SUBJECT: PACIFIC CENTER EAST PROJECT - GENERAL PLAN AMENDMENT 90-03 (a)
AND (b); ZONE CHANGE 90-04
RECOMMENDATION
It is recommended that the City Council:
1. Adopt Resolution No. 91-21 approving General Plan Amendment
90-03 (a) and 90-03 (b) .
2. Minute Order waive further reading and introduce Ordinance No.
1057 by title only.
3. Instruct the Public Works Department to transmit to the County
of Orange modifications to the County Arterial Highway Plan
approved by General Plan Amendment 90-03(b).
BACKGROUND
The Planning Commission at their regular meeting on January 14,
1991 recommended to the City Council approval of General Plan
Amendments 90-03(a) and 90-03(b) and Zone Change 90-04 related to
the Pacific Center East project. Each action received by the
Planning Commission can more specifically be described as follows:
1. General Plan Amendment 90-03(a) is an amendment to the land
use element of the Tustin General Plan to assign certain
properties within the Pacific Center East project area to the
Planned Community land use designation. Said properties are
presently designated Industrial.
2. General Plan Amendment 90-03(b) is an amendment to the
Circulation Element of the Tustin General Plan to modify the
Arterial Highway Plan as follows:
a. Redesignate a portion of Newport Avenue between the I-5
(Santa Ana) Freeway and Sycamore Avenue from a primary
arterial to a modified major arterial.
b. Redesignate a portion of Newport Avenue from Sycamore
Avenue south to its existing termination from a secondary
arterial to a major arterial and designate a proposed
City Council Report

extension of Newport Avenue south to Valencia Avenue as
a major arterial.
C. Designate a proposed reconfiguration of Del Amo Avenue
from Edinger Avenue to SR -55 (Costa Mesa) Freeway
eastside ramps as a four lane secondary arterial.
These amendments to the Circulation Element were required by
the Final Environmental Impact for the Pacific Center East
project.
3. Zone Change 90-04 is an amendment to the Tustin Zoning Map to
reclassify properties within the Pacific Center East project
area from their existing M (Industrial) District designation
to the PC (Planned Community) District in order to establish
consistency with General Plan Amendment 90-03(a). The
proposed PC zoning would also include adoption by ordinance of
the Pacific Center East Specific Plan as development standards
for the property.
The Pacific Center East project area includes approximately 126
acres located in the southwest portion of the City of Tustin.
Originally planned and zoned to be developed for light industrial
uses, the property currently is developed with approximately
1,090,000 square feet of research and development, light industrial
and office and commercial uses with approximately 48 acres of the
site vacant or in strawberry production. The project area is
surrounded largely by industrial and research and development uses
to the south, the Marine Corps Air Station to the east across Red
Hill, The SR -55 (Costa Mesa) Freeway to the west and the City of
Santa Ana on the west side of the SR -55, and to the north largely
multi -family residential uses and major public and institutional
uses (ie: Currie and Thorman schools, a City maintenance yard and
County Fire Station). The Tustin Meadows residential area is
located northeast of the project area.
The Pacific Center East project is the culmination of three years
of planning efforts by the City of Tustin. There were also between
1983 and 1987 numerous planning studies completed for the project
area evaluating various proposals including additional access and
alternatives for the extension of Newport Avenue and
reconfiguration of the Edinger Avenue/SR-55 northbound (eastside
ramps). Recognizing constraints for development within the project
area, the City also included the Pacific Center East project area

within the South/Central Redevelopment Project in 1985 in an effort
to provide additional development and financing mechanisms for
upgrading the area. More recently in 1987, the City hired the firm
of Phillips, Brandt, Reddick (PBR) to prepare a Specific Plan and
EIR. The development of the project was then accomplished through
an orderly process of data collection, issue analysis, definition
of alternative planning solutions and refinement of the preferred
design concept. Scoping sessions, study sessions and briefing
meetings with the Planning Commission and City Council were held
over the last three years as well as scoping meetings with outside
agencies, interested businesses, and residents to solicit input,
establish direction and reach consensus through a process of plan
revision and refinement. The EIR for the project was completed and
certified as final by the Planning Commission and City Council in
December of 1990. A revised Specific Plan text has been prepared
and is attached. A Development Agreement conditionally binding the
major property owner, Catellus Development, will ultimately be
presented to the Planning Commission and City Council in the
future.
A public hearing notice denoting the time, date and location of
this hearing was published in the Tustin News. The property was
also posted and property owners within the project site and 300
feet adjoining the project site were notified by mail. Although
not required, additional posting along each side of Newport Avenue
on each block was accomplished between the I-5 freeway and the
current termination of Newport Avenue.
DISCUSSION
The overall concept for the Pacific Center East project is intended
to provide a planned development which encourages a variety of
office, commercial, regional and technology uses. The Planned
Community designation proposed for the site is both a land use and
zoning classification. It recognizes that mixed and integrated
uses can be compatible with implementation of specific design
standards. In addition to adopting a Planned Community designation
for the site, provisions of the Tustin City Code and State law
provide a mechanism for concurrent adoption of specific development
regulations and a development plan for the area in the form of a
Specific Plan. The Specific Plan is designed as both a planning
and a regulating tool providing for buildout of the project area.

The Land Use Plan for the Pacific Center East Specific Plan
encourages a variety of office, commercial, regional and technolcgy
uses in four distinct land use categories: Commercial Center,
Regional Center, Office Center and Technology Center. A general
description of each category follows:
The Commercial Center designation provides for freestanding or
commercial uses along the north side of Edinger Avenue.
° The Regional Center designation is formed by the revised
circulation system and provides opportunities for a mix of
land uses including hotels, commercial and office areas for
both daytime and evening activity.
° The Office Center designation provides for professional and
corporate office areas within the Specific Plan area with more
concentrated development and higher building heights
concentrated at the southwesterly corner of the site.
° The Technology Center provides for research and development
uses with supporting office and commercial uses discouraging
intrusion of exclusive office uses in these areas.
At completion, the project would result in an approximate 2.2
million square foot net increase in floor area square footage
within the project area or a total of 3.3 million square feet of
total floor area. The Specific Plan also proposes major
circulation alternatives including the extension of Newport Avenue
to Valencia, the reconfiguration of the eastside SR -55 ramps and
realignment of Del Amo Avenue. The project is anticipated to be
developed in three phases. The amount of permitted development is
based on the sequence of available circulation capacity and
approvals necessary for certain circulation plans from responsible
agencies.
While the extension of Newport Avenue and reconfiguration of the
SR -55 ramps will necessitate removal of some existing uses, other
existing uses within the project area may remain as permitted
subject to certain Specific Plan regulations.
Land use and development regulations contained in the Specific Plan
establish by land use category the maximum authorized square
footages and floor area ratios, permitted uses, minimum building
site area, maximum building heights, minimum building and landscape

setbacks. In addition, regulations provide for requirements for
on-site parking and loading and such items as mechanical equipment,
fences and walls, refuse collection, landscaping and screening, and
child care requirements (where a development project results in a
net minimum increase of 100,000 square feet of floor area). The
child care issue was discussed at length by the Commission. The
background and justifications for child care requirements are
contained in Section 4.8(G) of the Specific Plan.
The implementation/administration section of the Specific Plan
require Planning Commission and Redevelopment Agency approval of
individual development projects within the Specific Plan. While
processing is similar to current procedures utilized in East
Tustin, the South Central Redevelopment Plan does require Agency
approval of the design of development projects.
In conjunction with preparation of the Pacific Center East Specific
Plan, the firm of PBR prepared a comprehensive fiscal impact
analysis of the project through build -out. The analysis projects
a positive impact to the City's annual budget over time (1992 is
the only year that a small deficit of approximately $68,000 is
anticipated). At build -out the project will generate approximately
$169,761 annually to the City's General Fund. The analysis
projects the City to receive $4,335,995 in gross revenues over the
ten year development period and to have expenses of $2,986,792.
This level of operating revenues and expenses also indicates a
surplus of $1,349,203 at build -out.
In addition to recurring fiscal impacts to the City of Tustin
General Fund, 1% of all incremental increases in property value as
a result of development will accrue to the Redevelopment Agency's
South Central Project Area. At build -out, the total potential tax
increment projected is approximately $1,631,026 annually. Of these
revenues, state law will require that 20% or approximately $326,205
be used annually for affordable housing requirements and be set
aside in the City's restricted housing set -a -side fund. This would
leave approximately $1,304,820 net tax increment which the
Redevelopment Agency may utilize to cover portions of required
infrastructure improvement costs within the Project Area. With
direction from the Redevelopment Agency, staff will begin working
on a financing plan for said improvements based on anticipated tax
increment.

CONCLUSION
The Pacific Center East Specific Plan represents countless hours of
staff, consultant, Planning Commission and City Council time over
the last three years. Therefore, it is recommended that the City
Council adopt City Council Resolution No. 91-21 approving the
subject General Plan Amendments and introduce Ordinance No. 1057.

The Planning Commission of the City of Tustin does hereby

resolve as follows:

I. The Planning Commission finds and determines as
follows:

A. Government Code Section 65358 provides that
13
when it is deemed to be in the public
interest, the legislative body may amend a
14
part of the General Plan.

B. An application was filed by the City of Tustin
requesting amendment to the Tustin Area
16
General Plan.
17
C. In accordance with Government Code Section
65353, a public hearing was duly noticed,
18
called, and held on the application by the
Planning Commission on January 14,_.1990, to
19
recommend designation on the General. Plan Land
Use Map certain property as Planned Community
20
as shown on the attached Exhibit A of the
Tustin General Plan and Circulation Element
21
amendments as shown on Exhibit B and more
specifically described as an amendment to the
22
Arterial Highway Plan contained in the
Circulation Element as follows:
23
1. Redesignate a portion of Newport Avenue
24
between the I-5 (Santa Ana) freeway and
Sycamore Avenue from a primary arterial
25
to a modified major arterial requiring
restriping for six lanes and possible
26
removal of on -street parking.

2. Redesignate a portion of Newport Avenue

D. General Plan Amendments 90-03(a) and 90-03(b)

have been reviewed in accordance with the
California Environmental Quality Act and Final

Environmental Impact Report (EIR) 90-01 has
been prepared certified and considered which
10
adequately addresses the general environmental
setting of the proposed _project, its
11
significant environmental impacts and the
project alternatives and mitigation measures
12
related to each significant environmental
effect for the proposed project.
13
All impacts, mitigation measures and project
14
alternatives identified in Final EIR 90-01
have been reviewed and considered, mitigation
15
measures have been 'incorporated into the
proposed project that eliminate or
16
substantially lessen the significant
environmental effects as identified in the EIR
17
and it is determined that ainy remaining
significant effects on the environment found
18
to be unavoidable have been balanced against
the benefits of the project and against the
19
project alternatives and those benefits have
been found to be overriding on each
20
significant impact identified in the EIR.
Findings and a Statement of Facts supporting
21
such findings are comprehensively listed in
Exhibit A of City Council Resolution No. 90-
22
158 which is incorporated herein by reference.
A Statement of Overriding Consideration is
23
contained in Exhibit B of City Council
Resolution No. 90-158 which is incorporated
24
herein by reference; and all mitigation
measures contained in Final EIR 90-1 were
25
adopted with City Council Resolution No. 90-
158 and were automatically incorporated as
26
conditions of approval of subsequent
discretionary actions at the appropriate level
27
of project implementation.

E. General Plan Amendment 90-03(a) and 90-03(b)
are in the best interest of the public and
surrounding property owners based on the
following:
1. The proposed Planned Community land use
designation is consistent with other
elements of the General -Plan.
2. The use of the Planned Community
designation will encourage a variety of
office, commercial, regional and
technology uses and provide a mechanism
for aesthetic integration of development
within the project area while minimizing
impacts on surrounding property owners.
3. Proposed amendments to the circulation
system will support the Pacific Center
East development by providing safe,
efficient vehicular movement within and
around the project site; provide capacity
for other traffic and also provide
traffic relief for other existing city
streets.
F. Proposed amendments to the Circulation Element
shall be submitted to the County of Orange
Environmental Management Agency in order to
amend the Master Plan of Arterial Highways to
reflect the City's amendments.
II. The Planning Commission does hereby recommend to
the City Council the following:
A. That General Plan Amendment 90-03(a) be
approved amending the Land Use Element of the
Tustin Area General Plan for properties within
the Pacific Center East project area as shown
on Exhibit A attached hereto and incorporated
herein by reference.
B. That General Plan Amendment 90-03(b) be
approved amending the Arterial Highway Plan
contained in the Circulation Element of the
Tustin Area General Plan as shown on Exhibit B
attached hereto and incorporated herein by
reference.

CENTER EAST PLAN AS DEVELOPMENT STANDARDS FOR THE

8 The Planning Commission of the City of Tustin does hereby resolve
as follows:

I. The Planning Commission finds and determines as follows:

A. An application was filed by the City pf Tustin requesting
11 amendment of the Zoning Map and adoption of a Specific
Plan for property shown on Exhibit A attached hereto and
12 incorporated herein by reference and generally bounded by
Red Hill Avenue on the east, Valencia Avenue on the
13 south, the SR -55 (Costa Mesa) freeway on the west and an
Orange County Flood Control Channel on the north parallel
-14 to and just directly north of Edinger Avenue.
i5 B. That a comprehensive planning study covering the subject
property was commissioned and completed.

C. That as a result of the planning study, the Planned
17 Community zoning designation for the property is desired
and a Specific Plan was prepared as the development
18 standards for the property in accordance with Section
65450 et seq. of the California Government Code. The
19 Specific Plan is detailed in Exhibit B -attached hereto
and incorporated herein by reference.

D. A public hearing was duly noticed, called, and held on
21 the application by the Planning Commission on January 14,
1991.

E. Zone Change 90-04 has been reviewed in accordance with
23 the California Environmental Quality Act and Final
Environmental Impact Report (EIR) 90-01 has been
24 prepared, certified and considered which adequately
addresses the general environmental setting of the
25 proposed project, its significant environmental impacts
and the project alternatives and mitigation measures
26 related to each significant environmental effect for the
proposed project.

those benefits have been found to be overriding on each
significant impact identified in the EIR. Findings are
7
comprehensively listed in Exhibit A of City Council
Resolution No. 90-158 which is incorporated herein by
8
reference. A Statement of Overriding Consideration is
contained in Exhibit B of City Council Resolution No. 90-
9
158 which is incorporated herein by reference; and all
mitigation measures contained in Final EIR 90-1 were
10
adopted with City Council Resolution No. 90-158 and are
automatically incorporated as condi:tions*of approval at
11
subsequent discretionary actions at'the appropriate level
of project implementation.

F. That a Zone Change should be granted for the following
13
reasons:

1. The proposed Planned Community Zoning District is
consistent with all elements of the General Plan
15
and in particular, the Land Use Element which is
being -concurrently amended.
16
2. The proposed rezoning of the property to Planned
17
Community and adoption of the Specific Plan will
allow for compatible uses and orderly development
18
of the subject properties. Said zone will not be
detrimental to the health, safety, morals, comfort
19
or general welfare of persons residing or working
in the neighborhood since the Planned Community
20
zoning designation and the Specific Plan document
establish development standards which ensure land
21
use compatibility between existing and adjacent
uses.
22
3. Reasonable alternatives to the project and their
23
implications have been considered.
24
4. The scope and depth of planning analysis for the
Zone Change was commensurate with the level of
25
detail contained in the Specific Plan and the
specificity of land use entitlement its adoption
26
will authorize.

5. The Zone Change including various components of the
Specific Plan as well as the Specific Plan in its
28
Resolution No. 2872

entirety are sensitive to the environmental and
3 public policy impacts of the proposed development.
4 6. Administration of the Specific Plan is thoroughly
integrated into the City's development processing
5 system.
6 7. All subjects required in a -Specific Plan by the
California Government Code and applicable City
7 ordinances are appropriately and adequately
covered.

II. The Planning Commission hereby recommends to the City Council
9 that Zone Change 90-04 be approved to rezone property within
the Pacific Center East project area to Planned Community ( PC)
10 as shown on Exhibit A incorporated herein by reference and
recommends that the Pacific Center East Specific Plan as shown
11 in Exhibit B incorporated herein by reference be approved as
the Planned Community regulations for the Pacific Center East
12 project area and that the Pacific Center East Specific Plan be
adopted by Ordinance of the City Council.

The City Council of the City of Tustin does hereby
resolve as follows:
I. The City Council finds and determines as follows:
A. Government Code Section 65358 provides that
when it is deemed to be in the public
interest, the legislative body may amend a
part of the General Plan.
B. An application was filed by the City of Tustin
requesting amendment to the Tustin Area
General Plan.
C. The Planning Commission at a regular meeting
on January 14, 1991 held a public hearing and
recommended to the City Council approval of
General Plan Amendments 90-03(a) and (b).
D. In accordance with Government Code Section
65353, a public hearing was duly noticed,
called, and held on the application by the
City Council on February 4, 1991, to recommend
designation on the General Plan Land Use Map
certain property as Planned Community as shown
on the attached Exhibit A of the Tustin
General Plan and Circulation Element
amendments as shown on Exhibit B and more
specifically described as an amendment to the
Arterial Highway Plan contained in the
Circulation Element as follows:
1. Redesignate a portion of Newport Avenue
between the I-5 (Santa Ana) freeway and
Sycamore Avenue from a primary arterial
to a modified major arterial.

2. Redesignate a portion of Newport Avenue
from Sycamore Avenue south to its
existing termination from a secondary
arterial to a major arterial and
designate a proposed extension of Newport
Avenue south to Valencia Avenue as a
major arterial.
3. Designate a proposed reconfiguration of
Del Amo Avenue from Edinger Avenue to SR -
55 (Costa Mesa) Freeway eastside ramps as
a four lane secondary arterial.
E. General Plan Amendments 90-03(a) and 90-03(b)
have been reviewed in accordance with the
California Environmental Quality Act and Final
Environmental Impact Report (EIR) 90-01 has
been prepared certified and considered which
adequately addresses the general environmental
setting of the proposed project, its
significant environmental impacts and the
project alternatives and mitigation measures
related to each significant environmental
effect for the proposed project.
All impacts, mitigation measures and project
alternatives identified in Final EIR 90-01
have been reviewed and considered, mitigation
measures have been incorporated into the
proposed project that eliminate or
substantially lessen the significant
environmental effects as identified in the EIR
and it is determined that any remaining
significant effects on the environment found
to be unavoidable have been balanced against
the benefits of the project and against the
project alternatives and those benefits have
been found to be overriding on each
significant impact identified in the EIR.
Findings and a Statement of Facts supporting
such findings are comprehensively listed in
Exhibit A of City Council Resolution No. 90-
158 which is incorporated herein by reference.
A Statement of Overriding Consideration is
contained in Exhibit B of City Council
Resolution No. 90-158 which is incorporated
herein by reference; and all mitigation

measures contained in Final EIR 90-1 were
adopted with City Council Resolution No. 90-
158 and were automatically incorporated as
conditions of approval of subsequent
discretionary actions at the appropriate level
of project implementation.
F. General Plan Amendment 90-03(a) and 90-03(b)
are in the best interest of the public and
surrounding property owners based on the
following:
1. The proposed Planned Community land use
designation is consistent with other
elements of the General Plan.
2. The use of the Planned Community
designation will encourage a variety of
office, commercial, regional and
technology uses and provide a mechanism
for aesthetic integration of development
within the project area while minimizing
impacts on surrounding property owners.
3. Proposed amendments to the circulation
system will support the Pacific Center
East development by providing safe,
efficient vehicular movement within and
around the project site; provide capacity
for other traffic and also provide
traffic relief for other existing city
streets.
G. Proposed amendments to the Circulation Element
shall be submitted to the County of Orange
Environmental Management Agency in order to
amend the Master Plan of Arterial Highways to
reflect the City's amendments.
II. The City Council does hereby approve the following:
A. General Plan Amendment 90-03(a) amending the
Land Use Element of the Tustin Area General
Plan for properties within the Pacific Center
East project area as shown on Exhibit A
attached hereto and incorporated herein by
reference.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE
90-04, AN AMENDMENT TO THE TUSTIN ZONING MAP
TO RECLASSIFY CERTAIN PROPERTIES WITHIN THE
PACIFIC CENTER EAST PROJECT AREA FROM THEIR
EXISTING M (INDUSTRIAL) DISTRICT IN ORDER TO
ESTABLISH CONSISTENCY WITH GENERAL PLAN
AMENDMENT 90-03(a). THE PROPOSED REZONING
ALSO INCLUDES ADOPTION OF THE PACIFIC CENTER
EAST PLAN AS DEVELOPMENT STANDARDS FOR THE
PROPERTY.
The City Council of the City of Tustin does hereby
resolve as follows:
I. The City Council finds and determines as follows:
A. An application was filed by the City of Tustin
requesting amendment of the Zoning Map and
adoption of a Specific Plan for property shown
on Exhibit A attached hereto and incorporated
herein by reference and generally bounded by
Red Hill Avenue on the east, Valencia Avenue
on the south, the SR -55 (Costa Mesa) freeway
on the west and an Orange County Flood Control
Channel on the north parallel to and just
directly north of Edinger Avenue.
B. That a comprehensive planning study covering
the subject property was commissioned and
completed.
C. That as a result of the planning study, the
Planned Community zoning designation for the
property is desired and a Specific Plan was
prepared as the development standards for the
property in accordance with Section 65450 et
seq. of the California Government Code. The
Specific Plan is detailed in Exhibit B
attached hereto and incorporated herein by
reference.
D. The Planning Commission at a regular meeting
on January 14, 1991 held a public hearing and
recommended Zone Change 90-04 including
adoption of the Pacific Center East Specific
Plan as the development standards for the
subject site.
E. A public hearing was duly noticed, called, and
held on the application by the City Council on
February 4, 1991.

F. Zone Change 90-04 has been reviewed in
accordance with the California Environmental
Quality Act and Final Environmental Impact
Report (EIR) 90-01 has been prepared,
certified and considered which adequately
addresses the general environmental setting of
the proposed project, its significant
environmental impacts and the project
alternatives and mitigation measures related
to each significant environmental effect for
the proposed project.

following reasons:
1. The proposed Planned Community Zoning
District is consistent with all elements
of the General Plan and in particular,

the Land Use Element which is being
concurrently amended.
2. The proposed rezoning of the property to
Planned Community and adoption of the
Specific Plan will allow for compatible
uses and orderly development of the
subject properties. Said zone will not
be detrimental to the health, safety,
morals, comfort or general welfare of
persons residing or working in the
neighborhood since the Planned Community
zoning designation and the Specific Plan
document establish development standards
which ensure land use compatibility
between existing and adjacent uses.
3. Reasonable alternatives to the project
and their implications have been
considered.
4. The scope and depth of planning analysis
for the Zone Change was commensurate with
the level of detail contained in the
Specific Plan and the specificity of land
use entitlement its adoption will
authorize.
5.
The Zone Change including various
components of the Specific Plan as well
as the Specific Plan in its entirety are
sensitive to the environmental and public
policy impacts of the proposed
development.
6.
Administration of the Specific Plan is
thoroughly integrated into the City's
development processing system.
7.
All subjects required in a Specific Plan
by the California Government Code and
applicable City ordinances are
appropriately and adequately covered.
II. The City
Council hereby approves Zone Change 90-04
rezoning
property within the Pacific Center East
project
area to Planned Community (PC) as shown on

Exhibit A incorporated herein by reference and
adopts the Pacific Center East Specific Plan as the
