HUSTON, CITY MANAGER OLD BUSINESS NO. 1 2-4-91 Inter- Com FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: SIDEWALK CONSTRUCTION AT 15602 MOSHER AVENUE RECOMMENDATION: That the Tustin City Council approve the request for waiver for sidewalk construction at 15602 Mosher Avenue subject to the following: 1. Execution of an irrevocable dedication for required right-of-way. 2. Execution and recordation of an agreement to construct sidewalks. BACKGROUND: - At the City Council meeting of January 21, 1991, the tenant/ developer at 15602 Mosher Avenue, GMFanuc Robotics requested a waiver to the required sidewalk construction at this time. This waiver proposed four alternatives as follows: 1. If/when future traffic increases to more than 500 vehicles per day, sidewalks will be constructed. 2. Deed the Mosher Avenue and Morgan Circle property to the City of Tustin for future use. 3. If sidewalks must be put in, allow us to put a sidewalk on Mosher Avenue only and deed the Morgan Circle property to the City of Tustin for future use. 4. Construct sidewalks if/when adjacent properties construct sidewalks. GMFanuc Robotics has been granted a building permit to proceed with the building improvements and have scheduled a move -in or occupancy date of Monday, February 18, 1991. Staff was directed to return the February 4th City Council meeting with a plan consisting of one of the four above mentioned alternatives that would be acceptable to both GMFanuc Robotics and the City. DISCUSSION: The following plan is proposed to ensure the future construction of sidewalks adjacent to the property a 15602 Mosher Avenue at the time they are needed and in the interim allow GMFanuc Robotics the opportunity to proceed with their building improvements and scheduled occupancy date of February 18, 1991: 1. Property owner shall execute an irrevocable offer of dedication for the required right-of-way along both Mosher Avenue and Morgan Circle frontages of the subject property, for purpose of sidewalk construction prior to the date of occupancy. 2. Execution and recordation of an agreement to construct the required sidewalks by GMFanuc Robotics and the property owner. Agreement to contain a termination clause that would no longer require sidewalk construction after the date that GMFanuc Robotics no longer occupies the premises under their current or future leases. 3. Construction of sidewalks adjacent to 15602 Mosher Avenue would be implemented only if any of the following should occur: a. Sidewalks are constructed on at least 50% of the remaining portion of Mosher Avenue between Valencia Avenue and Bell Avenue. b. Substantial increase in pedestrian activity utilizing the travel roadway of Mosher Avenue between Valencia Avenue and Bell Avenue. Bob Le endecker Director of Public Works/City Engineer BL:ccg
