RES 03-079RESOLUTION NO. 03-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MAKING FINDINGS UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WITH RESPECT TO THE ADOPTION OF THE REDEVELOPMENT PLAN FOR THE MCAS TUSTIN REDEVELOPMENT PROJECT The City Council of the City of Tustin finds as follows: A. The former Marine Corps Air Station ("MCAS") Tustin was officially closed on July 2, 1999, as a result of the recommendations of the Federal Base Closure and Realignment Commission; and B. the City of Tustin ("City") has been designated as the Local Redevelopment Authority for the reuse of MCAS Tustin and acting as such approved a reuse plan (the "Reuse Plan")in October 1996, and amended in September 1998; and C. The Reuse Plan was prepared in conjunction with the MCAS Tustin Specific Plan (the "Specific Plan"), which provides zoning and land use regulations for the former base and was approved by the City on February 3, 2003; and D. In accordance with the provisions of the National Environmental Policy Act ("NEPA") and the California Environmental Quality Act ("CEQA"), the federal government and the City prepared a Joint Final Environmental Impact Statement/Environmental Impact Report for the disposal and reuse of MCAS Tustin (the "Program FEIS/EIR") that was certified by the City on January 16, 2001; and E. A Redevelopment Plan ("Redevelopment Plan") for the MCAS Tustin Redevelopment Project has been prepared by the Tustin Community Redevelopment Agency pursuant to the Community Redevelopment Law of the State of California (Health & Safety Code Section 33000 et seq.) including Chapter 4.5 commencing with Section 33492, et seq., and special legislation pertaining to the realignment and closure of MCAS Tustin contained in Section 33492.100 et seq.; and F. The Program FEIS/EIR considered the environmental consequences of the implementation of the reuse alternative including the establishment of a redevelopment project area at MCAS Tustin (the "Project"); and G. An Environmental Analysis Checklist ("Checklist") for projects with previously certified/approved environmental documents has been prepared which concludes that although the adoption of the Resolution No. 03-79 June 2, 2003 Page 2 Redevelopment Plan could have a significant effect on the environment, there will not be a significant effect in this case because all potentially significant effects (1) have been analyzed adequately in the Program FEIS/EIR pursuant to applicable standards, and (2) any such significant effects have been avoided or mitigated purSuant to the' Program FEIS/EIR, including revisions or mitigation measures that have been imposed upon the proposed Project. Unavoidable significant environmental effects identified in the Program FEIS/EIR have been determined by the Tustin City Council to be outweighed by the economic, social, or other benefits of the Community Reuse Plan as set forth in the findings of fact and Statement of ©verriding Considerations adopted by the Tustin City Council on January 16, 2003. NOW, THEREFORE, the City Council of the City of Tustin resolves as follows: 1. On the basis of the Initial Study, the City hereby finds and determines as follows: A, No substantial changes are proposed in the Project which will require major revisions of the Program FEIR/EIS due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. B, No substantial changes have occurred with respect to the circumstances under which the Project is undertaken which will require major revisions of the Program FEIR/EIS due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. C, No new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the Program FEIS/EIR was certified as complete, shows any of the following: (i) The Project will have one or more significant effects not discussed in the Program FEIS/EIR; (ii) Significant effects previously examined will be substantially more severe than shown in the Program FEIS/EIR; iii. Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would Resolution No. 03-79 June 2, 2003 Page 3 substantially reduce one or more significant effects of the Project, but the Project proponents decline to adopt the mitigation measure or alternative; (iv) Mitigation measures or alternatives which are considerably different from those analyzed in the Program FEIS/EIR would substantially reduce one or more significant effects on the environment, but the Project proponents decline to adopt the mitigation measure or alternative. 2. No subsequent or supplement to the Program FEIS/EIR is necessary or required. 3. Adoption of the Redevelopment Plan will have no significant effect on the environment except as identified and considered in the Program FEIS/EIR.
