BACKGROUND: At their meeting of January 7, 1991, the City Council directed the City Attorney to draft an Ordinance reflecting changes in the termination dates of terms for the Planning Commission, Parks and Recreation Commission, Audit Committee, and Cultural Resources Advisory Committee. The attached Ordinance No. 1058 will amend the Tustin City Code pursuant to Council direction. Valerie Whiteman Chief Deputy City Clerk 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15' 16. 17 18 19 20' 211 22I 23! 24'. 25' 261'', 27'', 28 ORDINANCE NO. 1058 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA AMENDING THE TUSTIN CITY CODE REGARDING THE APPOINTMENT AND TERMS OF MEMBERS OF THE PARKS AND RECREATION COMMISSION, AUDIT COMMITTEE, CULTURAL RESOURCES ADVISORY COMMITTEE AND PLANNING COMMISSION The City Council of The City of Tustin does hereby ordain as follows: 1. Section 1513 of the Tustin City Code is hereby amended to read as follows: Section 1513. APPOINTMENT AND TERMS Members of the Planning Commission shall be appointed by the City Council. The terms of office of two (2) of the holders of said offices on February 1, 1991 shall be from that date until the third Monday in July, 1991 and the terms of office of three (3) of the holders of said offices on February 1, 1991 shall be from that date until the third Monday in July, 1992. The term of each of said offices shall thereafter be for two (2 ) years commencing on the expiration date of each office as prescribed hereinabove. All members of the Commission shall serve at the pleasure of the City Council and may be removed upon motion of the City Council adopted by at least three (3) affirmative votes. All members of the Commission shall serve until their respective successors are appointed and qualified. A member of the Planning Commission shall automatically be deemed removed from office upon filing for or announcing his or her candidacy for any elective office or upon the occurrence of three (3) successive unexcused absences from Planning Commission meetings or upon more than five (5) absences from Planning Commission meetings within any six (6) consecutive month period. 2. Section 1514 of the Tustin City Code is hereby amended to read as follows: Members of the Planning Commission shall receive compensation as prescribed by the City Council from time to time. 3. Section 1539 of the Tustin City Code is hereby amended to read as follows: Section 1539. APPOINTMENT AND TERMS Members of the Audit Committee shall be appointed by the City Council. The terms of the two (2) members whose 1 2 3 4 5 6 7 8 9 10 11 12 13� 14 15 16I 17 18 19 20 21 22 23 24 25 26 27 28 Ordinance No. 1058 Page 2 terms prior to February 1, 1991 were to expire in 1992 shall expire on the third Monday in July, 1995 and the holders of said offices whose terms prior to February 1, 1991 were to expire in 1993 shall expire on the third Monday in July, 1993. The terms of each of said offices shall thereafter be for four ( 4 ) years, commencing on the expiration date of each office as prescribed hereinabove. All members of the Audit Committee shall serve at the pleasure of the City Council and may be removed upon motion of the City Council adopted by at least three (3) affirmative votes. All members of the Audit Committee shall serve until their respective successors are appointed and qualified. Members of the Audit Committee shall receive compensation as prescribed by the City Council from time to time. 4. Section 1553 of the Tustin City Code is hereby amended to read as follows: Section 1553. APPOINTMENT AND TERMS Members of the Parks & Recreation Commission shall be appointed by the City Council. The terms of office of four (4) of the members shall be from the time of their appointment until the third Monday in July 1991 and the terms of office of three ( 3 ) of the members shall be from the time of their appointment until the third Monday of July, 1992. The term of each of said offices shall thereafter be for two (2) years commencing on the expiration date of each office as hereinabove provided. All members of the Commission shall serve at the pleasure of the City Council and may be removed upon motion of the City Council adopted by at least three (3) affirmative votes. All members of the Commission shall serve until their respective successors are appointed and qualified. 5. Tustin City Code is hereby amended by the addition thereto of PART 6 to read as follows: PART 6 CULTURAL RESOURCES ADVISORY COMMITTEE 1561 TERMS OF OFFICE The Cultural Resources Advisory Committee is established by Section 9252c and the qualifications of its members are as prescribed in said section. The terms of office of two ( 2 ) of the members of the Cultural Resources Advisory Committee on February 1, 1991 shall be from that date until the third Monday in July, 1992 and the terms of office of three (3) of the members of the Cultural Resources Advisory Committee on February 1, 1991 shall be from that date until the third Monday in July, 1993. The term of each of said offices shall thereafter be for four (4) years commencing on the expiration date of each office as prescribed hereinabove. All members of the Cultural Resources Advisory Committee shall serve at the pleasure of the City Council and may be removed upon motion of the City Council adopted by at least three (3) affirmative votes. All members of the Cultural Resources Advisory Committee shall serve until their respective successors are appointed and qualified. 7. The determination of which members of the bodies described above shall have the shorter or longer terms shall be decided by the members of the respective bodies by lot at a regular meeting and shall be recorded in the minutes of the meeting of the body and shall be subject to approval of the City Council or if not so determined shall be determined by action of the City Council.
