SUBJECT:VACATION AND ABANDONMENT OF A PORTION OF AUTO CENTER DRIVE
RECOMMENDATION:
It is recommended that the City Council, at their meeting of
February 41 1991, pass and adopt the attached Resolution
declaring the City's intention to vacate and abandon a portion
of Auto Center Drive and setting a time and place of public
hearing thereon.
BACKGROUND:
The original dedication of Auto Center Drive terminated in a
cul-de-sac at the westerly edge of the old retention basin and
adjacent to Parcels 6 and 7 of Parcel Map No. 84-1032.
The retention basin has since been filled in and Auto Center
Drive was extended approximately two hundred feet easterly to a
new cul-de-sac. The original cul-de-sac was realigned by the
installation of new curb and gutter and sidewalk that are
parallel with the centerline of the street, which resulted in
excess right-of-way adjacent to parcels 6 and 7.
The following is an anticipated schedule for this abandonment
procedure:
February 4, 1991 - City council adopts attached Resolution
declaring intent and setting date for public
hearing.
February 51 1991 - All affected utilities notified.
February 13, 1991 - Resolution of intent published in the
Tustin News.
February 18, 1991 - Property posted.
March 4, 1991 - City Clerk holds public hearing and pending
results, City Council adopts resolution
ordering vacation.
March 5, 1991 - City Clerk causes document to be recorded.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND ABANDON
A PORTION OF AUTO CENTER DRIVE ADJACENT TO PARCELS 6
AND 7 OF PARCEL MAP 84-1032 AS PER MAP FILLED IN BOOK
200, PAGES 19 THROUGH 24 INCLUSIVE OF PARCEL MAPS,
RECORDS OF ORANGE COUNTY, CALIFORNIA AND TO FIX A
TIME AND PLACE OF PUBLIC HEARING THEREON.
WHEREAS, the original dedication of Auto Center Drive
terminated in a cul-de-sac adjacent to Parcels 6 and 7 of
Parcel Map 84-1032; and
WHEREAS, Auto Center Drive has been extended
approximately two hundred feet easterly to a new cul-de-sac;
and
WHEREAS, the original cul-de-sac has been realigned by
the installation of new curb and gutter and sidewalk that are
parallel with the center line of the street;
NOW THEREFORE, the City Council of the City of Tustin
does hereby resolve as follows:
1. It is the intention of the City Council to vacate a
portion of Auto Center Drive adjacent to Parcels 6
and 7 of Parcel Map 84-1032 as described in Exhibits
"A" and shown on Exhibits "B" attached hereto and
incorporated herein by this reference and on file in
the office of the City Clerk, and
2. To make a finding that the two portions of the
original cul-de-sac are unnecessary for present or
prospective public street purposes, and
3. To reserve easements per Section 8330 of the
Streets and Highways Code.
4. The project is categorically exempt from
Environmental Impact Report requirements.
5. A public hearing is hereby set for March 4, 1991,
at 7:00 p.m., in the Chambers of the City Council
at 300 Centennial Way, Tustin, California for a
hearing of all persons interested in, or objecting
to, the proposed vacation.

6. This resolution shall be published once in the
Tustin News, a newspaper of general circulation
published in the City of Tustin, not less than
fifteen (15) days before said hearing and notice
of said hearing shall be posted conspicuously along
the line of those portions of Auto Center Drive
proposed to be vacated not less than ten (10) days
before said hearing, and not more than three hundred
feet (3001) apart and not less than three (3) copies
shall be posted.
7. The City elects to proceed under the provisions
Chapter 2 , Part 3 , Division 9 ( Section 8 3 2 0 , et. seq . )
of the California Streets and Highways Code.
PASSED AND ADOPTED at a regular meeting of the City
Council, held on the 4th day of February, 1991.

inclusive of Parcel Maps, Records of Orange County, California,
described as follows:
Beginning at the most southerly terminus of that course that bears
North 400 39' 26" East and having a distance of 353.45 feet as
shown on said parcel map; thence northeasterly along said course a
distance of 34.31 feet to the point of intersection with a curve
concave northeasterly and having a radius of 1165.00 feet, a
radial line to said point bears North 39058' 08" East; thence
northwesterly along said curve through a central angle of 00 33'
43" an arc distance of 11.42 feet to a point on the existing
northeasterly right-of-way line of Auto Center Drive and also
being the true point of beginning of the parcel to be described,
