SUBJECT: APPROVAL OF PROFESSIONAL SERVICES AGREEMENT FOR ASSESSMENT
~ DISTRICT NO. 86-2, STORM DRAIN DESIGN (PHASE. IV) J
RECOMMENDATION:
That the Tustin City Council at their meeting of April 17, 1989 approve
the Professional Services Agreement with Hunsaker and Associates Irvine,
Inc. to perform the engineering design services for the Assessment
District No. 86-2 Storm Drain design (Phase IV) for a fee in the amount
of $44,664.00, and authorize the Mayor to execute said agreement and to
authorize the firm of GPS Consulting Engineers to perform plan check
services for the project.
BACKGROUND:
Assessment District 86-2 provides' for the design and construction/
installation of certain public infrastructure improvements within the
District. The Phase , IV storm drain improvements are included within
these infrastructure improvements.
Staff solicited proposals from a total of five consultant firms and
received responses from all of the five following firms:
Hunsaker and Associates, InC. of Irvine
GPS Consulting Civil Engrs. of Tustin
Robert Bein, William Frost & Assoc. of Irvine
Adams-Streeter, Inc. of Irvine
CDC Engineering, Inc. of Irvine
DISCUSSION:
The proposed fees for said design work ranged from $44,664.00 to
$109,000.00. Staff is recommending that the firm of Hunsaker and
Associates be selected to provide the engineering Services for the AD
86-2 storm drain design for a fee of $44,664..00'. This firm has-provided
several other design services for both the Assessment District and the
developer (The Irvine Company) in the immediate area and is well
qualified to perform said work.
It is also recommended that the firm of GPS Consulting Engineers be
approved as the City's plan check consultant for this project.
The attached Professional Services Agreement is the standard format
which has been previously utilized by the City and approved by'the City
Attorney's office. '

This project will not impact the City's 1988-89 General Fund budget
because all design costs will be funded by Assessment District No. 86-2.

PROFESS'tONaL SERV'rCES A~REEHENT
THIS AGREEMENT, made and entered into this day of
, 1989, by and between CITY OF TUSTIN, a municipal
corporation (hereinafter referred to as "City"); and HUNSAKER AND
ASSOCIATES IRVINE, INC., Three Hughes, Irvine, CA 92718 (hereinafter
called "Consultant").
WITNESSETH:
WHEREAS, City desires to employ Consultant to furnish the necessary
services for providing engineering design services and construction
surveying for the East Tustin Phase IV Assessment District No. 86-2 Storm
Drain Facilities hereinafter referred to as "Project"; and
WHEREAS, Consultant is qualified ~o provide the necessarY services
in connection with said Project and has agreed to provide the necessary
services; and
WHEREAS, Consultant has submitted to City a proposal dated March 27,
1989, a copy of which is attached hereto marked Exhibit "A", and is by
this reference incorporated herein as though set forth in full herein
("the Proposal").
NOW, THEREFORE, City agrees to employ and does 'hereby employ
ConSultant to provide the professional services .for the Project, and City
and Consultant for the consideration hereinafter set forth; agree as
follows:
Section 1: Scope of Consultant's Services. COnsultant agrees to
furnish to City consulting services for the project. These services
shall include all of the services outlined in Consultant's proposal
(Exhibit "A") ·

Section 2: Time for Completion. It is hereby understood and

mutually agreed that the time for completion of the work to be performed

Section 3: Compensation. The compensation to be paid under this
agreement shall be as set forth in Exhibit "A". Monthly payments for
work completed will be paid as the work progresses, within thirty (30)
days of the date of consultant's invoice.
Section .4: Miscellaneous Provisions.
A. City and Consultant further agree to the following conditions:
(1) City, by notifying Consultant.in writing, shall have the
right to terminate any or all of the services covered by this agreement
at any time. In the event of such termination, Consultant shall be paid
for services rendered to the effective date of the termination.
(2) Consultant agrees that it shall proceed immediately and
diligently to perform the services provided for in this agreement- upon
receipt of notice from City to proceed therewith.
(3) The terms and provisions of this Agreement shall extend to
and be binding upon and inure to the benefit of heirs, executors,
administrators, successors and assigns of the respective parties thereto.

(4) Consultant shall perform the services hereunder as an
independent contractor and under no circumstances or conditions shall
Consultant and. any of. its agents, servants and employees, be considered

as an employee or agent-of the City.
(5) Consultant shall perform all services required under this
agreement using that degree of care and skill ordinarily exercised under
similar conditions in similar localities, and shall be responsible for
all errors and omissions for services performed by Consultant under the
terms of this'agreement. Consultant agrees to indemnify, defend and hold
City, its agents, employees, successors and assigns, harmless from any
loss, damage, injury, sickness, death, or other claim made by other
persons and from all costs, expenses and charges, including attorney's
fees, arising from. Consultant's negligent performance of this agreement.
Consultant shall maintain in full force and effect during the term of
this agreement, its existing policies of insurance far which certificates
of insurance have heretofore been delivered to City.
(6) Consultant shall carry and .pay for. such compensation
insurance as is necessary to fully protect Consultant and its employees
under California Worker's Compensation Insurance and Safety laws, to
relieve City from all responsibility under said laws in -connection with
the performance of this agreement, and upon execution of this agreement,
to file with City a certificate certifying to said protection.
(7) Consultant certifies that there shall be no discrimination
against any employee who is employed in the work covered by this

agreement, or against any application for such employment, because of
race, religion, color, sex, or national origin including, but not limited
to, the following:
a. Employment, upgrading, demotion or transfer,
recruitment', or recruitment advertising, lay-off
or termination, rates of pay or other forms of
compensation, and selection for training, including
apprenticeship.
(8) Consultant shall provide City monthly with a detailed
itemization of all' work performed, and the fees accrued thereon, in
complete and sufficient detail to fully apprise City thereof.
IN WITNESS WHEREOF, this Agreement was executed by the parties

CONSTRUCTION SURVEYING SERVICES FOR THE EAST TUSTIN PHASE IV
ASSESSMENT DISTRICT 86-2 STORM DRAIN FACILITIES
Dear Bob:
On behalf of Hunsaker &'Associates, Inc. I would like to thank both
you and the City of Tustin for requesting from us a proposal to
provide civil engineering and construction surveying services for the
final design and construction of Assessment District 86-2 storm drain
facilities within Phase IV of the East Tustin Ranch project area. As
I am sure you are aware, Hunsaker & Associates, Inc. has performed
virtually all of the civil engineering, land surveying and construc-
tion surveying services for Phase II, III-and IV within the East
Tustin Ranch project area. This work entailed complete design of all
rough grading, street improvements and storm drain facilities for both
privately constructed facilities as well as Assessment District con-
structed facilities. This work also. included the design and construc-
tion of the Orange County Master Plan facility known as Lower Peters
Canyon Retarding Bosin. A part of the design for the Retarding Basin
was the design and-approval of a major diversion of fl'ows to: the
retarding basin. This diversion is indeed the improvements which this
proposal addresses. Hunsaker & Associates, Inc. was the design engi-
neer who developed this diversion and saw to it that it was approved
by the City of Tustin and County of Orange. Also, as a part of this
diversion 'design. it was necessary that Hunsaker & Associates, Inc.
prepare and get approved (see letter dated February 1, 1989 from Pat
Stanton to you) a separate study for a 24 hour 1000 year storm and its
effect on the overall drainage basin. In addition, in your hands for
review and approval is the Hunsaker & Associates, Inc. current Phase
IV (Tract 13627) Hydrology Study which does include the tributary
areas and preliminary storm drain design for the exact Assessment
District 86-2 facilities within your request for proposal. Also, it
should be noted that Hunsaker & Associates, Inc. has prepared to date
all maps and legal documents associated with. all of the above 'improye-
ments in addition to providing to the City all current construction

staking for the above mentioned facilities. I hope this brief expla-
nation of Hunsaker & Associates, Inc.'s involvement in the entire East
Tustin Ranch project area will help in your decision making process as
to our knowledge of the project and also in your evaluation of our
ability to perform.
The following is a breakdown of the Scope of Services which will be
provided and associated fee for each -item.
I. PRELIMINARY ENGINEERING
A. Provide the required calculations and exhibits associated with
the preparation and approval of a complete Hydrology Study.
This study is to be based upon the current Orange County
Environmental ' Management Agency Hydrology Manual.
The associated fee for this work is
$ 976.00
B. Provide all hydraulic calculations necessary to provide pre-
liminary and final storm drain pipe sizin, g and horizontal
alignment. This is to include mainline storm drain as well as
lateral and inlet design.
The associated fee for this work 'is

SUBTOTAL PRELIMINARY ENGINEERING

II. FINAL ENGINEERING
A. Prepare at 40 scale on mylar final engineering drawings
depicting horizontal and vertical alignments of all storm
drain facilities within Phase IV, East Tustin Ranch,.
Assessment District 86-2. This work is to include the depic-
tion of the final hydraulic,grade line, profiles of all storm
drain laterals and the required construction notes to assure
proper construction of the facilities. This work is to depict
all required horizontal and vertical control data to assure
proper construction of the facilities. This work is to
include a complete title sheet as well as the requi~red sheet
index and detail sheets to assure proper construction of the
facilities. All design is to be done in accordance with cur-
rent Ci.ty of Tustin and, if required, OCEMA design standards
for storm drain facilities.
The associated fee for this work is $21,960.00
B. Prepare one complete set of technical specifications (special)
provisions) intended to support the above prepared improvement

plans for the construction of the required storm drain
facilities. These technical specifications (special
provisions) will be done in accordance with current City stan-
dards and will be done in such a manner as to be eventually
included in both the Assessment District Bid Package and the
Assessment District Contract Documents. The actual inclusion
of these technical specifications in the above mentioned docu-
ments will be done by Hunsaker & Associates, Inc. with 'the
.required "Boiler Plate" sections being provided by the City.
The associated fee for this work is
$ 1,952.00
C. Upon the completion and approval by the City of the final
storm drain improvement plans and technical specifications
{special provisions) provide one time a complete qbantitiy and
cost estimate for the storm drain facilities as designed.
This final quantity and cost estimate will be done in accor-
dance with current City standards and forms and all unit costs
will be agreed upon by all parties prior to the completion of
this work.
The associated fee for this work is

III. CONSTRUCTION SERVICES
A. Provide consultant services for plans and specification inter-
pretation'during both the bidding process and actural con-
struction of the facilities. This work-does include weekly
construction meetings if required. This work also includes the
required field survey supervision during construction. This
work is assumed to take a maximum of 28 hours.

B. Provide the following construction survey items:

1. Line and grade construction stakes for all storm 'drain
mainline and laterals at 25 foot intervals in addition to
all BC's and EC's and grade breaks.
2. One (1) line and grade stake for all junction structures.
This stake to include inlet and outlet elevations and man-
hole rim elevation.

stake to provide outlet elevation and top of curb
elevation.
4.. Upon exposure by the Assessment District Contractor of all
existing facilities which these proposed storm drain
facilities are joining, provide one {1} time horizontal
and vertical verification of the existing facilities.
5. The required horizontal and vertical control to assure
proper line and grade construction of the proposed storm
drain facilities.
The associated fee for this .work is

Hunsaker & Associates, Inc. has reviewed completely the requirements
of this proposal and thoroughly understands the schedule as. put forth
and assures-the City that with our~ current work load we wil~ be able
to meet all the deadline dates as put forth in your schedule and that
we will meet all of your requirements for this proposal. In addition,
I have included our current fee schedule for your review. However, I
should state that typically our fee schedule is adjusted every August
i and that you' should plan on an increase of some 5% in our billable
rates come August 1, 1989. This will not affect our time and materi-
als not to exceed contract with the City other than our billable rates
will rise. Lastly, I would like to point out that this proposal does
not include the preparation or processing of any legal documents for
the purpose of describing easements for the storm drain.
