1989/90 ROBERTI'Z'BERG-MARRIS URBAN OPEN SPACE AND
RECREATION PROGRAM GRANT MONEY APPLICATION
RECOMMENDATION
Approve Resolution #89-52 authorizing application for grant funds
under the Roberti-Z'berg-Harris Urban Open Space and Recreation
Program.
FISCAL IMPACT
From this grant the City would receive $22,893. The Parks and
Recreation Commission has recommended that these monies be
applied towards the Columbus Tustin Phase 2A improvements which
include: installation of a storm drain, .expansion of the parking
lot and perimeter landscaping. The City would be required to
provide a 30 percent local match, approximately $10,000. Two-thirds
of that local match must be provided by the City and one-third
another source. The other sources could be either federal
government funds or funding from other local public agencies. The
Revenue Sharing Funds paid to the City by the County in
1987, $35,000, would easily qualify for the one-third. The
remaining two-thirds, would need to be appropriated from
the General Fund. The Columbus Tustin Phase 2A improvements
are proposed in the 1989/90 Capital Improvement program.
Estimated cost for the improvements is $513,500.
In January, 1989, the City applied for grant funding
through the California Wildlife, Coastal and Park Land
Conservation Act of 1988, Per Capita Program, which provided $138,000
towards the Columbus Tustin Phase 2A projects. Staff also applied
for HCD Block Grant funding which was denied. Other funding
sources available for the project include: the County Revenue
Sharing Funds, remaining monies in the Park Bond fund,
.approximately $16,000 in remaining grant monies from a previous
Columbus Tustin grant, and the Redevelopment Agency.
BACKGROUND
In June, 1988, the voters in California passed Proposition 70,
The California Wildlife, Coastal, Park Land and Conservati'on Act
of'1988. Under this bond act there are three areas where funding
could be provided: a Competitive Program, a Block Grant Program and.
a 'Per Capita Program. The application for the Roberti-Z'berg-
Harris Urban Open Space and Recreation Program, the Block Grant

Program, is due beginning May 1, 1989. The Council must approve
the attached Resolution in order to complete the application process.
At the April meeting of the Parks and Recreation Commission, the
1989/90 Robert-Z'berg Harris Grant Application
Parks and Recreation Commission recommended to once again support
the Columbus Tustin Phase 2A improvement as a high priority and voted
to recommend 'to the Council that the subject grant money be
designated for this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF llJSTIN, CALIFORNIA, APPROVING THE APPLICATION
FOR GRANT FUNDS UNDER THE ROBERTI-Z'BERG-HARRIS -
URBAN OPEN SPACE AND RECREATION PROGRAH
COLUMBUS 'IDS'TIN IMPROVEMENTS PHASE 2A
WHEREAS, the Legislature of the State of California has enacted
the'Roberti-Z'berg-Harris Urban Open Space and Recreation Program,
which provides funds to certain political subdivisions of the.State of
Califoria for acquiring lands and for developing facilities to meet
urban recreation needs; and,
WHEREAS, the State Department of Parks and Recreation has been
delegated the responsibility for the administration of the program,
setting up necessary procedures governing application by local
agencies under the program; and
WHEREAS, said.procedures estabished by the State Department of
Parks and Recreation require the applicant to certify by resolution
the approval of applications prior to submission of said applications
to the State'; and
WHEREAS, said appl'ications contain a certification that the
applicant will comply with all federal, state, and local
environmental, public health, relocation, affirmative action, and
clearinghouse requirements and all other appropriate codes, laws, and
regulations prior to the expenditure of the grant funds; and
WHEREAS, the project(s) applied for under this program must be of
a high priority and satisfy the most urgent park and recreation needs,
with emphasis on unmet needs in the most heavily populated areas;
NOW, THEREFORE, BE IT RESOLVED that the Tustin City Council
hereby: ,
1. Approves the .filing of an application for funding under the
Roberti-Z'berg-Harris Urban Open Space and Recreation program;
and,
Certifies that said agency understands the general provisions of
the agreement; and,

Certifies that said agency has or will have sufficient funds to
operate and maintain the project{s} funded under this program;
and,
4. Certifies that said agency has or will have available, prior to
commencement or any work on the project(s) included in this
application, the required match; and,

Certi-fies that'the' project(s) included in this application
conform to the recreation element of any applicable city or
county general pl an; and
Appoints the City Manager as agent of the City of Tustin to
conduct all negotiations and execOte and submit all documents
including, but not limited to, applications, agreements,
amendments, payment requests, and so on that may be necessary
for the completion of the aforementioned project(s); and
7,
Appoints James G. Rourke as legal counsel for said agency with
authorization to sign the certification on Page I of the
application.
