HUSTON, CITY MANAGER REPORTS NO. 5 3-4-91 Inter - Com PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: UNDERGROUND UTILITY DISTRICTS - STATUS REPORT RECOMMENDATION: Receive and file. BACKGROUND: BAtheir meeting of February 19, 1991, the City Council directed staff to initiate two utility undergrounding projects as follows, utilizing Edison Company Rule 20A funding: Prospect Avenue, between First Street and Beneta Way Yorba Street between First Street and Irvine Boulevard DISCUSSION: The process and tentative schedule for forming each of these underground districts are as follows: 4-01-91 - City Council passes Resolution of intention to underground the overhead utilities within the designated District and sets the date and time for a public hearing on said action. 4-02-91 - Mail notice of public hearing to all affected property owners and utility companies. 4-04-91 - Publish Notice of Public Hearing in Tustin News 4-15-91 - City Council holds public hearing and adopts a Resolution approving the formation of the underground utility district. 4-25-91 - Prior to this date staff mails a copy of the above mentioned Resolution approving the subject district to each affected property owner and utility company. This scheduling has been reviewed with the Edison Company and found to be acceptable to their staff. A preliminary review of the Yorba Street project reveals that there are no overhead Edison Company facilities that would require undergrounding. The overhead facilities belong to Pacific Bell and/or Continental Cablevision and it is Staff's interpretation that an Underground District is still valid. Each of the utility companies, Pacific Bell and Continental Cablevision would still be responsible for funding the cost of undergrounding their respective facilities. This issue will be verified with the City Attorney's office and Staff will proceed with the formation of this District only if the costs are borne by the respective utility companies.
