'i ~ ..?A, ~ CONSENT CALENDAR DATE: JANTJARY 31, 1989 ~ TO: FROM: WILLIAM HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: JAMBOREE ROAD PIPELINE AGREEMENT WITH MWDOC ,,, J RECOMMENDATION: That the Tustin City Council at their meeting of February 6, 1989 approve the Jamboree Road pipeline agreement with Municipal Water District of Orange County and authorize the Mayor to execute said agreement subject to final approval of the City Attorney's office. BACKGROUND: The City of Tustin, through Assessment District No. 86-2, is constructing Jamboree Road between Irvine Boulevard and Chapman Avenue in Orange with full street improvements. The grading and drainage phase is currently under construction as Stage I and the hard surface improvements scheduled to commence in May 1989 with completion in November 1989. · The current alignment of Jamboree'Road traverses an underground water transmission pipeline commonly known as the Allen-McColloch Pipeline (AMP) which is owned and maintained by the Municipal Water District of Orange County (MWDOC). A future 66" diameter pipeline parallel to the existing AMP is planned by MWDOC some time after the completion of the Jamboree Road improvements. DISCUSSION: In order to avoid re-excavating the finished Jamboree Road improvements, MWDOC desires to install 400 L.F. of ninety-inch (90") diameter pipeline casing parallel to the existing AMP and underlying the Jamboree Road improvements. MWDOC has negotiated a cost for said work with the City's contractor, Yeager Construction Company, in the amount of $174,000.00 and requests the City to add' this work to our current Jamboree Road contract. The attached agreement provides for MWDOC to reimburse the City the full constrEction cost Of all work to install the 90" pipeline casing and reimburse the City for all inspection, engineering and administration cost to complete said extra work associated with the 90" pipeline. This agreement has been approved in concept by the City Attorney's office and is undergoing some minor changes as suggested by that office. It is requested that this agreement be approved by City Council subject to final approval by the City Attorney. This work will not hawe any financial impact on the City or Assessment District No. 86-2. Bob Leden'decker Director of Public Works/City Engineer AGREEMENT FOR INSTALLATION OF PIPELINE UNDERCROSSING IN EXTENSION OF JAMBOREE ROAD THIS AGREEMENT IS ENTERED INTO this day of January, 1989 by and between the CITY OF TUSTIN ASSESSMENT DISTRICT NO. 86-2 ("DISTRICT"), and MUNICIPAL WATER DISTRICT OF ORANGE COUNTY ("MWDOC"), a municipal water district. RECITALS WHEREAS, DISTRIC~ has commenced construction of an extension of Jamboree Road between Tustin Ranch Road and Chapman Avenue in the vicinity of Peters Canyon; and WHEREAS, the ~lignment of the extension of ~amboree Road under construction in the vicinity of Peters Canyon traverses an underground water ~ransmission pipeline commonly known as the Allen-McColloch Pipeline ("AMP"), which is owned, operated and _ maintained by MWDOC for the benefit of eleven water agencies which lease capacity therein; and WHEREAS, the Board of Directors of MWDOC has approved a project, designated as the AMP Flow Augmentation Project ("AMP Project"), which consists in part, of the construction of a 66" underground pipeline, parallel to the existing AMP in the area where it is traversed by. the alignment of the Jamboree Road extension; and WHEREAS, the grading of the Jamboree Road extension is being completed at this time and the construction schedule calls for installation of storm drains and other utilities during the months of January and February, 1989 and start of the roadway paving contract in March, 1989, prior .to the time construction 1 contracts for' the AMP Project are exDected to be awarded; and WHEREAS, substantial additional costs and the potential disruption of traff-ic along -the Jamboree Road extension associated with the construction' of -the AMP Project can be avoided by the installation of a ninety-inch (90') diameter pipeline casing in the four hundred-foot section of the parallel pipeline alignmen~ where it will cross the Jamboree Road extension during the road construction, so that the Darallel pipeline may be constructed later, without excavating across or boring or tunnelling under Jamboree Road; and .... WHEREAS, DISTRICT has obtained a firm_ price from the contractor performing the Jamboree Road construction, Yaeger Construction, for the installation of the ninety-inch casing as a part of the construction activities for an additional sum of $174,000.00; and WHEREAS, DISTRICT and MWDOC have determined that it is in the best interest of all parties that the four hundred-foot segment of casing be installed under the Jamboree Road extension during its construction; NOW, THEREFORE, DISTRICT and MWDOC agree as follows: 1. DISTRICT shall immediately cause a change order to be made to · its cons%ruction contract with Yaeger Construction, providing for the installation of four hundred feet (400') of ninety-inch (90") diameter steel casing pipe across the Jamboree Road extension in accordance with plans and specifications. approved by DISTRICT and MWDOC. Specifications are attached as Exhibit "A". Plans are attached as Exhibit "B". 2. MWDOC shall, uDon execution of this Agreement, deDosit with DISTRICT theI sum of One Hundred Seventy-Four...Thousand. Dollars ($174,000.00) to reimburse DISTRICT for the cost ~f the-.' · change order, Dlus~the sum of Two-Thousand Dollars ($2,000.00) -to reimburse DISTRICT for engineering and administration costs _ ~s~0ciated with the change order. MWDOC shall not be obligated to DISTRICT for any increased or additional costs or charges unless said additional or increased costs or charges are aDDroved by MWDOC in advance. 3. DISTRICT shall administer the construction contraCt and change order and Drovide on-site suDervis_ion and insDection of the work called for in the change order and cause the work to be comDleted, in accordance with the sDecifications. Notwithstanding the foregoing, MWDOC may, at its oDtion, Drovide its own engineers to insDect that portion of the work Derformed under the change order and to notify DISTRICT of any Droblems. DISTRICT shall cause the contractor to be Daid or Dayment to be withheld on the change order in accordance with the terms and conditions of its construction contract. '.' 4. The installation of the 90" casing 'shall be performed at such time and in such a manner as directed by DISTRICT to avoid interference with or delay of the comDletion of the Jamboree Road extension. 5. DISTRICT shall indemnify and hold MWDOC harmless from any and all liability, damages, claims, obligations, actions, 'or injuries in any way arising out of the construction contract or out of the construction activities whether in connection with the change order or any Dart of the contract for the construction of the Jamboree Road extension~ CITY OF TUSTIN ASSESSMENT DISTRICT NUMBER 86-2 By.
