HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL TRACT MAP NO. 13824 CONSENT.CALENDAR NO. 17 1-21-91 Inter - Com RECOMMENDATION It is recommended that the City Council approve Final Tract Map 13824 by the adoption of Resolution No. 91-6, as submitted or revised. BACKGROUND AND SUMMARY The Planning Commission at their meeting of January 14, 1991 recommended to the City Council approval of Final Map 13824. The proposed subdivision will create 8 numbered and 3 lettered lots to accommodate construction of 317 multiple family units. The City Council previously approved Vesting Tentative Tract Map 13824 at a meeting on February 5, 1990. k The project is bordered by Champion Way and Lot 22 on the north, Jamboree Road to the east and the Tustin Ranch Golf Course to the south and west. Anticipated development in the vicinity includes 306 apartment/condominium dwelling units on Lot 22 to the north. CONCLUSION The Vesting Tentative Map approved for this project included various conditions of approval which required adjustments to the map. All of the required revisions are reflected upon the Final Map and the required conditions of approval have been met. It has been determined that the Final Map is in conformance with the Vesting Tentative Map approval, requirements of the East Tustin Specific Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act. Based upon City Council Report Final Tract Map No. 13824 January 21, 1991 Page 2 this conformance, it is recommended that the City Council adopt Resolution No. 91-6, approving Final Map 13824. The City Council finds and determines as follows: A. That Final Tract Map No. 13824 has been submitted by Regis Contractors, Inc. to subdivide 14.46 acres into (eight) 8 numbered and three (3) lettered lots to accommodate 317 multiple family dwelling units. B. That a public hearing was held by the Planning Commission on December 11, 1989. At that hearing, the Planning Commission recommended approval of Vesting Tentative Tract Map 13824 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 13824 on February 5, 1990. . C. That the Planning Commission at its meeting of January 14, 1991 recommended to the City Council approval of Final Tract Map 13824. D. The Final Map is considered ministerially exempt pursuant to Section 15268(B) of the California Environmental Quality Act. E. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of single family dwellings. F. The 2.09 acres of parkland required for this development was previously dedicated with recordation of Tract 12870. G. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 13824 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. 1 3 4 5 G 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 91-6 Page 2 H. That the site is physically suitable for the type of development proposed. I. That the site is physically suitable for the proposed density of development. J. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at - large, for access through or use of the property within the proposed subdivision. L. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. M. That the Final Map is in substantial conformance with the Vesting Tentative Map. II. The City Council hereby approves Final Tract Map No. 13824, subject to final approval of City Engineer.
