HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT DESIGN REVIEW 89-69 RECOMMENDATION RDA N0. 5 2-4-91 Inter - Com It is recommended that the Community Redevelopment Agency adopt Resolution No. RDA 91-3, approving Design Review 89-69. BACKGROUND On January 28, 1991, the Planning Commission adopted Resolution No. 2873 approving Amendment #1 to Conditional Use Permit 85-26 authorizing the construction of a 1,487 square foot expansion providing an additional 62 seats for an existing restaurant, Chelsea's Cafe, located at 1481 Edinger Avenue. The subject restaurant is part of the Resco Redevelopment project approved by the Community Redevelopment Agency on April 15, 1985, which also included the construction of two R&D buildings totalling approximately 62,000 square feet. The subject site is zoned M (Industrial) and a restaurant use is subject to Conditional Use Permit approval which the Planning Commission granted. However, the subject site is located in the South -Central Redevelopment Area; therefore, the Design Review approval is the responsibility of the Community Redevelopment Agency. DISCUSSION The submitted plans propose the construction of an additional 11487 square feet of floor area of which 1,236 square feet will accommodate 62 additional seats while the other 251 square feet will enclose a portion of the restaurant's entry. The applicant proposes few alterations to the site layout as the expansion area is limited to that portion immediately adjacent to the restaurant's northeast elevation on Red Hill Avenue which is currently maintained as a landscaped/patio area. The expansion will not alter the parking lot area nor increase the need for additional parking. RDA 91-3 February 4, 1991 Page 2 The submitted plans propose to continue the use of the Tudor style of architecture by incorporating the use of the same materials and architectural embellishments. This is most evident in the use of cultured stone and cultured brick veneer on the wall elevation, the use of mullions on the casement bay windows capped with a copper - seamed roof material and the use of overlapping gables. Consequently, staff and the Planning Commission are supportive of the applicant's proposal, finding that the proposal is compatible with the existing style of architecture. CONCLUSION Based upon the above analysis and recommendation of the Planning Commission it is recommended that the Community Redevelopment Agency adopt Resolution No. RDA 91-3 approving Design Review 89-69, subject to the conditions contained in Exhibit A of Planning Commission Resolution No. 2873 L� l � -Aiue E. The Planning Commission finds and determines as follows: , A. That a proper application, (Amendment #1 to Conditional Use Permit 85-26 and Design Review 89-69) has been filed on behalf of Camelot Restaurants, Inc. to construct a 1,487 square foot expansion to accommodate- 62 additional seats on the property located at 1481 Edinger w Avenue B. A public hearing was duly called, noticed and held for said application on January 28, 19 91. C. The project has been determined to be Categorically Exempt .(Class 3) pursuant to Section 15301 of the California Environmental Quality Act. - D. That the establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use nor be a detriment to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin as evidenced by the following findings: 1. The expansion proposes additional restaurant seating of which adequate on- site parking is provided pursuant to the requirements of the Tustin City Code. 2. The revised restaurant elevations reflect the existing materials and architectural style thereby minimizing the impact of the expansion's appearance. II. The Planning Commission hereby approves Conditional Use Permit No. 85-26 to authorize -the construction of a 1,427 square foot expansion to accommodate 62 additional seats for a total of 228 seats on the property located at 1481 Edinger Avenue, subject,to the conditions contained in Exhibit A, attached hereto. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 28th day of January, 1991. -J DONALD LE JEUNE Chairman KATHLEEN CLANCY Secretary EXHIBIT A AMENDMENT #1 TO CONDITIONAL USE PERMIT 85-26 AND DESIGN REVIEW 89-69 CONDITIONS OF APPROVAL RESOLUTION NO. 2873 GENERAL (1) 1.1 The proposed 'project shall substantially conform with the submitted plans for the project date stamped January 28, 1991 on file with the Community Development Department, as herein modified, or as modified by the Redevelopment Agency in accordance with this Exhibit. , (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval. by the Community Development Department. R (1) 1.3 This Conditional Use Permit Amendment approval shall become null and void unless all permits are issued for the proposed expansion within eighteen (18) months of the date of final Redevelopment Agency approval of the design of said project and substantial construction is underway. (1) 1.4 Approval of Amendment 11 to Conditional Use Permit 85-26 and Design Review 89-69 is contingent upon the applicant signing and returning- an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The approval of Amendment #1 to Conditional Use Permit 85-26 is contingent upon ultimate approval of Design Review 89-69 by the Tustin Community Redevelopment Agency. The Planning Commission's Conditional Use Permit approval shall become null and void should the Redevelopment Agency not approve the subject project. (1) 1.6 All original conditions of approval stated in Conditional Use Permit 85-26 shall remain in effect relative to the original construction of the project. Requirements -of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building official. (4 ) 2.2 At building plan check submittal, it should be noted that any new installation of roof-toop equipment will be required to be screeded utilizing architecturally compatable treatments.(not just a raised parapet). (3) "2.3 Prior_ to the issuance of any building permits, water improvement plans -shall be submitted to and approved by the Fire Chief for adequate fire protection and financial security posted for the installation. The adequate and reliability of water system design, location of valves, and the distribution of fire hydrants will be evaluated and approved by the Chief (3) 2.4 Prior to the issuance of any building permits for combustible construction, evidence that a water supply for fire protection is available shall be submitted to and approved by the Fire Chief. Fire hydrants and access roads shall be in place and operational to meet requirements and fire -flow prior to commencing combustible materials. (3) 2.5 Prior to the issuance of any building permits, all alterations to piping for automatic fire extinguishing systems shall be approved. Plans for an automatic fire extinguishing system shall be approved by the Fire Chief prior to installation. Such systems shall be operational prior to the issuance of a certificate of use and occupancy. (5) 2.6 Proposed window details on the east and north elevations shall be consistent with the window treatment on the east and south elevations or existing windows shall be modified to match proposed window treatment. Exhibit A Resolution No. 2873 Page 3 LANDSCAPING, GROUNDS AND HARDSCAPE (1) 3.1 Submit at plan check, complete detailed landscaping and irrigation plans for all altered landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide a summary table applying indexing identification to plant materials in their actual location._ The plan and table shall list botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. FEES (1) 4.1 Prior to the issuance of any building permits,•payment shall be made of.all required fees including, but not limited to: A. Major thoroughfare and bridge fees to Tustin Public Works Department. B. Orange County Sanitation District No. 7 fees to the Sanitation District. C. East Orange County Water District Fees to the Water District. D. New development fees to the Community Development Department. E. All applicable plan check and building permit fees to the Community Development Department. F. School Facilities Fees to the Tustin Unified School District. G. RDA 91-3 A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA APPROVING DESIGN REVIEW 89-69 FOR THE EXPANSION OF THE RESTAURANT LOCATED AT 1481 EDINGER AVENUE. The Community Redevelopment Agency of the City of Tustin does hereby resolve as follows: I. The Redevelopment Agency finds and determines as follows: A. That a proper application (Design Review 89-69) has been filed on behalf of Camelot Restaurants, Inc. requesting approval of the expansion of an existing restaurant located at 1481 Edinger. B. A public hearing before the Planning Commission was duly called, noticed and held on January 28, 1991, approving Amendment #1 to Conditional Use Permit 85-26. C. Pursuant to Section 9272 of the Tustin Municipal Code, the Redevelopment Agency finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Community Redevelopment Agency has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. 5. Towers, roof structures, doors and windows. 6. Landscaping, parking area design and traffic circulation. 7. Location, height and standards of exterior illumination. 8. Location and method of refuse storage. 9. Relationship of proposed structures to existing adjacent uses. 10. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood. 11. Proposed signing. 12. The Redevelopment Agency conditionally approves Design Review No. 89-69 authorizing the expansion of the subject restaurant subject to all conditions contained in Exhibit A of the attached Planning Commission Resolution No. 2873.
