the public hearing has been completed, and if the Council so desires to vacate and abandon that portion of Auto Center Drive, the attached Resolution will require adoption. This Resolution provides for permanent easements per Section 8330 of the Streets and Highways Code for all existing public utilities within that portion of Auto Center Drive to be vacated and abandoned. Once the adopted Resolution is recorded at the County Recorder's office, the proceedings on this abandonment action are complete. The City Council finds and determines: a. The City Council duly adopted its Resolution No. 91-19 declaring its intention to vacate and abandon a portion of Auto Center Drive adjacent to parcels 6 and 7 of parcel map 84-1032 as described in Exhibits "A" and shown on Exhibits "B" attached hereto and incorporated herein by this reference, and fixing a time and place of public hearing thereon. b. Said resolution has been duly published according to law; and c. Said notices of said hearing have been posted as required by law; and d. A public hearing has been duly called, noticed and held according to law, and all persons interested in or objecting to the proposed vacation and abandonment appearing at said hearing were heard. e. Said portions of said street are not necessary for present or prospective public street purposes, except for public utilities. f. The project is categorically exempt from an Environmental Impact Report requirement. 2. The City Council hereby orders the vacation and abandonment of a portion of Auto Center Drive adjacent to parcels 6 and 7 of parcel map 84-1032 described in Exhibits "A" and shown on Exhibits "B" attached hereto, subject to the reservation of easements per Section 8330 of the Streets and Highway code. 3. HUSTON, CITY MANAGER Inter - Com FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT:VACATION AND ABANDONMENT OF A PORTION OF AUTO CENTER DRIVE RECOMMENDATION: It is recommended that the City Council, at their meeting of February 4, 1991, pass and adopt the attached Resolution declaring the City's intention to vacate and abandon a portion of Auto Center Drive and setting a time and place of public hearing thereon. BACKGROUND: The original dedication of Auto Center Drive terminated in a cul-de-sac at the westerly edge of the old retention basin and adjacent to Parcels 6 and 7 of Parcel Map No. 84-1032. The retention basin has since been filled in and Auto Center Drive was extended approximately two hundred feet easterly to a new cul-de-sac. The original cul-de-sac was realigned by the installation of new curb and gutter and sidewalk that are parallel with the centerline of the street, which resulted in excess right-of-way adjacent to parcels 6 and 7. The following is an anticipated schedule for this abandonment procedure: February 4, 1991 - City council adopts attached Resolution declaring intent and setting date for public hearing. February 5, 1991 - All affected utilities notified. February 13, 1991 - Resolution of intent published in the Tustin News. February 18, 1991 - Property posted. March 4, 1991 - City Clerk holds public hearing and pending results, City Council adopts resolution ordering vacation. March 5, 1991 - City Clerk causes document to be recorded.
