HUSTON, CITY MANAGER AGREEMENT - KBNNB'Iq~ ENANUELB AND /%8SOCI~TES ~mmm~ il m J RECOMMENDATION: That the City Council authorize the City Manager to execute an agreement with Kenneth Emanuels and Associates for State legislative information. DISCUSSION: There are two bills pending in the State Assembly and Senate regarding consolidation of the Orange County Transportation Commission (OCTC) and the Orange Couhty Transit' District (OCTD). The bills, SB838 and AB2216, would have a significant impact on Tustin and other cities. Because of the city's involvement in negotiations concerning these bills, it is essential to have access to timely and accurate information regarding, activity in Sacramento as the bills proceed through the legislative process. Mr. Emanuels is the former chief legislative analyst for the League of California Cities. For a fee of $400 per month, his firm will monitor the status of SB835 and AB2216 and provide the City with reports which will assist the City in its efforts to protect the City's interests. If, during the term of the agreement, there is no activity regarding SB838 and AB2216, Ken Emanuels and Associates would be able to assist the City 'in monitoring other legislation affecting the City, such as growth control and annexation. A: 111 ~ J AGREEMENT 'This Agreement made and executed a~ Tustin, California, effective April 1, 1989, by and between the CITY OF TUSTIN, hereinafter called CITY, and KENNETH J. EMANUELS, dba KENNETH EMANUELS & ASSOCIATES, hereinafter called CONTRACTOR. WITNESSETH: The City hires the Contractor and the Contractor agrees to work for the City on the following terms and conditions: I The duty of the Contractor shall be to provide legislative information and status regarding SB 838 (Bergeson) and AB 2216 (Ferguson) and other directly related legislation affecting the consolidation of'transportation planning and operating agencies in Orange County. II The City shall pay to Contractor the sum of $4,800.00 payable at the 'rate of $400.00 per month from April 1, 1989 to March 31, 1990. III It is understood that the City wfll not be responsible for any obligations of an employer. Specifically, the Contractor shall furnish his own means of transportation, miscellaneous supplies, and incidental expenses. It shall' be understood that the contractor shall not incur any additional expenses on behalf of the City of Tustin. IV It is understood and aBreed that either the City or the Contractor may terminate this A. Breement at any given time by giving thirty (30) days notice to the other party.
