A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
APPROVING FINAL PARCEL MAP 2002-106 TO SUBDIVIDE A 1.62
ACRE PARCEL CURRENTLY DEVELOPED WITH A CAR WASH,
CONVENIENCE STORE, AND FUELING STATION CANOPY AND A
RETAIL BUILDING INTO TWO (2) PARCELS FOR CONVEYANCE
PURPOSES.
The City Council of the City of Tustin does hereby resolve as follows:
1. The City Council finds and determines as follows:
A.
Final Parcel Map 2002-106 to subdivide a 1.62 acre parcel with existing
development into two (2) parcels of 0.57 and 1.05 acres located at 535
E. Main Street, for conveyance purposes, was submitted by Tom
Baumgartner on behalf of Tustin Car Wash for consideration. The 0.57
parcel (Parcel 1) will contain a 4,773 square foot retail building and the
1.05 parcel (Parcel 2) will contain the carwash, 1,236 square foot
convenience store, and fueling station canopy;
B.
The Planning Commission recommended that the City Council approve
Tentative Parcel Map 2002-106 on August 26, 2002, and the City
Council approved Tentative Parcel Map 2002-106 on September 3,
2002;
C.
The proposed subdivision is in conformance with the Tustin Area
General Plan, Tustin Zoning Code, State Subdivision Map Act, the City's
Subdivision Code, and has been determined to be consistent or has
been conditioned to be consistent with the Air Quality Sub-Element;
D. The site is physically suitable for the type of development proposed;
E. The site is physically suitable for the proposed density of development;
F.
The design of the proposed improvements is not likely to cause
substantial environmental damage or substantially and avoidably injure
fish or wildlife in their habitat;
G.
The types of improvements proposed are not likely to cause public health
problems;
H.
Reciprocal access for parking, ingress, egress, common trash and
utilities and continuous maintenance of the common areas will be
ensured through a covenant of easement with maintenance provisions

approved by the City Attorney, which will be recorded with the final
map;
I.
All necessary easements and dedications have been shown on the
map and associated improvements have been installed; and,
J.
Final Parcel Map 2002-106 is Categorically Exempt (Class 15) from the
provisions of the California Environmental Quality Act pursuant to
Section 15315 of Title 14, Chapter 3 of the California Code of
Regulations (Guidelines for the California Environmental Quality Act).
II.
The City Council hereby approves Final Parcel Map 2002-106 to subdivide a
1.62 acre parcel into two (2) parcels that are 0.57 and 1.05 acres located at 535
E. Main Street for conveyance purposes.
PASSED AND ADOPTED at a regular meeti, pg of the Tustin City Council, held on the
2nd day of June 2003.
