HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: REQUEST FOR WAIVER FOR SIDEWALK CONSTRUCTION AT 15602 MOSHER AVENUE RECOMMENDATION: That the Tustin City Council deny the request of G.M.F. Robotics for relief from sidewalk construction adjacent to their project at 15602 Mosher Avenue. BACKGROUND: In January, 1987, the City Council at the recommendation of the Planning Commission, adopted a policy to require sidewalk construction within the public right-of-way on all new developments or upgrades of existing facilities within the industrial zoned areas in the City. Prior to that date sidewalk construction was not required in an industrial zoned area unless a specialized use was developed which required said sidewalks. The sidewalk requirements were implemented as a result of increased pedestrian activity due to an increase of the work force utilizing public transportation services and the development of support retail services such as restaurant establishments within the industrial areas. The subject property of 15602 Mosher Avenue is located at the southeasterly corner of Mosher Avenue and Morgan Circle and was developed as Lot No. 4 of Tract No. 7721 in late 1974. Sidewalks were not required at that time and the overall street rights-of-way were developed with a three foot wide parkway as measured from the curbface. Additional dedication of street right-of-way will be required to construct the required sidewalk. The area of required dedication for sidewalk purposes are currently landscaped with turf, shrubbery and mature trees. These landscaped improvements will require removal and/or modification to construct the sidewalk. The requested sidewalk improvements would be five foot wide as measured from the curbface except in the vicinity of fire hydrants and street lights where it will require a wider width to provide clear access around these facilities. DISCUSSION: The existing structure of 15602 Mosher Avenue is being remodeled by the new tenants G.M.F. Robotics and as a result of this work the project was conditioned to construct sidewalk improvements along both street frontages per previous City Council direction of January, 1987. The attached letter/petition dated December 19, 1990 requests that the City Council grant relief from the above mentioned sidewalk construction requirement. Since January, 1987 all developments in both industrial areas of the City have been required to install sidewalks either with the new development or with the rehabilitation/tenant improvements. The sidewalk installations at this time may be isolated or non- contiguous to other sidewalks, but the intended end result is to provide a safe area for pedestrian use and to keep them out of the traveled roadway. Staff suggests that the request for relief from sidewalk construction be denied and would offer the following process be implemented so that G.M.F. Robotics could be issued a building permit to help meet their February 1st move in date: a. G.M.F. Robotics/property owner execute an irrevocable offer of dedication for the required public right-of- way for the sidewalk construction. b. G.M.F. Robotics/property owner post a cash deposit with the City to insure the completion of the sidewalk construction. The completion of these two items would allow immediate issuance of the building permit and use of the property by the requesting party and would also ensure that the public improvements could be completed at no cost to the City. The purpose will be to petition for relief from the sidewalk requirement inacted by the City Council on January 19, 1987. We believe that this requirement is not appropriate for our facility. Background information and justification: 1. Design review documents were submitted on October 25, 1990. Conditions of Approval, Design Review 90-46 was received on November 13, 1990. No requirement for sidewalks was listed. 2. Plan check documents were submitted on November 15, 1990 incorporating the design review conditions. 3. Plan check documents for revision were received from planning, fire and building on December 4, 1990. Engineering comments including the sidewalk requirement were received on December 17, 1990. 4. Our facility at 15602 Mosher Avenue is in an industrial area and there does not appear to be any significant retail activity in close proximity. 5. No other facility along Mosher Avenue between Valencia and Bell, nor Morgan Circle has any sidewalks. We would be the only facility with sidewalks and we are located in the middle of the block. Based on 5 and 6 above, it is doubtful that the sidewalk would be used at any time nor would it provide any benefit in this location. 7. To comply with this request will require the removal of trees, shrubs and other landscaping followed by relandscaping and the relocating of at least a sprinkler riser located next to the street.
