CITY COUNCIL APPROVAL OF SIGN CODE EXCEPTION
RECOI,~ENDATION
It is recommended that the City Council adopt Resolution No. 89-18 approving a
Sign Code exception authorizing Abigail Abbott Personnel Companies to display a
flag bearing their company name at 660 West First Street.
BACKGROUND
Abigail Abbott Personnel Companies has requested an exception to the City's Sign
Code to display a flag bearing their company name. Such a display is not listed
as an allowable sign for a professional office building; however,, pursuant to
Section 9470 of the City's Sign Ordinance,* the subject request can be authorized
by a Sign Code exception granted by the City Council.

DISCUSSION -..
On August 6, 1984, the City Council approved a Sign Code exception for Abigail
Abbott Personnel Companies at 660 West First Street to allow the placement of a
20 square foot wood monument sign in lieu of the 12 square feet permitted in the
sign code. In making this request, Abigail Abbott volunteered to forego
placement of a six (6) square foot tenant identification sign that they would
otherwise be permitted to display over the entrance of the building. The
exception was granted wi th the condition "That no other signing would be
permitted at the subject location as long as the 20 square foot sign is in
place.". To date, no additional signage has been placed on the building.
The current request is to hang an Abigail Abbott flag on their existing 35 foot
tall flag pole located near the entrance to the building, underneath the
Amertcan flag. The extsttng Amertcan flag measures 8' x 12'; however, due to
structural and aesthetic considerations, If thts request Is approved, they would
reduce the American flag to 5' x 8', and the Abigail Abbott flag would measure
3' x 5' in size. Colors of the proposed flag would tnclude a green background
with whtte lettering. Copy 'would consist of just the name: "Abigail Abbott",
using the company's logo/letter type.

When constdertng-a Sign Code exception, Sectfon 9470 of the City Sign Ordinance
states that the City Counctl must determine that at least one of the following
crlterla apply:

Subject property developed with structural setback more than two tines the
minimum front setback requirenent of the district.

Subject property frontage is at least 75~ of the minimum frontage
requirenents for the signing.

Proposed signing does not exceed ~re than one in number nor more than 15~
in the area of the aggregate size Of signs authorized by the criteria of
the district.
4. The proposed signing would be in substantial conformance with the purposes
and intent of this Chapter and would not constitute a health or safety
violation as described in Part 4 of the Sign Code.
Despite the previous Sign Code exception.granted in 1984 and its accompanying
restriction on additional signage, staff believes that the requested flag is
justified in that the existing 20 square foot monunent sign is placed parallel
to First Street, reducing its visibility to passing vehicles. A 3' x 5' flag
would greatly increase the visibility of Abigail Abbott without being garish or
contributing to sign clutter. Staff believes that this satisfies the fourth
criteria, in that the proposed flag would be in substantial confornmnce with the
purpose and intent of the Sign Code, providing reasonable visibility without
resulting in sign clutter.
Should the City Council approve this request, it would be appropriate to apply
the following conditions:

One (1) flag bearing the nanm "Abigail Abbott" nmy be hung on the existing
flag pole, underneath the Anmrican flag. The Anerican flag shall not
exceed 5' x 8' in size and the Abigail Abbott flag shall not exceed 3' x 5'
in size. All flags shall be . nmi ntai ned in a good state of repair and shall
be replaced when they becone torn, frayed, faded or otherwise visibly
danaged.

No additional exterior signing will be permitted at the subject property as
long as the 20 square foot monument Sign and Abigail Abbott flag are in
place.

A RESOLUTION .OF' THE CITY COUNCIL OF THE CITY OF
TUSTIN, AUTHORIZING A SIGN CODE EXCEPTION FOR ABIGAIL
ABBOTT PERSONNEL COMPANIES FOR THE PURPOSES OF
DISPLAYING A 15 SQUARE FOOT CORPORATE FLAG AT 660 WEST
FIRST STREET.
The City Council of the City of Tustin does hereby resolve as
follows:
The City Council does hereby find and determine as follows:

That a proper application for a Sign Code exception has been
filed on behalf of Abigail Abbott Personnel Companies for the
purposes of displaying a 15 square foot corporate flag at 660
West First Street.
That pursuant to Section 9470 of the City's Sign Code,
appropriate criteria required prior to Council granting a Sign
Code exception are present with the subject request.

That the display requested is consistent with the intent of
the Sign Code ordinance in that the purpose of the Sign Code
is for business identity and said display will be for business
i denti fi cati on.
II. The City Council hereby approves the Sign Code exception for Abigail
Abbott Personnel Companies to display a 15 square foot corporate flag
at 660 West First Street subject to the following conditions:
One (1) flag bearing the name "Abigail Abbott" may be hung on
the existing flag pole, underneath the American flag. The.
American flag shall not exceed 5' x 8' in size and the Abigail
Abbott flag shall not exceed 3' x 5' in size. All flags shall
be maintained in a good state, of repair and shall be replaced
when they become torn, frayed, faded or otherwise visibly
damaged.
