It is recommended that the City Council adopt Resolution No. 89-14 declaring the
property at 13662 Green Valley a public nuisance and authorize the City Attorney
to file legal action against the property owner compelling them to complete all
work and maintain the property.
BACKGROUND

The City Council at their regular meeting on January 3rd adopted Resolution No.
89-4 declaring their intention, to conduct a public hearing to ascertain whether
conditions on the property at 13662 Green Valley constituted a public nuisance
{see attached staff .report, resolution and other corresponcence). Conditions
noticed as constituting the presence of potential public nuisance included the
following:
1. The property has a pool filled with water and the property-
is unprotected by required fencing and gates, Uniform
Swimming Pool Code, Section 320.

Work' has continued under expired permits issued by the
Building Division, UAC, Section 303(d).

Work has progressed without required inspections per the
Building Codes, UAC, Section 305 (a), (b), (d) and (e).
e
Additional work has taken place upon the property without
obtaining required approval and permits, UAC, Section 301 {a).

The property in question has had on-going construction activity since July of
1987. The last requested inspection was performed in October, 1987.
Subsequently, all active building permits have expired and work was at a state of
abandonment when the first Notice and Order was issued in February, 1988 (see
attached Notice and Order). Prior to the Notice and Order, citations were left at
the property requiring immediate action on the pool fence and asking that the
owner contact the Building Division on the status of the job. No response was
recorded. On February 5, 1988, the Building Official and a police officer cited
the property owner in person for the lack of adequate pool fence. After issuance
of the citation a make-shift fence was erected.
On November 14, 1988 a second Notice and Order was issued because the property,
again, was unfenced and construction activity had continued without benefit of
permits and inspections. The residence was still unfinished and the property
owner had not contacted the Building Division on any of the previously cited items
on earlier notices. All work under current building permits had also expired.
Ret nspectt on of the subject property on January 26, 1989 revealed that there had
been very little work completed to eliminate the above noted conditions.
Specifically, the Departments inspection revea, led the following'

Attached is Resolution No. 89-14 which would declare the subject property a public
nuisance and require completion of all work and elimination of nuisance which
constitute conditions that endanger the life, limb, health, property and welfare
to both the surrounding public and the occupants of this property within 30 days.
If within 30 days, the property does not abate nuisance conditions, the City would
be authorized to take appropriate actions to attain compliance including
completion of work and recovery of any City incurred costs to correct work.
Staff would recommend that the City Council authorize the City Attorney to file a
legal action against the property owner compelling them to complete all remaining
work and maintain the property in a safe and neat manner. If not complied with,
said owner would then be in contempt of court and thus be punishable by
imprisonment and/or fines under the law.

TUSTIN, CALIFORNIA, DECLARING THAT CONDITIONS ON THE
PROPERTY LOCATED AT- 13662 GREEN VALLEY (AP#
500-082-07) CONSTITUTE A PUBLIC NUISANCE
The City Council of the City of Tustln hereby resolves as follows:
I. The City Council hereby finds and determines the following:
That pursuant to Section 5500 et. seq. of the Tustin City Code,
the City of Tustln has filed Notice and Orders on the property at
13662 Green Valley on the following dates - 2/5/88 and 11/14/88
indicating the presence of multtple violations and non-compliance
wi th City Codes.
B. That the property owner has not corrected said violations and a
public hearing was duly noticed and held on February 6, 1989 at
the City Council Chambers in the City of Tustin.
That the existing exterior conditions of the property which
constitute a public nutsance include the following:

II. The City Council hereby declares that the condition of the property at
13662 Green Valley (AP# 500-082-07) constitutes a public nuisance and
'also finds that the following corrective actions must be completed by
the property owner.
A. The methods of abatement are as follows:

BACKGROUNO

0ve'r the past nineteen months, the Community Development Department has attempted to
work wtth the property owner of the subject property to secure the stngle fanflly
premtses from trespasser, s and to aesthetically clean up the general appearance of the
property tn relatlon to 1ts surroundings. The property Js located tn an area mtxed
with both single and multtple famtly dwellings.
In an effort to abate the conditions, numerous notices and one cttatfon along wtth two
Nottce and Orders were t ssued to Mr. and Mrs. Grobe who own the property-. Copt es of
the correspondence are attached to thts report for reference and provide examples as to
the history of code enforcement acttons taken by the Community Development 0epartment.
In response to the most Important violation whtch requtres pool fenctng, Notlce and
Orders requested that thls violation be corrected Immediately for safety reasons. To
date, no such actton has been taken by the property' owner. As for the other
conditions, only a ptle of trash has been removed from the front yard. According to
the Nutsance Abatement Regulations ($ectton 5500 et. seq.) In the Tusttn Municipal
Code, a formal resolution must be approved by the Counctl to tntttate abatement
proceedings. Thts resolution ts for the purposes of describing the violations on the
property, 11sttng the requtred acttons needed to remove the stated violations and to
declare the Ctty's tntent to hold a publlc heartng to formally declare the property a
pub 1~ c nut sance.

to Mr. Grobe to request compliance. As of December 23, 1988 the property remains in
violation of the City Code for the following reasons:

Property not protected by fence and gates for body of water located in rear yard.
(TCC 8501; Sec. 320)

Construction continuing on property without required inspections. (UAC Sec. 305)
Work being performed on property with expired permits (UAC Sec. 303 d.)
4. Work being performed on property without required permits. (UAC Sec 301 a.)
5. Dead and mt sslng landscaping in front yard. (TCC Sec. 5501 (9) e)
No landing steps at front porch. (UBC Sec. 3304 h)
7. Exterior treatments do not match and unpainted surfaces.
Since abatement has not been achieved, staff has reviewed the City Code' in reference to
public nuisance abatement procedures. Once code enforcement action has been
unsuccessful at the staff level, formal action must be taken by the City Council.
Under the current provisions, the following actions should be taken in sequence and
according to the methods prescribed by the City Code and State law:

Approval of a resolution which states the Ctty's tntent to hold a publlc hearing
to declare satd property as a publlc nuisance.
.
Certified delivery of notice to property owner within 30 days of approval of the
resolution, but at least ten days prior to the date of the public hearing.

The approved resolution is posted on said property at least ten days prior to the
pub11 c hearing.

The intended public hearing is held for the Council's consideration of all
testimony and evidence and the Council declares whether or not the property is a
public nuisance, the Council then passes a resolution setting forth a 30 day
abatement period and listing the required actions by which the property owner must
clear said violation(s).
Should the Council approve the resolution declaring a public nuisance, this resolution
is served on the property owner. If abatement is not completed by the property owner
within the 30 day period, the City may then cause to have such action taken and assess
all costs for clean-up, repair work and all administrative costs upon the property
owner. The City Council would also review and approve the written report which states
all costs prior to assessing the property owner.

CONCLUSION
Based upon the history of code enforcement action by staff in the past and the recent
failure of the property owner to respond to the recent requests for action, staff
recommends that the City Council approve Resolution No. 89-4 which lists the above
mentioned violations and includes the following list of requested abatement actions:
1. Fence property with required fencing or drain pool.
2. Renew and obtain needed building permits.
3. Finish all exterior work.
This resolution sets a date of February 6, 1989 for the purposes of conducting the
required public hearing pursuant to the Nuisance Abatement Regulations.

Dear Mr. Grobe:
On February 5, 1988, the City of Tustin delivered the
enclosed Notice and Order requiring that certain efforts be made
to clean up the property located at 13662 Green Valley Drive,
Tustin, California (Assessor's Parcel No. 500-082-07). The
Notice and Order required the work to commence within thirty (30)
days of receipt of the Notice and OrdeT. As of this date the
Building Official informs us that a fence has been placed around
the swimming pool and trash has been removed from the front yard;
however, no effort has been made to comply with other items
listed in the Notice and Order (see Items 1B-D, 2 and 3 on page
2), no contact has been made with the Building Division as per
requested; nor has there been an appeal to the Notice and Order
in accordance with the procedure set forth in the Tustin
Municipal Code.
As City Attorney for the City of Tustin, our office has been
requested to commence abatement proceedings against the
aforementioned property.
